JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

APL 2011-13, Documentation and Justification Requirements for Sole Source and Limited Source Acquisitions 1

1. Identification of the agency and the contracting activity, and specific identification of the document as a "Justification for Other than Full and Open Competition."

Contracting Activity Processing the Requirement: DEA Office of Acquisition and Relocation Management (FA)

Name of Organization Originating the Requirement: DEA Aviation Division (OA)

Identification Number (purchase request/solicitation number): D-13-OA-0077

2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.

The anticipated action is a BRAND NAME JUSTIFICATION for the requisition of two (2) Flight Training Devices (FTDs). One (1) FTD must simulate the operation of a Beechcraft 350 aircraft with a Garmin G1000 avionics system approved under STC number SA01535WI-D, and one (1) FTD must simulates the operation of a Cessna T206H with a Garmin G1000 avionics system as manufactured by Cessna Aircraft Corporation.

3. A description of the supplies or services required to meet the agency's needs and estimated value.

See item #2. Full specifications for the FTDs are included in the solicitation’s Statement of Work

(SOW).

4. The statutory authority permitting other than full and open competition.

This requirement will be competed full-and-open subject to the brand name specifications specified herein.

5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

The Government requires an FTD that simulates the operation of a Beechcraft King Air 350 aircraft with a Garmin G1000 avionics system approved under STC number SA01535WI-D because OA’s Beechcraft King Air 350 fleet is in the process of being retrofitted with Garmin G1000 avionics systems. This process began in 2012, and therefore it is necessary for fleet standardization purposes that OA’s pilots be trained and kept current in the Beechcraft King Air 350 Garmin G1000 aircraft.

The Government requires an FTD that simulates the operation of a Cessna T206H with a Garmin G1000 avionics system as manufactured by Cessna Aircraft Corporation because OA operates over thirty (30) Garmin G1000 equipped Cessna T206H aircraft. Therefore, necessary that OA’s pilots be trained and kept current in the Cessna T206H Garmin G1000 equipped aircraft.

APL 2011-13, Documentation and Justification Requirements for Sole Source and Limited Source Acquisitions 2

6. A description of efforts made to ensure that offers were solicited from as many potential sources as is practicable. Include whether or not a FedBizOps announcement was made and what response, if any, was received, and include the exception under FAR 5.202 when not synopsizing. Describe whether any additional or similar requirements are anticipated in the future (This may not be included as an addendum, but must be in the body of the JOFOC).

A Sources Sought Notice was posted on the Federal Business Opportunities (FBO) website on May 10, 2013 with a due date for responses of May 16, 2013. As a result of this market research conducted and the evaluation of the responses received, it was determined that it was appropriate to move forward with this acquisition as a full-and-open competition. Additional or similar future requirements are not known at this time.

7. Cite the anticipated dollar value of the proposed acquisition including options if applicable and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The anticipated total dollar value of the proposed acquisition will not be provided at this time in order to avoid unduly influencing an ongoing full-and-open procurement.

8. A description of the market research conducted and the results or a statement of the reason market research was not conducted. Do not simply refer to the sources sought synopsis.

For the past several years, Aviation Division personnel have conducted market research to find a Flight Training Device (FTD) that can meet the minimum requirements needed to provide pilot training for Garmin G1000 avionics system equipped aircraft. This market research consisted of talking to industry representatives, attending trade shows such as the Airborne Law Enforcement Association and the National Business Aircraft Association. Only two companies were located that provide a FTD for a Beechcraft King Air 350 and a Cessna T206H Garmin G1000 avionics system equipped aircraft.

9. Any other facts supporting the use of other than full and open competition, such as:

a. Explanation of why technical data packages, specifications, engineering descriptions, statements of work or purchase descriptions suitable for full and open competition have not been developed or are not available.

N/A – this acquisition will be procured using a full-and-open competition.

b. When FAR Subpart 6.302-1 is cited for follow on acquisition as described in 6.302-1(a) (2)

(ii), an estimate of cost to the Government that would be duplicated and how the estimate was derived.

N/A

c. When FAR 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government.

APL 2011-13, Documentation and Justification Requirements for Sole Source and Limited Source Acquisitions 3
