FDOT, District 4 3400 West Commercial Boulevard Ft. Lauderdale, FL 33309-3421 ATTN: Christina Brown Deputy Right of Way Manager – Production

RE: DOW97, Continuing Services for Right of Way Acquisition & Relocation

County Road 812 (Lantana Road) Proposal for New Task Authorization

Dear Christina, BACKGROUND

The project was originally tasked to be completed on an accelerated schedule, to be conducted in 22 months with a certification date of July 2025. Appraisals have been delayed for reasons beyond FLAA’s control. We are now asked to provide services over an additional 18 months, with a certification date of January 2027.

This results in the project now being on a 40-month schedule. Additional parcel changes and additions (size and scope) have also resulted due to design changes.

A parcel has been added without proper compensation and a parcel voided results in a paired TCE converting to a Standalone TCE. FLAA provided significant early acquisition and suit information up-front (i.e. labor), which was expended to meet the original accelerated lawsuit schedule. FLAA has now been asked to duplicate and repeat efforts affecting several milestones and to incorporate additional relocation services.

Because of this and per our recent discussions, we propose the enclosed revised staff hours for acquisition and property management services for the specified parcels along Lantana Road. Additionally, we have included hours for relocation efforts anticipated for Parcel 104. This proposal is in accordance with the acquisition portion of the scope of services of contract DOW97 – Continuing Services for Right of Way Acquisition & Relocation. Per our previous conversations, we have developed a standalone task assignment to reflect the necessary hours for completing the assignment and incorporating relocation activities. This allows for easier invoice management and task milestone monitoring and auditing. The new task will reflect the following parcels:

ASSIGNMENT

14-parcel assignment as described and outlined below:

101 - Commercial w/ Bus. Damages & w/ Demolition 102 - Commercial w/ Bus. Damages & w/ Demolition 104 - Commercial w/ Bus. Damages & w/ Demolition [Large] 700 - Paired TCE, Commercial (See P.101) 701 - Paired TCE, Commercial (See P.102) 703 - Standalone TCE, Commercial 704 - Standalone TCE, Commercial 705 - Paired TCE, Commercial (See P.104) 706 - Standalone TCE, Commercial 707 - Standalone TCE, Commercial 708 - Paired TCE, Commercial (See P.101)

BD1 - Business Damage Claim BD2 - Business Damage Claim BD3 - Business Damage Claim BD4 - Business Damage Claim

Relo1 - Relocation Business Tenant (non-owner) Relo2 - Relocation Business Tenant (non-owner) Relo3 - Relocation Business Tenant (non-owner)

This equates to the following:

o 2 Commercial properties with Business Damages and Demolition o 1 Commercial properties with Business Damages and Demolition [Large] o 4 Paired temporary construction easements (commercial) o 4 Standalone temporary construction easements (commercial) o 4 Potential Business Damage Claims.

o 3 Business Tenant (non-Fee Owner) Relocations

ASSUMPTIONS & DELIVERABLES

18-month project Schedule from new NTP.

Hours are reflective of the updated right-of-way clear date of the current schedule.

Acquisition, Business Damages Claims, & Property Management portions of the Scope of

Services of Contract DOW97 serve as the basis for services provided.

Relocation services have been revised and included for up to three (3) business tenants as part of Parcel 104’s appraisal cure plan.

Any additional changes to the parcel Task Work Order, schedule, and scope, including the number of assigned parcels, identification of parcel types, and/or parcel unit rates, shall be discussed and agreed upon by both the Department and FLAA before issuance of an amendment to the Task Work Order or issuance of a new Task Work Order.

To account for the increased staff hours required to meet the new schedule and updated scope of services, hours have been spread throughout affected parcels.

For parcels where pre-591 letters and offer packages were previously delivered, FLAA shall invoice these milestones upon receipt of a project revision letter and the revised offer package.

Standard NTO letters shall be delivered with the Written Offer at the Initiation of Negotiations, as allowed by Florida Statute.

It is agreed that for expediency and to assure Good Faith Negotiations, all Written Offers shall continue to be made by Certified mail with Return Receipt requested. This includes revised offers to be made for parcels affected by the TCE expiration changes.

As part of the property management activities, FLAA shall develop a demolition scope, coordinate with the Department and Contractor, and provide oversight of demolition activities.

The Department’s demolition contracting shall be completed under the Department’s Districtwide Demolition Contract in advance of Title Transfer to ensure the integrity of the project’s schedule. All Demolition Contract activities will be completed by the Department’s Demolition Contractor and invoiced directly to the Department by the Demolition Contractor.

FLAA shall review the invoice to ensure invoiced activities occurred and provide photo evidence.

As agreed, FLAA’s responsibility for conducting parcel inspections shall end at Right of Way Certification, currently scheduled for January 4th, 2027.

FLAA’s contracted subconsultant shall conduct Business Damage Claim Analysis and Reviews. Their services shall be developed and tasked by the Department and invoiced as a pass-through expense.

FLAA shall not be responsible for updating the Needs Assessment Survey.

MILESTONES

Due to the extended schedule, the prospect of Business Damage claims, the addition of relocation services, and the necessity for updated research of recorded and unrecorded, unknown, and out-of-state interests, the following milestones are proposed. Note: FLAA provided significant up-front labor, which was expended to meet the original accelerated lawsuit schedule. FLAA has now been asked to duplicate and repeat efforts affecting several milestones. There is also a significant invoicing gap between the suit filing and OT milestones where labor is still necessary.
