About this file

This is Amendment No. 17 to Agency Term Contract No. GC799, a state and local contract indefinite delivery vehicle between the Florida Department of Environmental Protection and Earth Systems, LLC. The contract, originally effective February 20, 2014, governs petroleum contamination site response action services provided to the State of Florida.

Amendment No. 17 extends the contract for a six-month period beginning August 14, 2024, and ending February 14, 2025. The amendment prohibits the issuance of new Purchase Orders or Task Assignments after the extended term concludes; however, any Purchase Orders or Task Assignments issued or executed during the renewal or extended term period may continue for completion up to twelve months after the extended term expires. The contractor attests under penalty of perjury that commodities and services have not been produced using forced labor, and the Department reserves the right to terminate the contract should the contractor be placed on the force labor vendor list. All other terms and conditions of the original contract remain in effect, with the provisions of this amendment controlling in any instances of inconsistency.

AGENCY TERM CONTRACT NO. GC799

AMENDMENT NO. 17

This Amendment to Contract No. GC799, as previously amended (Contract) is made by and between the Department of Environmental Protection (Department), an agency of the State of Florida, and EARTH SYSTEMS, LLC (Contractor), on the date last signed below.

WHEREAS, the Department entered into the Contract with the Contractor for petroleum contamination site response action services effective February 20, 2014; and

WHEREAS, the parties wish to amend the Contract as set forth herein.

NOW, THEREFORE, the parties agree as follows:

1. The Contract is extended for a 6-month period, pursuant to section 287.057(13), F.S., to begin

August 14, 2024, and remain in effect until February 14, 2025. The Department and the Contractor shall continue to perform their respective duties during this extension period pursuant to the same terms and conditions provided in the Contract.

2. Paragraph 4, Term of Contract Section C is hereby deleted in its entirety and replaced with the following:

C. No new Purchase Orders or Task Assignments shall be issued or executed after the Term of Contract.

However, the Restated Contract shall continue in effect up to twelve months after the extended term for completion of any Purchase Order or Task Assignment issued/executed during the renewal or extended term. Purchase Orders or Task Assignments, completion of which extends beyond the extended term shall continue to be subject to change, as appropriate.

3. Pursuant to 287.1346, F.S., by signing this extension of contract, Contractor attests under the penalty of perjury that to the best of his or her knowledge any commodities or services offered to the Department have not been produced, in whole or in part, by forced labor. Contractor further agrees that the Department will terminate this contract should Contractor be placed on the force labor vendor list created pursuant to section 287.1346, F.S.

4. All other terms and conditions of the Contract remain in effect. If and to the extent that any inconsistency may appear between the Contract and this Amendment, the provisions of this Amendment shall control.
