DETERMINATION & FINDINGS FOR OTHER THAN FULL & OPEN COMPETITION
(ACTIONS SAT AND BELOW)
1. DESCRIPTION OF PROPOSED PROCUREMENT: GE Healthcare “Computerized Tomography (CT) CT Scanner AssurePoint Performance Maintenance & Service Program” to provide replacement parts for GE CT Brightspeed Elite (16 Slice – CSPE29) located on Aberdeen Proving Ground (APG), MD.
2. PROPOSED CONTRACTOR/MANUFACTURER:
GE HEALTHCARE
3000 N Grandview Blvd W-443
WAUKESHA WI 53188-1615
Cage Code: 1V332 POC: Matt Harrison, 919-244-8792 matthew.harrison@med.ge.com
3. ESTIMATED TOTAL VALUE: Basic contract:
4. STATUTORY AUTHORITY PERMITTING CONTRACTING WITHOUT PROVIDING FOR FULL
AND OPEN COMPETITION: The statutory authority permitting sole source is 41 USC 1901(e), implemented by FAR 13.106-1(b)(1)(i):
_X_ Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
___ Unusual and Compelling Urgency ___ Industrial Mobilization; Engineering, Developmental, or Research Capability; or Expert
Services ___ International Agreement ___ Authorized or Required by Statute ___ National Security ___ Public Interest
5. JUSTIFICATION FOR THE AUTHORITY CITED ABOVE:
The item(s) listed in section one above is available from only one source and competition is precluded for reasons indicated below. There are no substitutes available.
___ Compatibility: The item(s) must be compatible in all aspects (form, fit, and function) with existing systems presently installed. Describe the equipment you have now and how the new item/service must coordinate, connect, or interface with the existing system:
__x_ Proprietary: A patent, copyright, or proprietary data limits competition. The proprietary data are described as follows:
The U.S. Army Research Laboratory’s owns a GE Computerized Tomography (CT) Scanner Brightspeed Elite (16 Slice) (CSPE29) located at Army Research Laboratory (ARL), B434, Aberdeen Proving Ground (APG), MD 21005-5001. The CT scanner is used for mission critical data collection efforts supporting research and assessment. It is necessary to repair and maintain the CT scanner in order to meet mission needs.
The GE CT Brightspeed Elite (16 Slice – CSPE29) contains proprietary parts, software, and technology unique to GE Healthcare. The Government contacted GE Healthcare who informed the Government that they do not license or authorize any other contractors to provide support of the proprietary elements of the CT Brightspeed including but not limited to:
iCenter Maintenance Reports, InSite remote connection and maintenance, and Training in Partnership (TiP) application experts. Use of any other contractor for maintenance, repair, and support will increase operational and financial risk to the government. The use of another contractor will lead to the degradation of support, as they would lack remote connectivity and direct phone support and training due to the proprietary nature of these unique elements.
Furthermore, another contractor cannot provide service or replacement of proprietary parts without passing substantial risk based cost to the government or requiring the government to purchase the support directly from GE Healthcare, effectively duplicating the cost of service.
Using anyone other than the original equipment manufacture would result in mission delay and failure of all reliant activities dependent on the consistent operational-up-time of the CT Brightspeed scanner. Due to the aforementioned, GE Healthcare is the only company able to meet the Government’s needs.
___ Experimental Continuity: The item(s) must be consistent with prior materials in order to ensure experimental continuity. Describe the conditions that necessitate the use of experimental continuity:
__ Warranty: Purchasing item(s) from another manufacturer/provider would void existing warranty. Provide a brief explanation for the use of this reason and the impact that would occur if the item was purchased from another manufacturer/provider:
___ Direct Replacement: These are “direct replacement” parts/components for existing equipment and no substitutes exist.
___ Other reasoning to support a sole-source buy:
6. FAIR AND REASONABLE PRICE DETERMINATION:
It has been determined that the anticipated cost to the Government will be fair and reasonable and that approval of this recommendation is in the best interest of the government. This justification is accurate and complete to the best of my knowledge and belief.
