Standard Note 8
Standard Note 8 - Under-Utilization Goal for DBEs and Small Businesses - The goal of the Department’s Under-Utilization strategy is to encourage and promote use of Disadvantaged Business Enterprises (DBE) and Small Businesses in areas of work where they have been under-used. Under-Utilization (https://fdotwww.blob.core.windows.net/sitefinity/docs/default-source/procurement/pdf/under-utilization_table.pdf?sfvrsn=ebae821e_2) is defined by FDOT as 25% or less utilization level in a Work Group, which may vary by district. The specific Under-Utilized Work Groups are identified in the advertisement.
Consultants are strongly encouraged to propose a DBE or Small Business to perform services for each Under-Utilized Work Group identified in the advertisement. DBEs or Small Businesses can be proposed at either the Prime or Sub-level for the Under-Utilized Work Group(s). Use of Under-Utilized DBEs or Small Businesses for Consultant teaming is a shortlist consideration factor for projects referencing this Standard Note. Consultants are requested to indicate your firm's proposed use of DBEs and/or Small Business primes or subconsultants to meet Under-Utilization goals on the table within the Professional Services Letter of Response form (as designated in the advertisement) by checking the box under the Under-Utilization (UU) column. Failure to list DBEs and/or Small Business prime or subconsultants on the response form shall indicate no proposed utilization. Please refer to the advertisement for other submittal directions. Reports are available at the following locations to validate status of firms as Small Businesses and DBEs:

I. Purpose
The Florida Department of Transportation (FDOT or the Department) Office of Environmental Management (OEM) requires environmental services to perform various tasks related to environmental programs, preliminary engineering, and environmental activities in the planning, development, and delivery of the Department’s work program.
This contract specifically requests consultant support in Work Group 2.0 (Project Development & Environmental, PD&E) services, as defined in Chapter 14-75, FAC to provide environmental and engineering services. This support includes ensuring that the Department plans, delivers and maintains its transportation facilities in accordance with applicable environmental laws, and regulatory requirements with sensitivity to the natural, human, and physical environments. These objectives are accomplished by developing, updating, and implementing environmental programs, policies, processes, procedures, and supporting documents; as well as conducting environmental analysis and consultations;
developing and delivering training; supporting self-assessments or other program reviews;
and implementing and enhancing the coordination of transportation policy issues affecting the environment as it relates to Department projects.
II. Objective
OEM desires to obtain Statewide environmental services. The firm providing these services shall be referred to as the Consultant for the remainder of this scope. The Consultant shall provide professional environmental and transportation engineering expertise required to coordinate, review, analyze, report, plan and develop transportation projects, policies and procedures, and environmental program or project tasks consistent with this scope of services, as assigned by OEM. The Consultant work will be managed by the OEM project manager (Department Project Manager) who will provide a specific definition of the work for each task to be performed by the Consultant, as defined in this Scope of Services (SOS) through the issuance of individual Task Work Orders (TWO). Each TWO shall identify the OEM Task Manager (Task Manager) who will manage the task, maintaining coordination with the project manager. Each TWO shall include product/deliverable requirements and schedule.
III. Responsibilities of the Consultant
1. The Consultant shall provide an overall Project Manager (Consultant Project Manager) who will be the primary point of contact for the Consultant for the scope, schedule, staffing coordination and completion of all work tasks. The Consultant Project Manager shall meet with Department Project Manager as deemed necessary. The Consultant Project Manager shall also meet and coordinate with each Task Manager as described in each TWO to accomplish the required work.
A-2
2. The Consultant Project Manager shall provide monthly progress reports, in the format required by OEM, by TWO no later than 15 calendar days following the billing period being reported on. The Consultant Project Manager should establish regular (typically monthly) meetings with the Department Project Manager to review the progress report, discuss challenges, and other contractual needs or issues that may arise during the bill period. Billing periods shall include the work performed during a four-week period or one month, unless specified otherwise in the applicable TWO.
The monthly progress report documents the delivery of products or services. The acceptance of these products or services shall be the basis for evaluation and processing of payment.
3. The Consultant shall provide and maintain an up-to-date list of staff with agreed-to classifications and approved salaries (subject to the contract Exhibit “B”) that would be available to be assigned to specific TWOs. No consultant staff, except those specifically identified in a Task Work Order or those specifically agreed to by the Department Project Manager, shall charge time to that particular Task Work Order.
The Consultant must request approval from the Department’s Project Manager for any modifications or additions to the list of available staff prior to the initiation of any work by that individual. If applicable, new job classifications may be added to the contract via contract amendment. The Consultant shall submit a copy of the resume and payroll register before new staff can be added.
4. The Consultant shall provide sufficient staff to complete all assigned work within the
TWO schedule, consisting of either the specific staff resource requested or acceptable staff equivalent at defined levels of expertise and as approved by the Contract or Task Manager to complete the assigned work. If at any time, the Task Manager or project manager determines that the expertise of assigned staff is inadequate to competently complete the assignment, the Task Manager shall coordinate with the Consultant Project Manager, to identify and assign an appropriate replacement staff resource to ensure adequate staff timely completion of work.
5. For a TWO where consultant staff are anticipated to work the majority of a 40-hour week at Department facilities, the Consultant will be reimbursed at the field rate, and staff who are anticipated to work on average the majority of the week at the home office should be reimbursed at the home rate.
6. The Consultant shall perform all analysis, develop recommendations, and document all work within the required time schedule as defined in the executed TWO. The Consultant will ensure that no costs will be billed to the Department unless authorized in an executed TWO, or TWO amendment or revision.
A-3
7. Services assigned to any subconsultants must be approved in advance by the Department Project Manager, and the Consultant Project Manager in accordance with this Contract. All subconsultants must be qualified by the Department to perform all work assigned to them. Subconsultants with specialized areas of expertise may be required to complete specific TWO assignments. Any subconsultant to be hired and all work assignments to be performed shall be agreed to by the Department Project Manager, and the Consultant Project Manager and documented in the contract file prior to any work being performed by the sub-consultant.
8. The Consultant shall ensure no costs are incurred or billed to the Department for any task; a) prior to the Notice to Proceed date of the TWO; b) for wages at a different rate than authorized in this Contract and listed in the TWO; and c) for different expenses or for expenses at a unit cost that is higher than shown in the
TWO.
9. The Consultant shall ensure that there are no direct charges included in any TWO’s that are a part of the audited overhead rate or direct expense rate included in the Contract.
10. The Consultant shall ensure that all Department policies, procedures, standards, and other information applicable to the services are understood and followed by the appropriate consultant staff, including sub-consultants. The Consultant shall provide any needed training and assistance to each sub-consultant to ensure proper understanding of Department requirements and timely completion of work.
11. The Consultant shall ensure that all deliverables, including source materials produced as part of the Contract, are delivered upon request to the Task Manager or Department Project Manager, or upon completion of all work for the applicable TWO, whichever comes first. Electronic documents shall be prepared and delivered in standard Department software unless otherwise specified in a TWO for documents to be produced for that TWO.
Individual tasks will be assigned on an as needed basis. The Consultant will be required to provide a written proposal of the tasks to be conducted with a staff-hour and cost estimate (to include personnel, job classifications, areas of specialty, percentage of time devoted to task(s) and estimated cost). Once OEM and the Consultant agree on services to be performed, products to be produced, and the associated costs, OEM shall furnish the Consultant with a TWO. Unless the work is required in response to an official emergency declaration, no work shall be commenced by the Consultant until receipt of a Notice to Proceed for a TWO. Work performed under this contract to specifically support non-federal programs or projects must be state funded only. The eligibility of federal activities will be determined based on the type of funding selected for the TWO.
