About this file

This is an Amendment One Questions and Answers document issued by the Kansas Department of Health and Environment's Office of Procurement and Contracts regarding the Lead Testing & Reduction Program Services contract (EVT0010868). The amendment addresses clarifications on proposal submission procedures, bidder information requirements, and scope of work specifications. The RFP requests comprehensive lead testing and reduction services for schools and childcare facilities, including website and data platform development operational within 60 days of award, lead sampling coordination at EPA-certified laboratories, sampling kit distribution, database management, staff training on lead exposure risks, and supply of remediation products including water pitchers, filter kits, bottle filling stations, and drinking fountains. The program will serve approximately 200 facilities annually with at least 25 samples per testing round across two rounds per facility. The amendment specifies that vendors must procure and supply 10,000 sampling kits and conduct 10,000 outlet tests in each of Years 1 and 2, provide remediation support to 50 facilities annually, and deliver 100 drinking fountains, 100 bottle filling stations, 200 water pitchers, and 200 filter kits per year. The proposal closing date is September 24, 2026 at 2:00 PM CST, with the contract term running from the date of award through December 31, 2027, followed by four optional twelve-month renewal periods.

Pricing shall be submitted as lump-sum costs for Year 1 and Year 2, defined as twelve-month periods following the date of award, under a Net 30 indefinite-quantity contract structure with no guaranteed volume. The amendment confirms that the Kansas Department of Health and Environment will not be purchasing supplies directly; vendors must factor procurement and supply costs into their total bids. Budgetary information regarding EPA grant funding amounts, current expenditures, and available contract funds remains undisclosed pending contract award. Electronic signatures are acceptable for electronically submitted proposals. Third-party cloud infrastructure providers such as AWS or Azure may be used for data hosting if located within the United States and approved by the Office of Information Technology Services (OITS). The amendment clarifies that financial statements need only be submitted if required by the specifications in Section 4 of the RFP or if specifically requested by KDHE or the Procurement Negotiation Committee during evaluation. The procurement officer is Lily Lundy, reachable at 785-296-0714 or lily.lundy@ks.gov.

RFP Section

Question

Answer

1. N/A General For the vendor awarded this contract, what are KDHE's expectations regarding the transfer of historical program data (e.g., prior testing results, facility records, and program documentation) from the previous service arrangement, including expected format, timeline, and any data validation requirements?

There is no requirement for that.

2. 11 Section 1.9 – Signature of Proposals

Section 1.9 requires proposals to be signed by an authorized representative by "original signature."

For proposals submitted electronically via email, is a scanned wet-ink signature or an electronic signature (e.g., DocuSign) acceptable on the Signature Sheet and related certification forms?

Vendors may sign electronically submitted proposals in any matter they see fit, so long as required signature forms are submitted as signed.

3. 15 Section 2.4 – Bidder

Information

Section 2.4(f) states a financial statement "may be required" as part of the Bidder Information narrative. Should a financial statement be included with the initial Technical Proposal, or only provided if specifically requested by KDHE or the PNC later in the process?

If the Specifications in Section 4 require this information, vendors must submit within their Technical Proposal; otherwise, they may be requested after.

4. 25 /

Section 4.3 – Scope of Work / Section 4.9 –

Vendor Evaluation

Criteria

Since pricing is requested as a lump sum, can KDHE provide an estimated number of participating schools/childcare facilities, expected sampling volume, and anticipated mitigation-supply volume for Year 1 and Year 2, to support accurate cost proposal development?

Approximately 200 facilities per year and approximately or at least 25 samples per testing round which would include initial testing and follow-up on average, so at least two rounds per facility.

5. 26 Section 4.4 – Requested Services /

Appendix A Line

Specifications

Section 4.4 requires the program website/platform to be developed, hosted, and ready for use within 60 days of award, while the Line Specifications in the Event Details document list a due date of 11/30/2026 for the single line item. Can KDHE confirm whether these represent the same milestone, or clarify what the 11/30/2026 due date specifically refers to?

The Line Specifications within the Event Details are generic, vendors should refer to the requirements laid out within Section 4 of the Bid Documents.

6. 33 Appendix A, Section 4(a)

Data Security - Physical &

Environmental Security

Appendix A states that Data Centers hosting AGENCY data shall be owned, operated, and controlled by the Contractor unless KDHE approves an alternate arrangement in writing. Can KDHE confirm whether use of a third-party cloud infrastructure provider (e.g., AWS, Azure) located within the United States is acceptable, or whether a separate written approval is required as part of contracting?

Yes, if located within the United States and approved by OITS.

7. 37 5 – Cost Sheet

The Cost Sheet requests lump-sum pricing for "Year 1" and "Year 2," but the contract term runs from Date of Award through December 31, 2027 — a period that may not align to two clean 12-month periods.

Can KDHE confirm the specific start and end dates that should be used to define "Year 1" and "Year 2" for cost proposal purposes?

The Contract Term on the Cover Page is a placeholder and is subject to change dependent upon when a contract is awarded. Years 1 and 2 will be twelve-month periods after the Date of Award.

8. 20 3.27 – Proof of

Insurance

What are the required insurance limits for Worker’s Compensation, Public Liability, and Property Damage?

N/A

9. 25 4.1 – Background

How many schools and childcares are eligible for the program? How many have already been tested through the program?

All schools and childcares are eligible.

None are excluded even if they have tested previously.

10. 25 4.1 – Background

The Kansas Department of Health and Environment (KDHE) has been awarded funding from the U.S.

Environmental Protection Agency (EPA) to establish and manage the Voluntary School and Child Care Lead Testing and Reduction Grant Program. How much funding has KDHE received for the Program, how much has been spent to date, and how much is intended to be available for this contract? How many schools or childcare facilities have been sampled under the Program? How many samples have been analyzed? What percentage of samples were above the action level of 10 ppb?

Budgetary information is not at liberty to be disclosed until after contract award.

Regarding the other questions, this is a new contract so this information is not available at this time.

11. 37 5 – Cost Sheet

For the purposes of preparing a cost proposal that is comparable across contractor responses, can KDHE provide quantities for the following line items so bidders are evenly evaluated?

a. The number of sampling kits provided in Year

b. The number of sampling kits provided in Year

c. The number of outlets tested in Year 1

d. The number of outlets tested in Year 2

e. The number of facilities needing remediation support in Year 1
