About this file

This document is Amendment No. 16 to Agency Term Contract No. GC789 between the Florida Department of Environmental Protection (DEP) and APEX Companies, LLC. The contract, originally executed on February 28, 2014, provides petroleum contamination site response action services in the North Region of Florida. This amendment addresses rate increases to the contractor's existing rate schedule and was executed on May 8, 2024, with an effective Rate Change Date of June 10, 2024.

The amendment implements a 5% rate increase across the contract's pay items, with the exception of select items that received increases ranging from 3% to 4.99%, with the maximum permitted increase of 5% complying with provision 11.B.ii of the contract. The rate increases apply only to new work assignments offered on or after the Rate Change Date, while all pre-existing work assignments continue under the prior rate schedule. The updated rates are reflected in Attachment D, Rate Schedule (Version 3.6), which supersedes the previous Version 3.5. The rate changes encompass over 300 pay items covering mobilization services, drilling and boring operations, well installation and abandonment, soil and water sampling and analysis, remedial action systems, engineering and professional services, and various support activities. The contractor's detailed justification for the requested increases was reviewed and approved by the Department prior to amendment execution.
