BID REDACTION ATTESTATION FORM

The West Virginia Public Employees Insurance Agency is subject to public disclosure of all solicitations, bids, and contracts under the West Virginia Freedom of Information Act (FOIA) as described in W. Va. Code §29B-1-1, et seq. If any part of a Vendor’s bid is considered to contain information exempt from public disclosure under the West Virginia Freedom of Information Act

(FOIA), Vendor must submit a redacted copy of their bid to PEIA within 15 business days of the bid closing date. After 15 business days of the bid closing date, if Vendor has not submitted a redacted bid, PEIA will respond to any valid FOIA requests with the unredacted bid in PEIA’s possession.

Vendor understands and attests to the following (please check each box to confirm):

For purposes of redaction, the vendor must be specific as to why a FOIA exemption applies

(W. Va. Code §29B-1-4). Redactions must be “surgical” and not “global,” meaning that, for example, redaction of the number(s) after a percentage (%) or a price ($) mark must leave visible said percentage or price mark. Redactions should, to the greatest extent possible, not consist of whole paragraphs or pages.

Redactions must be accurate and complete

Redactions must be consistent with applicable laws and regulations

Any falsification, omission, or concealment of material fact may subject Vendor to administrative, civil, or criminal liability

PEIA assumes no liability for the accuracy, completion, or legal consistency of the redactions included and Vendor is wholly responsible for the defense of any challenges.
