Construction General Permit

1.2.3. Discharging to Waters with High Water Quality - Eligibility for New Sources.

If you are a "new source" (as defined in Appendix A), you are eligible to discharge to a Tier 2, Tier 2.5, or Tier 3 water only if your discharge will not lower the water quality of the applicable water. In the absence of information demonstrating otherwise, EPA expects that compliance with the stormwater control requirements of this permit, including the requirements applicable to such discharges in Part 3.3.2, will result in discharges that will not lower the water quality of the applicable water. See list of Tier 2, Tier 2.5, and Tier 3 waters in Appendix F.

Note: Your project will be considered to discharge to a Tier 2, Tier 2.5, or Tier 3 water if the first surface water to which you discharge is identified by a state, tribe, or EPA as a Tier 2, Tier 2.5, or Tier 3 water. For discharges that enter a storm sewer system prior to discharge, the first surface water to which you discharge is the waterbody that receives the stormwater discharge from the storm sewer system.

1.2.4. Use of Cationic Treatment Chemicals.

If you plan to use cationic treatment chemicals (as defined in Appendix A), you are ineligible for coverage under this permit, unless you notify your applicable EPA Regional Office in advance and the EPA office authorizes coverage under this permit after you have included appropriate controls and implementation procedures designed to ensure that your use of cationic treatment chemicals will not lead to a violation of water quality standards.

1.3. Types of Discharges Authorized Under the CGP.

The following is a list of discharges that are allowed under the permit provided that appropriate stormwater controls are designed, installed, and maintained:

a. Stormwater discharges, including stormwater runoff, snowmelt runoff, and surface runoff and drainage, associated with construction activity under 40 CFR § 122.26(b)(14) or§ 122.26(b)(15)(i);

b. Stormwater discharges designated by EPA as needing a permit under 40 CFR § 122.26(a)(l)(v) or§ 122.26(b)(15)(ii);

c. Stormwater discharges from construction support activities (e.g., concrete or asphalt batch plants, equipment staging yards, material storage areas, excavated material disposal areas, borrow areas) provided:

i. The support activity is directly related to the construction site required to have permit coverage for stormwater discharges:

ii. The support activity is not a commercial operation, nor does it serve multiple unrelated construction projects:

iii. The support activity does not continue to operate beyond the completion of the construction activity at the project it supports; and

iv. Stormwater controls are implemented in accordance with Part 2 and, if applicable, Part 3, for discharges from the support activity areas.

d. The following non-stormwater discharges from your construction activity, provided that, with the exception of water used to control dust and to irrigate areas to be vegetatively stabilized, these discharges are not routed to areas of exposed soil on your site and you comply with any applicable requirements for these discharges in Part 2:

i. Discharges from emergency fire-fighting activities;

Inspection Requirements for NPDES Compliance

EPA Construction General Permit Part 4 inspection requirements for NPDES compliance:

Inspection Frequency: You must conduct inspections in accordance with one of the two schedules listed below.

You must specify in your SWPPP which sche9ule you will be following.

1. At least once every 7 calendar days, OR

2. At least once every 14 calendar days and within 24 hours of the end of a storm event of 0.5 inches or greater. (If this option is chosen, a rain gauge is required to be on-site: The SWPPP should also include a daily rainfall log.)

Case-by-Case Reductions ill lttspectiott Frequettcy: You may reduce your inspection frequency to at least once every month if: · ·

1. The entire site is temporarily stabilized, 2: Runoff is unlikely due to winter_conditions (e.g., site is covered with snow, ice, or the ground is frozen), or

3. Construction is· occurring during seasonal arid periods in arid areas and semi-arid areas.

111spectiott Waiver for Frozen Cotlditions: A waiver of the inspection requirements is av~ilable until one month before thawing conditions are e_xpected to result in a discharge if all of the following requirements are met:

· 1. The project is located in an area where frozen conditions are anticipated to continue for extended periods of time (i.e., more than one month);

2. Land disturbance activities have been suspended; and

3. The beginning and ending dates of the waiver period are documented in the SWPPP.

Qualified Personnel: Inspections must be .cond.ucted by qualified personnel (provided by the operator or cooperatively by multiple operators). "Qualified personnel" means a person knowledgeable in the principles and practice of erosion and sediment controls who possesses the skills to assess conditions at the construction site that could impact stormwater quality and t9 assess the effectiveness of any sediment and erosion control measures · selected to control the quality of stonnwater disch?fges from the construction activity. ·

Scope of Inspections: Inspections must include all areas of the site disturbed by construction activity and areas used for storage ofm~terials that are exposed to precipitation. Inspectors niust look f9r evidence of, or the potemial for, pollutants entering the stormwater conveyance system. Sedimentation and erosion control measures must be observed to ensure proper operation. Discharge locations must be inspected to ascertain whether erosion control measures are effective in preventing significant impacts to waters of the United States, where accessible. Where discharge locations are inaccessible, nearby downstream lqcations must be inspected to the extent that such inspections .are practicable. Locations where vehicles enter or exit the site must be inspected for evidence of off-site sediment tracking.

All-reports required by this permit, indudittg tlie SWPPP, S.WPPP amettdniettts, a11d i11spectio1t reports 1ttust be sig11ed by a person described in Appendix G, Subsection 11.A (below) or by a duly authorized representative of that person.

1.. For a corporation: By a responsible corporate officer. For the purpose of this Part, a responsible corporate officer means: (i) a president, secretary, treasurer, or vice-president of the corporation in charge .of a principal business function, or any other person who performs similar policy- or decision-making functions for the · corporation, or (ii) the PJanager of one or more manufacturing, production, or operating facilities, provided, the manager is authorized to make management decisions which govern the operation of th~ regulated facility including having the explicit or implicit duty of making major capital investment recommendations, and initiating and .

directing other comprehensive measures fo assure long term environmental compliance with enVironmental laws and regulations; the manager can ensure that the necessary systems are established or actions taken to gather complete and accurate information for permit application requirements; and where authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures.

2. For a partnership· or sole proprietorship: By a general partner or the proprietor, respectiv~ly; or

· 3. For a municipality, state, federal, or other public agency: By either a principal executiv~ officer or ranking elected official. For purposes of this Part, a principal executive officer of a federal agency includes (i) the chief executive officer of the agency, or (ii) a senior executive officer having responsibility for the overall operations of a principal geographic unit 9fthe agency (e.g., Regional Administrator of EPA). · ·

A persoi1 is a duly authorized representative only if:

The authorization is made ~n writing by a-person described in Appendix G, Subsection 11.A;

The authorization specifies either an individual or a position having responsibility for the overall operation of the regulated facility or activity such as the position of plant manager, operator of a well or a well field, superintendent, positfon of equivalent respon.sibility, or an individual or position having overall responsibility for environmental matters for the company. (A duly authorized representative may thus be either a named individual or any individual occupying a named position); and ·
