I. CM/GC INTRODUCTION
CM/GC is a contracting method that involves the contractor in the design process. The intent is to form a partnership with Central Federal Lands Highway Division (CFLHD), the Bureau of Indian Affairs (BIA), the Fond du Lac Reservation (FDLR), and you as the contractor. The focus is on a partnership in which we minimize risk, improve construction schedule, try new innovations, and live within the budget. An important role of the contractor is to help acquire the information to reduce risk. We anticipate that your involvement will help reduce errors in design, improve constructability and meet budget goals.
The CM/GC team relies on the expertise of the contractor to deliver a better product in less time and at a lower cost than design-bid build construction processes. The team relies on the contractor to bring the following expertise to the project during the design phase:
The skills and knowledge to estimate the quantities of materials, labor, and equipment needed to construct the project;
The skills and knowledge to determine the tasks (work breakdown structure) needed to complete the project and estimate the costs, duration, and sequence of these tasks;
An understanding of the availability, cost, and capacities of materials, labor, and equipment;
The skills and knowledge to identify potential risks (including financial risks) and methods to mitigate them during the design process; and Constructability.
Contractor input and collaboration is key to the team’s success. It is not expected that all contractor suggestions can be applied, but it is expected that they are evaluated and considered in a timely process. During the design process the contractor works with the designer to:
Reduce risk;
Continuously update cost;
Negotiate a fair and reasonable price for the construction contract; and Assumptions are documented and updates are with open book prices.
When the project plans and specifications are complete, the contractor will prepare and submit an updated price proposal for the construction contract. Because this approach minimizes risk, the construction cost is expected to be less than conventional Design-Bid-Build projects. Should you win the award for this contract, your role will be to help manage the budget and propose solutions that will help achieve the goal of staying within budget. This will include a careful design that avoids the need for change orders. If this project cannot be delivered within the allocated budget, CFLHD has the option to reduce scope, seek additional funds, or end negotiations and advertise the project as a sealed bid.
II. PROJECT DESCRIPTION
Project Goals Maximize innovation to provide increased quality and performance within the project budget.
A-5
Existing Conditions
Project History
This project is located on Reservation Road on the Fond du Lac Reservation which is approximately 6 miles west of Duluth, Minnesota. The existing roadway was washed out during a large storm event during June 2012. The old culvert, all of the surrounding embankment and pavement were damaged during this event. The roadway is closed to traffic.
Contractor Access Access to the bridge site during construction will be limited to the roadway. Both sides will be accessible to the contractor. This will also be the only area available for the contractor’s staging of equipment and materials. The roadway is barricaded and gated at the access points.
Design Parameters and Criteria
Preliminary Design The design of this project is currently in the preliminary stages, but it has been determined that the structure will be a single span pre-stressed reinforced concrete girder bridge. As part of the CM/GC evaluation, prospective contractors will be evaluated on innovative design/construction methods that may result in a more cost effective project. The successful candidate will be expected to procure the bridge girders (Option X) prior to notice to proceed for construction (Option Y.)
Design Specifications Due to the hydraulic and environmental constraints, a single-span bridge is the only option that will be considered; no culverts will be considered. The minimum hydraulic opening is 10 feet. The new design must maintain the current alignment and typical section as shown in the TS&L. Where applicable the design and construction shall conform to:
Standard Specifications for Construction of Road and Bridges on Federal Highway Projects, FP-03, U.S. Customary Units;
AASHTO LRFD Bridge Design Specifications; and Other material and design specifications as appropriate for the selected materials.
III. FACTORS TO CONSIDER IN YOUR PROPOSAL
Offerors should consider the following information when preparing your proposal:
Sensitive cultural and natural resource issues associated with this bridge site; there will be limited access to the project site. No work or staging will be allowed outside the existing roadway prism;
Existing trout stream will need to be maintained during construction;
Girders will require advance lead time for fabrication and delivery;
Short on-site construction time of only approximately 4 months (July 1, 2013 – November 1, 2013) due to need to complete the project this year before winter conditions set in. Delays
A-6 to the schedule can easily force construction into a 6-month or more delay and require multiple seasons to construct; and
Difficult weather conditions (heavy rain, strong winds, cold temperatures) can cause construction and delivery delays.
IV. INSTRUCTIONS TO OFFERORS
A. INTRODUCTION
All offerors are required to submit, at a minimum, an offer that conforms to the solicitation documents. By submission of its offer in accordance with the instructions provided, the offeror unconditionally assents to the terms and conditions in this solicitation document and the attachments hereto.
The Government intends to award a Best Value contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offerors initial proposal should be clear and complete and contain the offerors best terms from a price standpoint. The Government reserves the right to conduct discussions if later deemed necessary. The Government further reserves the right to reject any or all offers if such action is in the Government's best interest.
Each offeror shall submit an offer that fully addresses the evaluation factors contained in this solicitation and complies with the preparation and submission instructions contained in this provision. Offerors should carefully review this section and its relationship to the Evaluation Factors prior to commencing proposal preparation.
Contractors are required to meet the dates set for the field review and all other meetings specified in this Request for Proposal. Contractors are also required to meet the information review and submittal dates specified in this Request for Proposal.
By listing personnel in the Technical Proposal section of the proposal, the Contractor is agreeing to make the personnel available to complete work on the contract at whatever level the project requires. Personnel changes will be reviewed by CFLHD’s Project Manager to assure the replacement is equally qualified and has adequate experience. CFLHD will only allow changes in key personnel when caused by circumstances outside the control of the Contractor (i.e., employee terminates employment with the Contractor). Changes in key personnel for the convenience or benefit of the Contractor will not be allowed. Key personnel will consist of the Contractor’s project manager and superintendent.
B. SUBMISSION OF OFFERS:

Provide no more than one page discussing Option X and Option Y pay items that have perceived risk factors built into the final pay item price. The discussion should include perceived risk factors, costs associated with perceived risk factors and proposed mitigation measures.
E. SELECTION PROCEDURES
CFLHD will award the contract (if at all) to the responsible Offeror determined to provide the “Best Value”, within available funding, using the Tradeoff process described in FAR 15.101-1. A Technical Evaluation Panel (TEP) comprised of Government personnel who are experienced professionals will evaluate the proposals. The technical evaluation and rating of proposals will be conducted in strict confidence. The number and identities of offerors will not be revealed to anyone not involved in the evaluation and award process or to other offerors. Proposals will be evaluated based only on the factors described herein. The TEP will evaluate price proposals independent of the technical evaluation. The TEP will not have access to price information until completion of the technical evaluation.
The TEP will perform an assessment of the combined technical score and price. Each Board member will individually provide a rating for each criterion in the Technical Proposal. The consensus method will then be used by the Board members to determine a final numerical rating for each evaluation criterion. The final numerical ratings will then be summed to determine the Overall Technical Score for each Offeror’s Technical Proposal. The maximum possible Overall Technical Score is 100 for each Proposal. All evaluation factors other than price, when combined, are approximately equal to price.
The Price Proposals will then be opened. The Evaluation Board will consider the benefits associated with the Technical Scores against the Contract Bid Price for each Proposal.
Comparisons will be made between Proposals to identify the Proposal that provides the most project benefits to CFLHD for the money spent. On this basis, the Board will determine the Proposal that provides the Best Value to the government. This Proposal will be forwarded by the Evaluation Board to the Contracting Officer for consideration and action. CFLHD intends to award the contract without discussions with the Offerors. However, if deemed necessary by CFLHD, at its sole discretion, discussions with individual Offerors may be held. All Offerors submitting Proposals will be notified in writing of the results of the evaluation process. Offerors not selected for award may request a debriefing in accordance with FAR 15.506.
Technical Evaluation Factors - Technical Evaluation factors are listed above in descending order of importance.
Price Evaluation:
The total price of Schedule A plus Option X plus Option Y will be evaluated. FAR 52.219-4 Notice of Price Evaluation Preference for HUBZone Small Business Concerns applies to this procurement and will be considered when evaluating price.
Per FAR 5.217-7 Option for Increased Quantity - Separately Priced Line Item, the Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option
A-13 by written notice to the Contractor within 60 days after award. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.
Prices submitted for Schedule A Tasks shall be considered firm-fixed prices and negotiations for tasks included in this proposal will not be considered. If contract modifications are required during the Contractor Involvement during Design Phase, the billable rates included in the Schedule A Task pricing shall be used without negotiation.
The prices submitted for Option X and Option Y will be used for evaluation purposes. Options X and Y may be exercised within 60 days of contract award (FAR Clause 52.217-7), or the prices therein may be used as a basis for negotiating modified Option X and Option Y work pricing with the selected contractor. The Cost and Risk discussion will be used to assist the government in establishing the reasonableness of the offeror’s proposed price. Price proposals deemed unreasonable will not be considered for award. If the successful offeror and the government are unable to reach agreement on a fair and reasonable price for Option X and Option Y, the government reserves the right to not award them per FAR 17.208(c). The government contemplates award of Option X, if at all, not later than May 30, 2013 and Option Y, if at all, not later than June 30, 2013.
