Contract Summary

This document is Amendment No. 6 to Agency Term Contract No. GC822, a state and local contract indefinite delivery vehicle executed between the Florida Department of Environmental Protection (FDEP) and Professional Service Industries, Inc. (PSII). The contract, originally executed on February 26, 2014, provides petroleum contamination site response action services in the North Region of Florida. The amendment was signed on September 11, 2018, by John J. Truitt, Deputy Secretary of FDEP, and Erin L. Lennon, Contract Manager/Project Scientist for PSII.

Amendment No. 6 modifies two pay items within the contract's Schedule of Pay Items, effective for new work assignments offered on or after September 15, 2018. Pay Item 14-1 (Direct Push Boring with In-Situ Injection) was changed from a per-foot unit of measure to a per-day rate of $6,720.00, and Pay Item 14-2 (In-Situ Injection Into Existing Well/Treatment Point) was similarly converted from a per-injection-point basis to a per-day rate of $5,600.00. All new work assignments offered prior to September 15, 2018, continue to apply the contractor's previous rate schedule. The amendment also adds a certification requirement that the contractor is not on the Scrutinized Companies that Boycott Israel List and is not engaged in a boycott of Israel, pursuant to Section 287.135, F.S. Attachment D (V3.0), a comprehensive 27-page rate schedule, is included and made part of the contract, listing hundreds of pay items for drilling, boring, well installation, laboratory analysis, remediation system operations, and professional services required for petroleum site remediation activities.

MODIFICATON

AMENDMENT NO. 6

The Agency Term Contract No. GC822 (hereinafter "Contract") between the FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION (hereinafter "Department") and PROFESSIONAL SERVICE INDUSTRIES, INC. (hereinafter "Contractor") executed on February 26, 2014, to provide petroleum contamination site response action services in the North Region, is hereby amended.

WHEREAS, the Department has solicited, received, negotiated and accepted rates for the two new pay items identified; and

WHEREAS, the Effective Date of the Revised Pay Items shall be September 15, 2018. However, outstanding Work Assignments prior to this date shall continue and be subject to requests for change, as appropriate; and

WHEREAS, the pay item changes authorized will be applicable only for new work assignments offered on or after the Effective Date of September 15, 2018 (“New Work” assignments).

NOW THEREFORE, the parties agree as follows:

1. The following provision is hereby added to paragraph 37, Disqualification:

E. Contractor certifies that it is not on the Scrutinized Companies that Boycott Israel List or engaged in a boycott of Israel. Pursuant to Section 287.135, F.S., the Department may immediately terminate this Contract at its sole option if the Contractor is found to have submitted a false certification; or if the Contractor is placed on the Scrutinized Companies that Boycott Israel List or is engaged in the boycott of Israel during the term of the Contract. As provided in Subsection 287.135(8), F.S., if federal law ceases to authorize these contracting prohibitions then they shall become inoperative.

2. Department hereby modifies Attachment A (V2.0), Scope of Services, Section V. Technical

Specifications, Subsection B. Schedule of Pay Items, and Attachment D, Rate Schedule (V2.2), as follows:

i. Pay Item 14-1, Direct Push Boring with In-Situ Injection: [Per Foot] is superseded with Pay Item 14-1.a., Direct Push Boring with In-Situ Injection: [Per Day] for all New Work assignments offered on or after September 15, 2018.

Point] is superseded with Pay Item 14-2.a., In-Situ Injection Into Existing Well/Treatment Point: [Per Day] for all New Work assignments offered on or after September 15, 2018.

3. All New Work assignments offered prior to September 15, 2018, will continue to apply Contractor’s applicable prior Rate Schedule.

DEP Agency Term Contract No. GC822 Amendment No. 6

4. Contractor’s Rate Schedule is hereby changed for the Pay Items indicated on Tables 1 and 2 below, effective for New Work assignments unless and until further modified by a subsequent amendment to the Contract.

5. This amendment modifies only the pay items and rates as specified on Tables 1 and 2, and does not add, delete or otherwise modify any other line item contained in the contract.

6. Attachment D, Rate Schedule (V3.0) is hereby added to the Contract and attached hereto and made a part hereof. For all New Work assignments offered on or after the Pay Item Change Date established in this Amendment, Attachment D, Rate Schedule (V3.0) shall apply.
