About this file
Amendment No. 8 to Contract No. LE680 is an amendment to an indefinite delivery vehicle between the Florida Department of Environmental Protection (FDEP) and Progressive Environmental Services, Inc., located at 1619 Moylan Road, Panama City, Florida 32407. The contract provides emergency response services statewide and has been in effect since August 24, 2009. This amendment was executed on October 18, 2017.
The amendment modifies the Work Authorization Form (Attachment A), which is deleted in its entirety and replaced with Attachment A-1, the Revised Work Authorization Form. Additionally, Paragraph 39 of the original contract is replaced to establish transaction fee requirements under Florida's MyFloridaMarketPlace (MFMP) e-procurement system. The contractor is assessed a transaction fee per Rule 60A-1.031, Florida Administrative Code, which shall be automatically deducted from payments when possible. If automatic deduction is not feasible, the contractor must pay the fee upon submission of reports and corresponding payments. The contractor receives a credit for transaction fees paid on returned items through no fault of the contractor but forfeits non-refundable transaction fees when items are rejected due to contractor non-performance or non-compliance. Failure to comply with transaction fee requirements constitutes grounds for declaring the contractor in default, potential recovery of re-procurement costs, and exclusion from future state business. All other terms and conditions of the original contract remain in effect, with amendment provisions controlling in case of any inconsistencies.
