Questions and Answers for Solicitation
DU208WR-13-R-0001
Question:
There are discrepancies in quantities between these two versions.
"Solicitation_with_Attachments_A-J.pdf." states that the quantity for 0001A is 5282 while the quantity stated in "DU208WR-13-R-0001.pdf" for 1001A is 4442. Which is correct?
Answer:
0001A is for the base year and 1001A is for the first option period, so both numbers are correct.
Question:
Solicitation Number on the Contract states DU208WR-13-R-0001 and Attachment A & B indicate
DU208WR-13-00001. Which Solicitation Number is correct?
Answer:
The correct solicitation number is DU208WR-13-R-0001 and Attachment A&B have been corrected with amendment 2 dated November 14, 2012.
Question:
In reviewing the Historical Data, there are counties listed under Escrow Closing Counties (Page
B-6), which have no data listed on the Historical Data Chart. The missing counties for Texas Area
15 are as follows:
Concho, Crockett, Foard, Hardeman, Irion, Knox, Mason, Menard, Stephens, Sterling, Sutton and
Throckmorton
Answer:
Those counties had no assignments during the time period of the historical data chart.
Question:
There are counties listed in the Historical Data Chart (Page B-7 and B-8) which do not appear to belong to the Solicitation Are DU208WR-13- 0001 (Texas Area 15) . The counties added on the chart do not appear to belong within in Texas Area 15:
Counties of Dallas, Denton, Fannin, Somervell and (blank?) with 25 assignments.
Answer:
There were some assignments made during that historical time period in error and outside of
Texas Area 15. The awarded contractor would have the right to refuse closings outside of the contract areas.
Question:
Historical Data (Pages B-7 and B-8) indicate from October 1, 2011 – October 31, 2012 total assignments were 2,539. October 1, 2011 thru October 31, 2012 is 13 months of data, not 12 months; thus the Historical date would reflect 12 months and 20 additional days.
Answer:
The historical data covers 13 months and 20 days.
Question:
There also appears to be an error in the two years annual contract assignments:
Base Period 5,282 (52% increase for base year above Historical Data for previous year)
Option One 4,442 (43% increase for Option Year One over Historical Data for Oct 1, 2011 –
October 31, 2012)
Option Two-2,975
Option Three – 2,704
Option Four – 2,704
Thus, it would appear there is a possible error on the projected number of assignments?
Answer:
The Base and Option period projections are correct.
Question:
Where is the Price Schedule Form whereby the Bid Proposal Price can be inserted by the
Offeror? Previously this had been broken out by Estimated Total Price by CLIN and by Option
Periods. Does the Offeror now complete the Unit Price (Item.21) and Amount (Item.22) on the
Solicitation /Contract Form in place of the Price Schedule Form?
Answer:
The price schedule was inadvertently left out and has been corrected with amendment 2, dated
November 14, 2012, to the solicitation.
Question:
Why have Texas Area 15 Counties of Concho, Crockett, Foard, Hardeman, Irion, Knox, Mason, Menard, Stephens, Sterling, Sutton and Throckmorton been included in the Historical Data for other Texas Area Solicitations that were recently posted? Are these counties being taken out of
Texas Area 15 on DU208-WR-13-R-0001?
It appears the inclusion of these counties would not be an accurate accounting of the
Assignment Projections on additional new Texas Area Solicitations to be incorrect.
Answer:
Those counties are not being taken out of Texas Area 15.
Question:
Does the Past Performance Evaluations in Attachment I and Attachment J, apply to current and/or previous Closing Agents needing to obtain GTR Prior/Past Performance
Evaluations/Surveys?
Answer:
Yes, Past Performance Evaluations in Attachment I and Attachment J, apply to current and/or previous Closing Agents.
Question:
Do I need to be certified as a minority-owned business in order to submit an offer? Would it be possible to submit an offer and then get certified afterwards, as certification will take a couple of months to complete?
You do not need to be a certified minority-owned businesses in order to respond; this is a small business set-aside. In order to be eligible for award, they would need to need to be registered in
SAM. Who is required to register in SAM?
Any entity wishing to do business with the federal government under a Federal Acquisition
Regulation (FAR)-based contract or applying for federal grants, cooperative agreements or other forms of federal financial assistance through Grants.gov must be registered in SAM. Federal agencies may require entities be registered in SAM for additional processes. Also, consider creating a SAM account if you wish to utilize the full set of capabilities that have been developed in SAM and/or migrated from legacy systems (CCR, FedReg, ORCA and EPLS).
Question:
The description of duties 2.1.4.15 of the Synopsis states that the bid includes the cost of recording. By this, do you mean that that the prevailing bidder pays the cost of recording (as opposed to charging HUD on the closing statement)?
Answer:
The cost of recording the Special Warranty deed or any other documents on behalf of HUD is at the expense of the closing agent. They should pay accordingly. The charge appears on the HUD 1 as a “paid outside of closing” charge.
Question:
Section 4.2.1.1 states that the contractor will receive the sales contract when the escrow is being opened. Does the Contractor prepare the sales contract?
Answer:
No—they receive the contract from the appropriate Asset Manager or in a few cases directly from HUD.
Question:
Section 4.2.3 requires the ordering of a title search. Does a title commitment satisfy this requirement?
Answer:
The format of the title was not defined. Typically for non-title companies, to obtain a commitment is a cost facto. Therefore if the purchaser was not using the closing agent for title work---the contractor would be incurring a cost they could not recover.
Question:
Section 4.5.5.1.2 states that the Contractor will upload a copy of the "note and mortgage documents."
Does HUD provide seller financing, and if so, does Contractor prepare the loan documents? If so, is this included in my bid, or is Contractor allowed to charge an additional amount for loan document preparation?
Answer:
The closing agent is not required to prepare loan documents in connection with HUD transactions. HUD only provides seller type financing in properties located in Asset Control Areas through Purchase Money
Mortgages. There are no special requirements for loan doc preparation. See contract requirements regarding ACA type purchases.
Question:
Good Neighbor Program - does the bid amount include preparation of these documents? If so, what % of transactions typically involve the Good Neighbor loan?
Answer:
Sales to GNND participants is at .5% of our overall transactions.
Question:
Assuming Buyer obtains loan elsewhere, typically there is a title company involved. What % of transactions does Contractor function as title company and issue title insurance?
Answer:
None of the closing agent requirements involved them performing as a title company. We are not contracting for title services. It is common that a closing agent has the ability to issue title insurance as a title provider or as a fee attorney for a title company. But it is not and cannot be a requirement of their contract as written.
Question:
If title company is involved, does contractor still record the deed, or forward for recording as detailed in synopsis (typically, we close through title co. and they record).
Answer:
Closing agent must perform all elements of the PWS regardless of who the purchaser, lender, or buyer elects to obtain title insurance from. The closing agent may not cause any delay or influence a purchaser in any way in regards to obtaining a title policy.
Question:
Question for clarification - is the bid just for the "Base Year", or should the bid be for the Base Year plus each option year?
Answer:
You must bid for the base and all options.
Question:
What was the prevailing bid the last time this region was bid?
Answer:
The prevailing bids for the two contracts in this region were $3,070,375 and $3,135,000.
