About this file
DEP Contract No. LE680 is an indefinite delivery vehicle contract between the Florida Department of Environmental Protection (DEP) and Southern Waste Services, Inc. This Amendment No. 5, executed on August 19, 2015, represents the fifth amendment to the original contract dated August 24, 2009. Southern Waste Services, Inc. serves as the primary contractor under this arrangement, with a secondary contractor available for backup support. The Department may call upon the secondary contractor regardless of the primary contractor's availability. The contract is administered by the Department's Office of Emergency Response, with co-contract managers Melissa Woehle and Jonathan Lara, and the contractor's representative is Brian Cross.
The contract provides environmental response services including personnel, equipment, materials, and supplies across multiple service categories. Pricing is established through the Second Revised Fee Schedule (Attachment C-2), which includes labor rates ranging from $25.92 to $75.66 per hour for standard time and $33.95 to $87.30 for overtime, vehicle rates from $7.76 to $63.05 hourly, heavy equipment from $14.55 to $115.92 hourly, water response equipment, generators, pumps, compression equipment, field testing instruments, personal protective equipment at various levels ($14.55 to $654.75 per person per day), specialized equipment, and expendable materials. The contractor may invoice upon task completion or for sub-tasks completed in their entirety, and for tasks exceeding six months, monthly invoicing is permitted. Travel expenses are reimbursed in accordance with Florida Statutes Section 112.061 at State of Florida employee rates. Labor and equipment rates are calculated portal-to-portal from the nearest listed contractor office. The contract is terminable by the Department with thirty days' written notice for cause or for convenience, and the Department maintains audit rights for five years following contract completion or termination.

SECOND REVISED FEE SCHEDULE
The following information pertains to this Attachment:
• Daily costs reflect a straight eight-hour work day.
• Daily rates for equipment are available after six consecutive hours of equipment use, including standby hours.
• Weekly rates for equipment are available after five consecutive days of equipment use, including standby hours.
• Standby rates are to be applied when equipment has been tasked by an SOSC, but is not actively being used.
• For long-term equipment usage (more than one week), rates can be negotiated on a lump sum basis.
• Labor and equipment rates will be from portal-to-portal, and shall be calculated from the nearest listed contractor office. It is the responsibility of the Contractor to maintain adequate staffing and equipment inventory at field offices to provide services.
• For the purposes of this Contract, holidays are State of Florida holidays only.
• Travel expenses and per diem, if authorized by the OER Project Manager, shall be in accordance with the requirements contained in Chapter 112.061, Florida Statutes, and must be documented by a State of Florida Travel Voucher with appropriate receipts. Reimbursement will be at rates currently allowed for State of Florida employees.
• Charges for equipment, services or expenses, including services and expenses of subcontractors, directly identifiable to a particular assignment of work, which are not included in Attachment C-2, shall be compensated on a “cost plus” basis and must be evidenced on the daily report for that particular job. Such approvals should not be common, but will enable the DEP to obtain expendable supplies or specialized services that may be unanticipated, but which are related to this Contract. Invoices for “cost plus” items must be supported by the type documentation required in Attachment G, Contract Payment Requirements.
In the event that DEP determines that such rates should become part of the Second Revised Fee Schedule attached to the contract resulting from this solicitation, the DEP will initiate a change order evidencing rates mutually agreed to by both parties for inclusion in Attachment C-2.
• All the Contractor’s response personnel identified in Attachment C-2 shall be trained as appropriate to 29 CFR, 1910.120 standards. The OER OSC may from time to time ask for training documentation from personnel on site.
• Equivalent vehicles and equipment contracted or rented shall be invoiced at the contract rates contained in the Second Revised Fee Schedule. If the Contractor lists prices for equipment that is subsequently rented from a subcontractor at a higher rate, the price listed in the Second Revised Fee Schedule will be paid.
Equipment not owned should not be included in the Second Revised Fee Schedule.
• If the Contractor cannot respond due to other commitments, and another subcontractor is used, the DEP will be invoiced at the rates contained in the Second Revised Fee Schedule for the equivalent personnel and equipment.
• Response vehicles or trailers are defined as units that are fully equipped with various PPE, breathing air, tools (both regular and non-sparking), patch kits, field monitoring equipment, overpack drums, expendables, etc., that will be used as the primary response unit for the Contractor.
• Rental costs for equipment such as containment boom shall not exceed the total replacement cost of the item.
• A listing of office locations and types/quantities of equipment available at each office location for use under this Contract is included as page 2 of this Attachment.
