(1) Reporting: If evidence of a potential cultural site(s) is discovered, immediately notify the COR and give the location and nature of the findings. Stop all activities within a 50-foot-radius of the discovery, and do not proceed with work within that radius until directed to do so by the COR.

(2) Care of Evidence: Do not damage artifacts or fossils uncovered during construction. Should any impacts occur, the Contractor may be liable under the Archaeological Resources Protection Act for any resource damaged.

(3) Contract Adjustments: Where appropriate by reason of delays caused by a discovery, the Contracting Officer may make adjustments to contract requirements/agreements.

c. Known Cultural Sites: There are multiple cultural resource sites located in the project vicinity. These sites have specific requirements of mitigation and avoidance.

(1) Training: All Contractor personnel visiting or working at the project site will be required to attend cultural resource awareness training provided by Western prior to accessing the project area.

(2) Mitigation and Avoidance of Sites: The Contractor including all personnel and equipment will avoid and not access a site or pass by a site other than under the guidance and direction of a Western provided on-site Archaeological Monitor.

Access near sites will be marked and limited.

(3) Marking Sites: The materials for avoidance will be provided, installed and removed by the Western provided on-site Archaeological Monitor.

5. CONSERVATION OF NATURAL RESOURCES:

a. General: Federal law prohibits the taking of endangered, threatened, proposed or candidate wildlife and plants, or designated Critical Habitat. Federal law also prohibits the taking of birds protected by the Migratory Bird Treaty Act. “Take” means to pursue, hunt, shoot, wound, kill, trap, capture or collect a protected animal or any part thereof, or attempt to do any of those things.

b. Unknown Occurrence of Protected Species or Habitat: If evidence of a protected species is found in the project area, the Contractor shall immediately notify the COR and provide the location and nature of the findings. The Contractor shall stop all activity in the vicinity of the species or habitat, and not proceed until directed to do so by the COR.

c. Known Species: There is the possibility for special status (protected) species to occur in the project area. In order to alleviate potential impacts to these species, the following special conditions must be followed:

(1) Limit Disturbance Area: At all proposed work areas, limit the mechanical disturbance of previously undisturbed habitats (including soils) to the greatest extent practicable.

(2) Pre-construction Clearance Surveys: Western will assign a qualified Biologist to the project to conduct pre-construction clearance surveys for Desert Tortoise, Burrowing Owls (year-around), nesting birds (from February 15th to May 10th, and from August 25th to August 31st), and other special-status species.

(a) Project activities may not disturb an active bird nest. If an active bird nest is located on or adjacent to the site, a qualified Biologist will designate and flag an appropriate buffer area around the nest where activities will not be permitted.

(b) At Western’s direction, a qualified Biologist may also perform monitoring onsite during construction activities as needed, based on the results of the pre-construction clearance surveys, to ensure minimization of impacts to special-status species and other biological resources.

(c) The qualified Biologist is authorized by Western to temporarily halt construction activity if needed to prevent potential harm to special status spe-cies. The work supervisor will co-ordinate with the qualified Biologist, if present, on planned or on-going activities and any specific pre-construction survey or monitoring requirements for each activity in those areas.

(3) Threatened and Endangered Species Avoidance Dates: Within riparian scrubland habitat, Project construction or O&M activities will not be conducted between May 10th and August 25th.

(4) Drainage Ditch: Western will avoid discharge of any material into the mapped drainage ditch within the project area, and avoid any construction activity within the ditch. No dirt, raw cement, concrete or washings thereof, asphalt, paint, oil, solvents, or other petroleum products, or any other substances that could be hazardous to aquatic wildlife will be allowed to enter the drainage ditch.

(5) Worker Training: Western will conduct employee training to ensure that all workers on the project site (including Contractors) are aware of all applicable Conservation Measures for biological resources, including information regarding civil and criminal penalties for violations of the Federal Endangered Species Act, the Migratory Bird Treaty Act, and the Bald and Golden Eagle Protection Act.

(6) Animals: No pets will be permitted on the work site. Workers will not be permitted to feed, harm, approach, harass, or handle wildlife at any time, except to move animals out of harm’s way, and only as directed by a supervisor. This condition will not exempt workers, including the biologist, from any Western safety policy with regard to venomous reptiles.

(7) Conform to APLIC Design Guidelines: In order to minimize any potential electrocution hazard for Golden Eagles or other large birds, energized and ground conductors and hardware will be separated by 60-inches or more, or will be covered.

(8) Trash, Refuse, Concrete, and Other Materials: All trash and food materials will be properly contained within vehicles or closed refuse bins while on the site, and will regularly be removed from the site (at least on a weekly basis) for proper disposal.

All construction refuse will be removed from each work site upon completion of construction. No raw cement, concrete or washings thereof, asphalt, paint, oil, solvents, or other petroleum products, or any other substances that could be hazardous to vegetation or wildlife resources, shall be disposed of onsite or allowed to spill onto soil. Cleanup of any spilled material shall begin immediately.

(9) Minimize Standing Water: Within desert shrubland habitat, water applied to dirt roads and construction areas for dust abatement shall use the minimal amount needed to meet safety and air quality standards, to prevent the formation of puddles, which could attract wildlife to construction sites.

(10) Speed Limit: To minimize potential impacts to special-status wildlife, no vehicles will be permitted to exceed 25 miles per hour while traveling on access roads.

d. Contract Adjustments: Where appropriate by reason of delays caused by a discovery, the Contracting Officer may make adjustments to contract requirements/agreements.

6. OTHER RESOURCE PROTECTION MEASURES: Resource Protection Measures (RPM) shall be implemented as follows, per the Environmental Assessment for the Blythe-Headgate Rock 161-kV Transmission Line Structure Replacement and Black Point Mesa Reroute Project (EA No. DOE/EA-1427, 2005):

a. Sensitive plants shall be avoided. Sensitive plant species include fishhook, cottontop, and barrel cactus; beavertail prickly pear; ocotillo, buckhorn, and Wiggin’s cholla; saguaros, and other small or viable Opuntia, or Cylindropuntia species.

b. No construction would occur during periods where the soil is too wet to adequately support construction equipment because construction equipment would cause ruts in the soil in excess of six-inches or greater. If grading operations associated with replacing a pole have altered the original ground topography, the ground surface would be reshaped to approximate the original topography.

Message from the Administrator

At Western, we show our commitment to safety every day through the actions we take, the training we offer and the work conditions we provide. We expect the same commitment to safety from each of our contractors who provide products or services to Western. In performing work for Western, all contractors must make the right decisions to ensure that the work environment is as safe as possible.

Our safety program is based on four points:

Safety procedures or common sense must be applied by each

Federal and contract employee. Safety should not be set aside to meet a project schedule or for personal convenience.

Employees and contractors must believe that they have the right and the responsibility to identify and take action to reduce, if not eliminate, hazardous work environments and hazardous work practices.

Managers and supervisors must lead by example and execute their responsibility to ensure each job is accomplished in a safe and healthy way.

Safety is a personal responsibility. Each individual makes the decision on what action to take to accomplish a task.

By integrating these principles into every task we take, together we can ensure Western is a safe place to work.

Mark A. Gabriel Administrator
