About this file
This is a pre-proposal conference presentation file from the Texas Commission on Environmental Quality (TCEQ) for RFP 582-26-00001 regarding Dry Cleaner Remediation Program Site Activities (DCRPSA). The solicitation seeks contractors to perform environmental remediation services including site assessments, non-engineered corrective actions, and oversight services at dry cleaner sites across Texas. Key activities include soil boring installation, monitoring, and sample collection. The procurement timeline includes a pre-proposal conference on February 19, 2025, questions due by February 25, 2025, HUB subcontracting plan courtesy review deadline of March 3, 2025, and proposal submissions due March 14, 2025 at 3:00 p.m. Central Time. The contract term is five years from September 1, 2025 through August 31, 2030.
The evaluation criteria include company description/organization/management (15%), experience (25%), team qualifications (15%), key personnel qualifications (20%), and price (25%). The program is funded through the Dry Cleaning Facility Release Fund with approximately $3.1 million allocated annually for site work. TCEQ plans to award four statewide contracts. Insurance requirements include commercial automobile liability ($5M per accident), commercial general liability ($6M per occurrence), professional liability ($4M per loss), and contractor's pollution liability ($5M per claim). The program includes a 26% HUB subcontracting goal. The Schedule of Pay Item Prices includes both fixed-price and reimbursable items covering professional labor, equipment, laboratory analyses, and field services. Program scope covers approximately 245 total sites with 170 sites prioritized for work each fiscal year.

Additional information about changes to the insurance requirements:
• The updated insurance language is meant to allow more flexibility for how a vendor can meet the limits specified, whether with the primary policy or an umbrella policy. Previously, in addition to the specific limits, there was an Umbrella Liability Insurance limit that was stated separately and now it is combined under each coverage requirement.
• In recent Remediation Division solicitations, the limit for the Commercial General Liability Insurance (CGL) was increased to $2,000,000 and the limit for the Contractor’s Pollution Liability Insurance (CPL) was increased to $2,000,000; therefore, the new limits for the CGL and CPL are those amounts, plus the $3,000,000 previously included in the Umbrella Liability Insurance limit. It is possible to meet the specified requirements with $2,000,000 in CGL, $2,000,000 in CPL, and $3,000,000 in an Umbrella Liability Insurance policy – just as it was before.
• According to Subarticle 10.6 of the General Terms and Conditions, the subcontractor’s insurance should be commensurate with the portion of the Work that it is performing.
