About this file

This document is a Historically Underutilized Business (HUB) Subcontracting Plan (HSP) form issued by the Texas Department of Licensing and Regulation (TDLR) for motor fuel testing and analysis services. The form outlines the requirements for prime contractors to document their subcontracting plans and good faith efforts to include Texas certified HUB vendors in state contracts. The document includes detailed instructions for completing different sections of the HSP based on whether contractors will be subcontracting portions of the work and to whom those subcontracts will be awarded.

TDLR has established a HUB goal of 26% for other services contracts, specifically targeting gas analysis services under Class Item Description 926/43. The HSP requires contractors bidding on contracts valued at $100,000 or more to provide notice to at least three Texas certified HUBs and two trade organizations about subcontracting opportunities, allowing seven working days for responses. The plan includes detailed forms for documenting subcontractor selection, mentor-protégé relationships, and good faith efforts through either Method A or Method B attachments. Non-compliance with HSP requirements or failure to submit a completed plan will result in bid rejection pursuant to Texas Gov't Code §2161.252(b).

While this HSP Quick Checklist is being provided to merely assist you in readily identifying the sections of the HSP form that you will need to complete, it is very important that you adhere to the instructions in the HSP form and instructions provided by the contracting agency.

NOTE: Responses that do not include a completed HSP shall be rejected pursuant to Texas Gov’t Code §2161.252(b).

SECTION 1:

(mm/dd/yyyy)

The Texas Department of Licensing & Regulation (TDLR) is committed to increasing contracting opportunities with HUBs by contracting directly with HUBs or indirectly through subcontracting opportunities in compliance with Chapter 2161 of the Texas Government Code, and by requesting a HSP for contracts with an expected value of $25,000 to $99,999.

If a bid/proposal/offer to a solicitation with an expected value of $100,000 or more does not contain a completed HSP and supporting documentation, the bid/proposal/offer will be considered non-responsive and will be disqualified. After contract award, Successful Respondent may be subject to debarment pursuant to Section 2161.253(d) of the Texas Government Code if any modifications are made to the HSP without PRIOR approval from TDLR.

For assistance in completing the HSP, Respondent may visit the following website:https://comptroller.texas.gov/purchasing/vendor/hub/

If Respondent is not subcontracting any portion of the contract, Sections 1, 2(a), 3 and 4 must be completed.

If Respondent is subcontracting some portion of the contract, the supporting documentation of “Good Faith Effort” must be demonstrated in either Method A (Attachment A) or Method B (Attachment B).

TDLR’S HUB goal and category for this solicitation is 26.00 percent for other services contracts.

TDLR requests all Respondents to consider utilizing HUBs in subcontracting areas that are listed below; however, this list should not be considered exclusive.
