PART I

SECTION C

DESCRIPTION/SPECIFICATION/WORK STATEMENT

C.1. BACKGROUND.

The Saint Lawrence Seaway Development Corporation (Corporation) is a wholly owned U.S. Government corporation within the U.S. Department of Transportation which owns and operates that portion of the St. Lawrence Seaway in U.S.

territorial waters between Lake Ontario and Montreal, Canada. The Corporation’s mission is to facilitate the safe and efficient passage of commercial vessels through the Seaway. A major part of this function is the removal of floating aids to navigation (buoys) prior to closing the Seaway for the winter and placing them back in service in the spring during the

Seaway opening. The Corporation owns a barge with a pedestal crane which is utilized for this purpose (the Buoy

Barge).

The Buoy Barge is a 150 ft. long x 60 ft. wide x 10 ft. deep U. S. Army Corps of Engineers’ (Corps) DeLong jack up pier barge that was modified by the U. S. Coast Guard (USCG) for setting and removing buoys. The Buoy Barge is equipped with a pedestal crane Model Number T80-62-82 manufactured by Techcrane International.

C.2. DESCRIPTION OF WORK.

This Request for Proposal is for the design, construction, delivery, installation, and testing/commissioning of a pedestal crane which conforms with these specifications and is designed and constructed to operate in the winter conditions experienced in Massena, New York. This crane is to replace the existing pedestal crane Model Number T80-62-82 manufactured by Techcrane International on the Corporation’s Buoy Barge which is and will be docked at the

Corporation’s Marine Base/Maintenance Facility in Massena, New York for this project/work. This Request for Proposal also includes options for the removal of the existing pedestal crane and for the trade-in value of that crane. The removal of the existing pedestal crane would take place at the Corporation’s Marine Base/Maintenance Facility and the existing crane would be available for pickup/trade-in at that location.

C.3. DRAWINGS AND SPECIFICATIONS.

The reference drawings and specifications have been made available to each offeror in an electronic format on the

Government Point of Entry at https://www.fbo.gov/ for the purpose of preparing their proposals.

C.4. WORK SITE REQUIREMENTS.

a. General. The Offeror acknowledges that he/she has satisfied himself/herself as to the nature and location of the work, the general and local conditions, including but not restricted to those bearing upon transportation, disposal, handling, and storage of materials, availability of labor, water, electric power, roads, uncertainties of weather or similar physical conditions at the site, the conformation and conditions of the ground and structures, and the character of equipment and facilities needed preliminary to and during prosecution of the work. The Offeror further acknowledges that he/she has familiarized himself/herself with the Buoy Barge and the issues that could be encountered while performing the required work insofar as this information is reasonably ascertainable from an inspection of the site as well as from information presented by the reference drawings and these specifications. If the

Offeror fails to properly acquaint himself/herself with the available information and existing work site conditions, he/she will not be relieved from responsibility for properly estimating the cost of successfully performing the work.

The Contractor shall be responsible for performing all work in strict accordance with applicable Corporation and

Occupational Safety and Health Administration (OSHA) safety and health requirements.

b. Utilities.

1. Air. The Contractor shall be responsible for providing and maintaining any compressed air required for the performance of the work. The Contractor's portable air compressor(s) shall be located in areas to be approved by the Contracting Officer's Technical Representative (COTR).

2. Electricity. The Contractor shall provide any electrical power required at his/her own expense.

3. Potable Water. Any potable water required shall be provided by the Contractor at his/her own expense.

4. Sanitation. The Contractor shall provide chemical toilets within his/her work area which shall comply fully with the New York State Department of Health Standards. The capacity of the toilets shall be sufficient to provide for the needs of the Contractor’s people and all waste material from the toilets shall be disposed of away from the site. The Contractor shall be responsible for keeping his/her work areas clean of refuse of any kind and shall dispose of all refuse off the site.

c. Parking Areas. The Contractor and his/her work crews shall park their vehicles in areas designated by the COTR.

Vehicles required to transport equipment and materials to and/or from the work site shall not be parked at the work site for long periods of time without prior approval of the COTR.

d. Work Area. The work site required by this contract will be along the sheetpile wall/dock located on the north side of the Maintenance Building.

e. Restricted Areas. The Contractor will be required to confine his/her operations to the work area, as designated in the previous subparagraph. The access roads, parking areas and Corporation buildings shall be kept free of the

Contractor’s personnel, materials and equipment. When necessary for the Contractor’s personnel, materials, or equipment to occupy these access roads and/or parking areas, the Contractor shall notify the COTR to coordinate this with Corporation operations.

f. Existing Conditions and/or Existing Features. The Buoy Barge will be moored along the sheetpile wall/dock located on the north side of the Maintenance Building. Work shall be performed at that location.

g. Inspection. The Contractor's work will be inspected by the COTR or his designee . The Contracting Officer will have the ultimate authority for project acceptance. It is the Contractor's responsibility to insure that all work conforms to the contract documents. If the COTR, his designee or Corporation Occupational Safety and Health Manager determine that any of the Contractor’s work practices are not conforming to Corporation and OSHA health and safety regulations, they shall immediately notify the Contractor and record it in the daily log. If the deficiency is not corrected in a timely manner or presents an imminent danger, the COTR, his designee or Corporation Occupational

Safety and Health Manager will have the authority to stop the work, but in that case, they must notify the Contracting

Officer and COTR within one (1) hour of such occurrence. The Contractor shall verbally report any accidents immediately to the COTR with a written report to the Contracting Officer with copies to the COTR to follow within twenty-four (24) hours.

C.5. CONTRACTOR-FURNISHED MATERIALS.

The Contractor shall furnish all materials required for the performance of the contract. All materials furnished by the

Contractor shall be of the type and quality described in these specifications and shall be of sufficient quality to perform the intended purpose.

C.6. PLANT.

The Contractor shall furnish all plant required for performance of the contract. The Contractor-furnished plant shall be in satisfactory operating condition and capable of safely and efficiently performing the work. The plant shall be subject to the inspection of the COTR at all times.

C.7. ENVIRONMENT PROTECTION.

a.General. For the purpose of this specification, environment protection is defined as the retention of the environment in its natural state to the greatest possible extent during project construction and the enhancement of the natural appearance in its final condition. Environment protection requires consideration of air, water, and land and involves noise, solid waste management, and management of radiant energy and radioactive materials, as well as other pollutants. In order to prevent and to provide for abatement and control of any environmental pollution arising from the construction activities in the performance of this contract, the Contractor and his/her subcontractors shall identify and comply with all Federal, State, and Local laws and regulations concerning environmental pollution control and abatement. Any non-compliance shall be immediately corrected and the Contracting Officer notified.

b. Notification. The Contracting Officer or her representative will notify the Contractor of any noncompliance

Page 5of41 detected by the Corporation with the aforementioned Federal, State or Local laws or regulations. Such notice, when delivered to the Contractor or his/her authorized representative at the site of the work, shall be deemed sufficient for the purpose. The Contractor shall, after receipt of such notice, immediately inform the COTR of the proposed corrective action and take such action as may be approved. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop order shall be made the subject of a claim for extension of time or for excess costs or damages by the Contractor.

c. Protection of Land Resources. The land resources within the project boundaries and outside the limits of permanent work performed under this contract shall be preserved in their present condition or be restored to a condition after completion of construction that will appear to be natural and not detract from the appearance of the project. The Contractor shall confine his/her construction activities to areas defined by the plans and specifications.

d. Protection of Water Resources. The Contractor shall not pollute the River with fuels, oils, greases, bitumens, calcium chloride, acids, insecticides, herbicides, or other harmful materials. The Contractor shall identify and comply with all applicable Federal, State, County, and Municipal laws concerning pollution of the St. Lawrence River.

C.8. SITE VISIT.

Prospective offerors are strongly recommended to visit the work site prior to entering a proposal to determine the extent of work required. A site visit will be conducted at 1:00 p.m. on Wednesday, April 26, 2017. Arrangements for site visits must be made with the Office of the Associate Administrator, phone 315-764-3251 (no collect calls).

C.9. DISPOSAL OF SPOIL.

Any waste material to be spoiled in the prosecution of the work shall be removed from the work site by the Contractor and disposed of at his/her own expense in strict accordance with New York State Department of Environmental

Conservation regulations.

C.10. DISPOSAL BY BURNING.

Burning will not be permitted.

C.11. SAFETY.

The Williams-Steiger Occupational Safety and Health Act of 1970 (as amended) as set forth in 29 CFR 1926/1910, where applicable, shall govern this contract. A project-specific Worker Health and Safety Plan shall be submitted for approval.

Maintenance work by Corporation personnel will be in progress concurrently with the work under this contract therefore, the work areas may become congested. Only the Contractor's authorized personnel, subcontractors and suppliers shall be allowed to enter the work areas. The Contractor shall fully cooperate with the Corporation in all phases of the work and any disputes which may arise will immediately be brought to the attention of the

Contracting Officer through the COTR.

TECHNICAL PROVISIONS

C.15. SPECIFICATIONS FOR THE NEW PEDESTAL CRANE.

a. Standards.

All electrical installations shall be in compliance with Code of Federal Regulations Title 46

Subchapter “J” and IEEE Standard 45-2002.

All structural installations shall be in compliance with Code of Federal Regulations Title 46 and

American Bureau of Shipping Rules for Classing and Building of Steel Barges 2009.

c. General.

The Contractor shall design, construct, deliver, install, and test/commission a new pedestal mounted crane on the existing pedestal. The Contractor shall modify the existing crane base pedestal and pedestal support structure to satisfy the structural calculation requirements that the Contractor develops for the particular crane provided. The engineering plan for all pedestal modifications shall be approved by the Crane

Manufacturer and the Corporation prior to work performance.

The Contractor shall generate and provide the Corporation with stability calculations for the Buoy Barge based on the crane design, weight, and loading data provided by the Crane Manufacturer.

The Contractor may be required to remove and take possession of the existing crane depending on the Optional Requirements that are awarded.

*Note: References made to work to be accomplished by the Crane Manufacturer, Manufacturer and

Contractor shall all be included in the Cost Proposal. It shall be the choice of the Crane Manufacturer as to whether or not to use a separate Contractor to complete the work for removal of the existing crane and installation of the new crane.

d. Scope of Work.

1. Removal. If the contractor is awarded optional requirement 2, the Contractor shall remove the existing pedestal crane from the pedestal and disconnect the electrical connections to the crane for reconnecting to the new crane. If option 2 is not awarded, removal of the crane will be performed by others.

2. Design, Construction and Installation. The Contractor shall design, construct deliver and install a new pedestal mounted crane meeting the criteria as described herein. This shall include all material and equipment to complete a fully operational crane installation.

3. Installation and Tech Support.

The Contractor shall include in their proposal Manufacturer Tech Rep support for crane installation supervision for the duration of the installation at the Corporation’s Marine base/Maintenance Facility located at 251 Fregoe Road in Massena, New York.

The Contractor shall include in their proposal two days of Manufacturer Tech Rep operator and maintenance training. The training location is to be at the Corporation’s Marine

Base/Maintenance Facility located at 251 Fregoe Road in Massena, New York.

All Manufacturer Tech Rep support shall be included in the Cost Proposal.

4. Pedestal Modification. The Contractor shall modify the existing crane pedestal as/if required to accept the new crane. Modifications shall be to the Manufacturer’s recommendations and shall be in compliance with the requirements of the Pedestal Structural Calculations developed by the Contractor.

Preliminary pedestal structural and vessel stability calculations have been completed by Marine Systems

Corporation based upon the installation of a replacement pedestal mounted crane equal to the Alaska

Marine Crane that had previously been on the Buoy Barge. These structural calculations must be updated to reflect the crane provided. The Contractor is responsible to provide the Corporation updated data that proves the structural integrity of the pedestal and the stability integrity of the barge using the parameters of the crane provided.

e. General Crane Specifications.

1. Type. Self-contained, diesel-driven, pedestal mounted crane for marine application conforming to

ASME B30.8-2004; ABS minimum design standard; API-2C standards; and USCG failsafe operation.

2. ISO Qualification. The vendor shall provide documentation of current ISO Certification.

3. Compliance. The crane shall be, in all respects, in compliance with the following:

Specification for Offshore Pedestal Mounted Cranes, American Petroleum Institute (API)

Specification 2C, Sixth Edition, March 2004.

4. Operation. Simultaneous operation of three or more functions is required. The crane must be certified for personnel lifts in accordance with API-2C.

5. Lift Capacity. Independent lift capacity (one hook at a time) shall be:

Auxiliary hook: Minimum 8,000 lbs. at a radius of 82 ft.

Main hook: Minimum 20,000 lbs. at a radius of 55 ft.

6. Wire Load Line Arrangement. The Corporation buoy setting and retrieval operation uses the main and auxiliary hook in a combined sequence where the buoys and sinkers are worked from the main hook and chain is worked from the auxiliary hook. This operation requires that:

The main hook load line shall be installed under (beneath) the boom to the fixed position main hook head assembly.

The auxiliary hook (fast line) shall be installed on top of (above) the boom to the auxiliary hook head assembly mounted on the telescoping extension.

There shall be a minimum clearance of twenty feet (20 ft.) between the two head assemblies with telescopic section extended so that the falls will remain separated with the boom working loads on deck at minimal radii.

7. Operational Speeds (Approximate). Slew 0 to 2 RPM; Luff 60 seconds; Hoist 45 ft./min.

8. Boom Stowage. Retractable to less than 65 ft. radius for stowing.

9. Cab Operation. Operation from crane-mounted enclosed cab.

10. Side Loads. Crane must be capable of handling side loading during operations. A minimum of two

(2) slew motors shall be installed. Additional slew motors may be required by the Manufacturer’s calculations and design. Side loading in the operation of servicing navigational aids is difficult to quantify as it depends upon constantly changing wind, sea, and current conditions; boom extension;

water depth; lift weight; and vessel position holding. The crane provided must be certified to operate with side loading developed:

With boom hook at 45 ft. from the pedestal base

Water depth of 40 ft.

Sinker weight 7,500 lbs. (3.4 LT), chain weight 3,000 lbs. (1.4 LT)

Sinker pull out loading estimate ½ sinker weight (1.7 LT)

Maximum side angle hook to pick 30 degrees

11. Warranty. The offerors warranty must be submitted with the proposal. The Corporation wishes to acquire the best warranty available but will accept a minimum warranty that encompasses two (2) years or 1,000 hours of operation, whichever comes first due to the limited use of the crane. The warranty period calculation shall commence upon the date of Contract completion and acceptance by the

Corporation.

12. Marine Service. The crane shall be suitable for marine service on a floating hull, rated to be fully revolving with ten (10) degrees of vessel list and three (3) degrees of vessel trim. Compliance shall be with Specification API-2C for in-service operation guidelines in the highest rated wind speeds but no less than 35 MPH.

13. Manufacturer Experience. The Manufacturer shall provide documentation of a minimum five (5) years’ experience in manufacturing this class of marine pedestal crane.

14. Parts and Service. The Manufacturer shall provide, with their proposal, documentation of North

American parts and service availability with response time of parts delivery and/or service representation on-site in the St. Lawrence Seaway geographical area.

15. Drawings and Manuals. The vendor shall provide complete and detailed:

f. Specific Crane Requirements.

Note: All equipment and materials specified shall be that specified or equipment or materials having physical properties and performance characteristics equal to or exceeding those specified.

1. Boom. Telescopic with extended length of 82 ft. minimum to auxiliary hook; maximum retracted length of 65 ft.; material ASTM 514 GR.B or 572 GR.50 steel.

2. Fittings. Hinge pins stainless steel; Fasteners GR.5 or GR.8 except 316 stainless steel in non-critical areas up to ½ in. at the discretion of the Manufacturer; Hoses rated for a burst pressure of 4 times working pressure; Sheaves steel; Bearings Rotek brand shear ball, or equal; cylinder rods chrome.

3. Hydraulic Motors. Rexroth, or equal.

4. Hydraulic Pumps and Fluid. Pumps shall be Rexroth, or equal. Hydraulic fluid shall be environmentally friendly, mineral based fluid Panolin Atlantis biodegradable hydraulic fluid, or equal.

5. Hydraulic Valves. Hydraulic isolation valves shall be installed in the system at each winch and at each major hydraulic component to facilitate maintenance and repair. Valves shall be Rexroth, or equal.

6. Gear Box. Auburn, or equal.

7. Minimum Lift Radius. 15 feet.

8. Maximum Tail Swing Outside Diameter of Pedestal. 7 feet.

9. Swing Drives. Multiple hydraulic swing drives shall rotate superstructure 360° with automatic swing brakes and a positive house lock included.

10. Overload Protection. Provide relief valves for overload protection for swing motors.

11. Winches. Braden planetary, or equal, Main and auxiliary winch capacities as shown on the

Manufacturer’s load chart, for all radii between 25 feet and full extension shall not be less than those specified. Loads shall be the maximums identified for corresponding radii. Both winches to have power-up, power-down feature. Both winches designed for ¾ in. or equivalent wire rope. Main winch holding

400 ft. of cable and auxiliary holding 300 ft. of cable, cable certification is required. Both winches shall be equipped with a 3rd wrap indicator, cable tension drum roller, and drum rotation indicators.

12. Hooks. Main block rated 20-ton will be a double sheave designed for ¾ in. or equal wire rope. Sheaves will have gently rounded lips for high fleet angles, and a swivel hook with a positive locking safety latch. Overhaul ball will be a minimum 7-ton top mounted swiveling unit designed for ¾ in. orequal wire rope, with a positive locking safety latch. Both units will meet OSHA Rule 1926.550 (g).

14. Spooling. LMI and Anti-Two Block Systems with 3 function shutdown.

15. Lubrication Maintenance. All crane lubricating points shall be easily accessible from crane walkways or platforms without need to remove guards or other components.

16. Exhaust System. The diesel engine exhaust system shall be silenced with a silent quality muffler, as a minimum, in order to minimize noise levels in the operator’s cab and on the deck of the barge. The noise level in the crane cab shall not exceed 75 dB(A).

17. Pedestal Adapter. Pedestal adapter with mounting flange machined and match drilled for mounting to slewing bearing.

18. Pedestal. The overall height of the pedestal shall be such that the underside of the crane will provide for nine

(9) feet of headroom from work deck.

19. Handrails. All catwalks and ladders shall be fitted with galvanized handrails. Access to the crane shall be via an installed ladder. The location of the ladder shall be designed to minimize the tail swing radius, preferably hugging the pedestal.

20. Diesel Engine. Self-contained Tier III compliant diesel engine with fuel oil tank and spill containment.

Rated Horsepower: Approx. 150 to 250 sized by Manufacturer to match crane design requirements.

g. Coatings.

The Contractor shall perform surface preparation and apply protective coatings per Manufacturer’s recommendations to all new and disturbed steel. Surfaces shall be cleaned of all dirt and grease. Coatings shall be Sherwin Williams or equal applied as follows:

1 Coat S-W Fast Clad Zinc HS primer – 4 mils Dry Film Thickness (DFT)

1 Coat S-W Duraglide 235 Marine Epoxy Primer – 5 mils DFT white

1 Coat S-W Duraglide 235 Marine Epoxy Primer – 5 mils DFT finish coat to match surroundings An additional coat shall be applied to exterior surfaces as follows:

The crane and ancillary equipment shall be primed and finish coated with a marine acrylic epoxy coating system, 12 mils DFT minimum total.

h. Structural and Stability Calculations.

1. Crane Pedestal Structural Calculations.

The crane is to be mounted on the existing crane pedestal, which is an integral part of the vessel structure. It is the Contractor's responsibility to verify that the existing crane pedestal will support the new crane in all operations required in this Specification.

Preliminary Structural Calculations were done on the previous crane pedestal and are included as MSC

Drawing 3210-003-21 (Addendum A) in Appendix I.

The Contractor will be required to provide independent, PE stamped, structural engineering calculations for the crane pedestal structure using data from the actual crane proposed for the vessel. The Contractor will be required to verify that the pedestal will meet the structural requirements to support the proposed crane with the crane performing all operations required in this Specification.

The Contractor is responsible for providing engineering and design changes to modify the crane pedestal to mount the proposed new crane.

2. Stability Analysis.

The Contractor will be responsible for determining that the crane selected to meet the requirements of this

Specification will not adversely affect vessel stability.

A preliminary stability engineering analysis was done for the Alaskan Crane that was previously on the

Buoy Barge and on an additional, representative crane. These analyses are attached as MSC Drawing

3210-003-22 (Addendum B) in Appendix I.

The Contractor will be required to provide a similar engineering analysis for the actual model crane proposed to fulfill the Contract. The analysis must ensure that the crane installation and operation will not adversely affect the stability of the vessel with the crane performing all operations required in this specification.

All structural and stability calculations are to be provided to the Corporation for approval. The Contractor must receive approval from the Corporation prior to the commencement of crane pedestal modifications or crane installation.

i. Tests and Inspections.

1. Installation Tests.

Installation tests and trials shall be performed according to the Crane Manufacturer’s Specifications and to the approval of the Corporation. All machinery, alarms, sensors, physical operation, etc.

shall be tested and passed to the standards of SAE J1053 and J765; ASME B30.8-2004; and USCG

CFR.

2. Final Inspection.

This Work Specification is Performance Based. The crane installation shall be operated in all modes to the satisfaction of the Corporation and in compliance with the standards listed in C15.a. above. The

Contractor shall load test the crane with certified weights to the Manufacturer’s Specifications. All tests shall be recorded and signed off by the Manufacturer’s Tech Rep and the Corporation.

j. Transfer of Ownership.

1. If the option to take ownership of the crane is awarded, the contractor shall remove the crane from

Corporation Property upon completing the project. The contractor shall be responsible for all cost to remove and transport the crane from the Corporation facility. Title of the crane shall pass to the contractor upon removal from the barge.

C.16. QUALITY ASSURANCE.

a. Quality Control. The shop shall perform routine quality control inspections. Quality control inspections shall include visual examinations of workmanship and verification of dimensional accuracy and tolerances.

b. Quality Assurance. Quality assurance inspections of the Contractor's work will be done by the COTR or his designee.

C.17. SUBMITTALS.

a. Proposal. With the proposal, the offeror shall submit the following, which will be considered in

b. After Award.

1. General. For the purposes of this specification, “approval” of submittals means that the Corporation has reviewed them for completeness and for conformance to the design concepts. “Approval” of any submittal does not relieve the Contractor from responsibility for proper workmanship, material conformance, dimensional accuracy and design adequacy for all components.

2. Shop Drawings. After award and prior to any fabrication, the Contractor shall submit shop drawings, the crane pedestal analysis, and the Buoy Barge stability analysis to the Contracting

Officer’s Technical Representative (COTR) for approval. An electronic version of the shop drawings and analyses shall be submitted to the COTR for approval and no fabrication shall begin until the approval is received.

3. Health and Safety Plan. Prior to any on site work, a site-specific Project Health and Safety Plan shall be submitted.

C.18. SCHEDULE.

The schedule proposed for this project shall be as follows:

Receive Proposals – 5/18/17

Award a contract – 5/31/17

Please Note: If it is possible to have the new crane installed and tested/commissioned before November 15, 2017 so that we can use it to remove buoys in December, that would be acceptable however; if that cannot be completed prior to November 15, 2017, the installation and testing/commissioning will have to take place after the buoys are placed in the spring.

C.19. COMPLETION OF TECHNICAL AND COST PROPOSALS.

Each offeror is required to complete and return an original and three (3) copies each of a Technical and Cost Proposal as outlined below. Each proposal shall consist of a cover page, which indicates the date, the period for which it is valid and a table of contents which identifies all sections with page numbers.

a. Technical Proposals. Each offerors’ proposal shall include sufficient information so that a proper evaluation can be made with respect to the requirements outlined in the Statement of Work. As a minimum, Technical Proposals shall include:

1. Crane Characteristics. A description of the crane to be furnished in sufficient detail so that it is clear how the crane being proposed meets all of the specified requirements (this can include drawings, sketches, cut sheets, etc.). It shall also include details on completing the required analyses.

2. Past Performance. A list of at least three similar cranes/projects completed during the past five years, including as a minimum crane/project description, contract value and owner contact information. These cranes should have been designed and constructed for use in winter temperatures similar to Massena, New York and shall have been used by the owner in those conditions.

D.1. PRESERVATION, PACKAGING, AND MARKING.

Preservation, packaging, and marking for all items delivered shall be according to standard commercial practice and adequate to ensure acceptance by common carrier and safe arrival at destination.

INSPECTION AND ACCEPTANCE

All operational practices of the Contractor and all workmanship, material, equipment, and articles used in the performance of work under this contract shall be in accordance with the best commercial marine practices and the rules and requirements of all appropriate regulatory bodies including, but not limited to the American Bureau of

Shipping, the U.S. Coast Guard, and the Institute of Electrical and Electronic Engineers, in effect at the time of

Contractor's submission of offer, and shall be intended and approved for marine use.

The Corporation may inspect and test all material and workmanship at any time during the Contractor's performance of the work.

The Contractor shall perform work in accordance with the contract, any drawings and specifications made a part of this contract, and any change or modification issued under the Changes clause.

(1) If the Government finds any material or workmanship is defective or not in accordance with the contract the

Corporation may reject the defective or nonconforming material or workmanship and require the Contractor to correct or replace it at the Contractor’s expense.

(2) If the Contractor fails to proceed promptly with the replacement or correction of the material or workmanship, the Corporation may replace or correct the defective or nonconforming material or workmanship and charge the Contractor the excess costs incurred.

(3) As specified in the contract, the Contractor shall provide and maintain an inspection system acceptable to t h e

Government.

The Contractor shall maintain complete records of all inspection work and shall make them available to the Government during performance of the contract and for 180 days after the completion of all work required.

The Contractor shall not permit any welder to work on a vessel unless the welder is, at the time of the work, qualified to the standards established by the U.S. Coast Guard, American Bureau of Shipping, or Department of the Navy for the type of welding being performed.

G.2. REQUIRED INSURANCE

(1)The Contractor shall, at its own expense, obtain and maintain the following insurance—

Casualty, accident, and liability insurance, as approved by the Contracting Officer. As well as

Workers Compensation Insurance (or its equivalent) covering the employees engaged on the work.

(2) The Contractor shall ensure that all subcontractors engaged on the work obtain and maintain the insurance required in paragraph 1.

(3) Upon request of the Contracting Officer, the Contractor shall provide evidence of the insurance required by this solicitation.

G.3. CONTRACTING OFFICER DELEGATION OF AUTHORITY

The Contracting officer may delegate all or part of her authority to administer this contract. Such a delegation will be in writing and will describe the extent of the authority delegated. The Contracting Officer will provide a copy of such delegation to the Contractor.

G.4. CONTRACTING OFFICER'S TECHNICAL REPRESENTATIVE (COTR)

The Contracting Officer may designate Government personnel or other Contractors to act as the Contracting Officer’s

Technical Representative (COTR) to perform functions under the contract such as review and/or inspection and acceptance of supplies, services, including construction, and other functions of a technical nature. The Contracting

Officer will provide a written notice of such designation to the Contractor within five working days after contract award.

The designation letter will set forth the authorities and limitations of the COTR under the contract. The COTR will ensure that the Corporation's project objectives are met, along with providing necessaryinformation, direction, coordination, etc., within the contractual work description. The COTR is not authorized to change any of the terms or conditions of this contract nor sign documents such as contracts or contract modifications.

When in the opinion of the Contractor, the COTR requests work outside the existing scope of the contract, the Contractor shall promptly notify the Contracting Officer in writing. The Contractor shall take no action until the Contracting Officer has issued a contractual change or otherwise resolved the issue. A copy of all written correspondence to the COTR by the

Contractor shall also be mailed or otherwise furnished to the Contracting Officer at the address set forth in Clause G.1.

G.5. ADDITIONAL WORK

a. The Contractor shall not perform any additional work without the Contracting Officer's authorization.

b. The Contractor, in connection with anyproposal he/she makes for a contract modification, shall furnish a price breakdown directlyto the Contracting Officer, itemized as required by the Contracting Officer. Unless otherwise directed, the breakdown shall be in sufficient detail to permit an analysis of all materials, labor, equipment, subcontract, overhead costs, and profit covering all work involved in the modification whether such work was deleted, added or changed. Any amount claimed for subcontracts shall be supported by a separate, similar price breakdown. If the proposal includes a request for a time extension, justification shall be furnished with the proposal.

c. The Contracting Officer reserves the right to accomplish additional work on the basis of a negotiated fixed price when it is in the best interest of the Corporation.

G.6. PROGRESS PAYMENTS

Progress payments,” as used in this clause, means payments made before completion of work in progress under a contract. All payments will be due within 14 days of receipt of a proper invoice.

(a) In order for a Contractor to be considered for payment of progress payments, the Contractor must request, in writing, within five (5) working days after contract award, the inclusion of progress payments in the contract awarded as a result of the solicitation. Written requests must be accompanied by an itemized breakdown of the contract price for performing each item of work.

(b) Upon submission by the Contractor of invoices in the form and number of copies directed by the Contracting

Officer, and as approved by the Contracting Officer, the Corporation will make progress payments as work progresses under the contract.

(1) Generally, the Contractor may submit invoices on a monthly basis, unless expenditures justify a more frequent submission.

(2) The Corporation need not make progress payments for invoices aggregating less than $5,000.

(3) The Contracting Officer shall approve progress payments based on the value, computed on the price of the contract, of labor and materials incorporated in the work, materials suitably stored at the site of the work, and preparatory work completed, less the aggregate of any previous payments.

(4) Upon request, the Contractor will furnish the Contracting Officer any reports concerning expenditures on the work to date that the Contracting Officer may require.

(c) The Corporation will retain until final completion and acceptance of all work covered by the contract, an amount estimated or approved by the Contracting Officer under paragraph (b) of this clause.

The Contracting Officer may direct that progress payments be based on the price of the contract as adjusted as a result of change orders under the Changes clause. If the Contracting Officer does not so direct—

(1) Payments of any increases shall be made from time to time after the amount of the increase is determined under the Changes clause; and

(2) Reductions resulting from decreases shall be made for the purposes of subsequent progress payments as soon as the amounts are determined under the Changes clause.

(d) Upon completion of the work under a contract and final inspection and acceptance, and upon submission of invoices in such form and with such copies as the Contracting Officer may prescribe, the Contractor shall be paid for the price of the contract, as adjusted pursuant to the Changes clause, less any performance reserves deemed necessary by the Contracting Officer, and less the amount of any previous payments.

(e) All materials, equipment, or any other property or work in process covered by the progress payments made by the Corporation, upon the making of those progress payments, shall become the sole property of the Corporation, and are subject to the provisions of the Title clause of the contract.
