About this file
This document is a Competition Impractical Authorization form from the Arizona Department of Transportation (ADOT), specifically from the ASD/Procurement Division. The document involves ADOT and Bingham Equipment Co., a supplier with ID IV0000017656, seeking authorization for a direct contract due to unique procurement circumstances. The requestor is Kim Matura, a Senior Procurement Specialist, and the document was ultimately approved by Christine Fruitman, the Chief Procurement Officer, on 9/15/2025.
The authorization is for diagnosis and parts/repair services on off-road heavy equipment from specific brands: Kubota, Bobcat, Case Construction, and New Holland. Bingham Equipment Company is the only authorized dealer for these brands in Arizona, with proprietary diagnostic software that makes competitive bidding impractical. The estimated contract value is $700,000.00, with a contract term of 51 months. The hourly labor rate was determined fair and reasonable at $165.00 per hour, which is slightly lower than a comparable contract rate of $170.00 per hour. The direct contract is intended to enable ADOT to quickly repair emergency equipment by accessing specialized parts and services that are only available through this single authorized dealer.

Rationale: Compliance with A.R.S. § 41-2533, 41-2534, 41-2538 or 41-2578 is: Impracticable Provide justification details:
ADOT Equipment Services Department has an immediate need for diagnosis and parts/repair services on Kubota, Bobcat, Case Construction and new Holland off-road heavy equipment brands. The software to diagnose these brands is proprietary and only available through an Authorized Dealer. Bingham Equipment Company is the only authorized dealer for off-road construction equipment for these brands in Arizona. Therefore Bingham Equipment Company must be utilized for diagnosing and repairing this equipment for ADOT. Additionally, the custom built equipment requires replacement parts that is also only available through Bingham Equipment Company in Arizona.
Solicitation BPM006442 was issued and Bingham was not awarded a contract at that time, therefore a direct contract is required to meet the needs of ADOT.
This Competition Impracticable authorization will allow ADOT to receive necessary parts and services for emergency equipment that are needing repairs. Having the ability to repair off-road heavy equipment will facilitate returning equipment to service in a timely manner.
Fair and reasonable price determined pursuant to A.A.C. R2-7-702:
The Procurement Officer verified with the contracted suppliers that Kubota, Bobcat, Case Construction and new
Holland brands require specific software in order to diagnose mechanical errors with the equipment. The Procurement Officer also confirmed that parts required to perform repairs would be only purchased by Bingham Equipment Company.
ADOT intends to enter into a Direct Contract with Bingham Equipment to cover the required services.
Hourly Labor rate under CTR075378 with Arizona Machinery: $170.00 per hour.
Hourly labor rate quoted to ADOT from Bingham Equipment: $165.00 per hour.
Therefore, the price is determined to be fair and reasonable as it is supported by market pricing.
