About this file

This is an Exhibit N form from the Texas Department of Agriculture (TDA) regarding confidential or proprietary information designations for proposal submissions under the Texas Public Information Act (PIA). The document serves as a mandatory disclosure form that respondents must complete and submit with their proposals to indicate whether their submission contains confidential or proprietary information protected from public disclosure. The form provides three checkbox options for respondents: designating their entire proposal as exempt from disclosure with clear marking of confidential information, submitting confidential information with a separate public redacted copy, or certifying that no confidential or proprietary information is included in the proposal. The form emphasizes that blanket assertions of confidentiality may result in adverse rulings from the Office of the Texas Attorney General.

Respondents are required to complete the form by providing their printed name, authorized company name, signature, and date. This exhibit must be submitted as part of the overall response to the Background Checks contract opportunity. The document was last revised on March 7, 2024, and is designed to ensure compliance with Texas PIA requirements while protecting legitimately confidential business information during the procurement process. The form does not address pricing, contract terms, or award specifics, as its sole purpose is to establish the confidentiality status of proposal materials.
