Summary of DEP Agency Term Contract No. GC799, Amendment No. 12
This is Amendment No. 12 to Agency Term Contract No. GC799 for the Petroleum Restoration Program, executed between the Florida Department of Environmental Protection (DEP) and Earth Systems, Inc. The contract was originally effective February 20, 2014, and this amendment was signed on August 22, 2022, by John Truitt, Deputy Secretary of the Department of Environmental Protection, on behalf of the State of Florida.
Amendment No. 12 updates Attachment A (V2.0), specifically the Scope of Services contained in Section V, Technical Specification, subsection B, Schedule of Pay Items, Section 12 regarding Debris, Waste, and Product Removal and Disposal. The amendment establishes a protocol for handling soil overages: when delivery weight tickets indicate volume exceeding the amount approved on a Purchase Order, and the overage does not exceed 20 percent of the total authorized volume, the contractor must notify the site manager via Request for Change within two business days of the additional soil being transported from the site. All other contract terms and conditions remain in effect, with any inconsistencies between the original contract and this amendment resolved in favor of the amendment's provisions.
