Amendment No. 005 Page 2 of 3

U.S. DEPARTMENT OF TRANSPORTATION

FEDERAL HIGHWAY ADMINISTRATION

EASTERN FEDERAL LANDS HIGHWAY DIVISION

Amendment No. 005 Foothills Parkway Design-Build Project FOOT 8E17

Great Smoky Mountains National Park Solicitation: DTFH71-09-R-00007 Request for Qualifications (RFQ)

The purpose of this Amendment is to:

1) Provide a summary of responses to questions/clarifications asked by potential bidders.

Questions/Clarifications

The following are responses to questions/clarifications asked by potential bidders which were received via email at eflhd.contracts@fhwa.dot.gov. Many of the questions received and clarifications provided have been addressed in the previous amendments issued to date; those questions/clarifications not addressed in the amendments are provided here.

1. We understand that FHWA-EFLHD is asking for financial audit reports for the design-build team (contractor and lead designer). The RFQ also states "include audits for all joint venture partners and architect-engineering firm subcontractors." The joint venture aspect is not applicable in our case. However, our design/architect-engineering firm will have one direct civil engineering subcontractor, yet that firm will utilize some specialty firms for depth of services. Do we need to show all the third tier specialty service firms' audit reports, or are we to just include reports for the major participants on the team (the design-builder and the second tier engineering subcontractors)?

Response: If a subcontractor is the lead for a significant part of the work or unique specialty portion of the work, then they would come under the financial audit requirement; if that subcontractor failed and the project could not be completed, then the sub should be included. The FHWA is trying to determine if the lead firms in the development of this project for both the design and construction are financially stable and able to complete the project. If the subcontractor stops being the lead firm, that is where the audit requirement stops.

2. Page IC-15 of the Part I. Instructions to Offerors provides the following direction … Item I.C.4.b 2., second sentence: "Steel structures and AASHTO Girder structures will not be considered." Also the last bullet on that same page indicates in the second sentence of that bullet: "Cast-in-place segmental construction will not be allowed on this project." With this understanding, the question is: Will Cast-in-place on falsework construction be allowed on this project?

mailto:eflhd.contracts@fhwa.dot.gov

Amendment No. 005 Page 3 of 3

Response: The Item I.C.4.b.2., statement "Cast-in-place segmental construction will not be allowed on this project" is incorrect. Cast-in-place segmental construction is allowed.

The current RFP is labeled as a "Draft". At this time we will not issue a revised Draft RFP as part of the RFQ process; a full and corrected RFP will be issued once the Phase One RFQ firms have been selected.

3. Will the Federal Highway Administration, Eastern Federal Lands Highway Division, require that the Offeror be licensed with the Tennessee Board for Licensing Contractors in order to execute the work associated with this solicitation?

Response: We have not made a requirement within the solicitation that the firms be licensed with the Tennessee Board for Licensing Contractors. Because the work is being done on Federal Government Land under a Federal Government Contract, as long as the Contractor has a contractor’s license, that is all we are requiring; the firms may be licensed in any state.

4. For the scope of work envisioned, is a TN Board-certified land surveyor required?

Response: Qualifications for personnel performing construction survey and staking can be found in Section 152 of the FP-03.

5. Under Phase One Submittals, it indicates that interested offerors may use Standard Form

330. If the SF330 form is utilized will Part II forms count toward the 40 page limit?

Response: Each Offeror must provide one original (clearly marked) and seven (7) copies of the completed Statement of Qualifications (SOQ). The SOQ should contain no more than forty (40) pages typed on one side only. The SOQ shall be printed on 8.5" x 11" paper. If dividers are used and contain project-specific information they will be counted as pages. All SOQs shall be printed using the Times New Roman font, regular with a size of 12-points. The SOQ should address each of the rating categories in the same order as listed in the RFQ. Provide one audit report which should be packaged separately and will not count against the forty (40) page total.

6. Is it acceptable for the lead designer to perform in-house QA or is EFLHD expecting an independent peer review performed by an independent consultant?

Response: Yes, it is acceptable for the QA to be performed in-house.

7. Will design, i.e. roadway, geotechnical and structures, be performed in accordance with the AASHTO LRFD Code?

Response: It is not the intent of EFLHD to receive project specific design or engineering recommendations as part of this Phase One selection process. Offerors should limit their SOQ’s for the information required by the RFP.

Amendment No. 005 Page 4 of 3

The Government will require performance of the work according to the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects (FP-

03) and its supplement.

As of 12:00noon EST on Monday, August 31, 2009, all questions received via email at eflhd.contracts@fhwa.dot.gov have either been included above or have been addressed in the previous amendments issued to date. Any questions received after this time will be answered on an individual response basis, unless another amendment is required.
