Summary of Contract Bonds

This document contains bond templates required by the City of Hayward, California for construction contracts related to asphalt paving repair and patch work. The City of Hayward mandates two types of bonds from contractors: a Labor and Materials Bond and a Performance Bond. Both bonds must be executed by the contractor and a California-authorized surety corporation. The bonds guarantee faithful performance of contract obligations, payment for all labor and materials, compliance with the Unemployment Insurance Act of California, and protection against claims under California Civil Code Title 15. The bonds remain in effect for one year following the City's acceptance of completed work. The bond amount must equal no less than 100 percent of the total contract value. Upon contractor default, the surety must either complete the project, obtain bids for project completion, or permit the City to complete the work while making sufficient funds available to cover completion costs less the remaining contract balance.

The surety assumes all financial obligations related to labor, materials, equipment, and services, including reasonable attorney's fees and enforcement costs incurred by the City. The bonds are not affected by any changes, extensions, alterations, or additions to contract terms, and the surety waives notice of such modifications. The City reserves the right to reject any contractor or subcontractor proposed by the surety during default remediation. A Power-of-Attorney from the surety's local representative must be attached to both bond instruments. These bonds serve as security mechanisms ensuring contractor performance and protecting the City and all parties supplying labor and materials for the roadway repair project.
