About this file

This is a Procurement Determination form for Competition Not Practicable submitted by the Arizona Department of Transportation (ADOT), Division of Procurement and Strategic Development (PSD). The requestor is Monica Rodriguez, Procurement Officer. The procurement action seeks authorization to award a contract to The Light Brigade, Inc. (Supplier ID IV0000095399) under Arizona Revised Statutes § 41-2535 and Arizona Administrative Code R2-7-D301(4), which permits noncompetitive procurement when competition is impracticable. The determination was approved by Monique Harris, Procurement Manager, on August 20, 2025.

The contract covers Fiber Optics Training services with an estimated annual cost of $15,000 and a requested term of 60 months. The justification for sole-source procurement is based on business continuity, as ADOT has received training from The Light Brigade for seven years and the vendor's proprietary resources (books, manuals, and materials) are embedded in departmental operations. Switching vendors would require replacement resources and potential retraining, creating greater financial disruption. ADOT conducted a search of available statewide contracts and the Arizona Procurement Portal (APP) and found no alternative sources. The pricing was determined fair and reasonable based on historical pricing data from prior years of service, with recent invoices ranging from $2,142.14 to $2,376.46 per training session. The procurement authority confirmed that no statewide contract is available for these services and authorized the request.

Rationale: Compliance with A.R.S. § 41-2535 is: Impracticable

Provide justification details:

The procurement needs exist because ADOT has been receiving foundational and ongoing Fiber Optics Training from Light Brigade for seven (7) years, and the training content and resources have been embedded into ADOT’s processes. The Department explored the mandatory state contracts and none were identified to facilitate this service.

The reason competition is impracticable is because the resources (books, manuals, etc.) provided by Light Brigade are used in daily operations. Changing to a different vendor would disrupt business continuity as replacement resources, and potentially retraining, would be needed, causing a greater financial impact.

The proposed procurement is advantageous to the state because it will maintain business continuity.

The procurement process included searching APP for fiber optics training contracts.

The strategy to promote competition includes the development of a five (5) year term direct contract (in progress).

Fair and reasonable price determined pursuant to A.A.C. R2-7-702:

The pricing is consistent with prior years of service and supported by relevant, historical price date and is therefore determined fair and reasonable.

I have determined no statewide contract is available for these goods / services ☒
