About this file

This is Amendment No. 5 to DEP Agency Term Contract No. GC752, an indefinite delivery contract for petroleum contamination site response action services in Florida's Central Region. The contract is between the Florida Department of Environmental Protection (FDEP) and ENVISORS-ENSOUTH JOINT VENTURE, LLC. The original contract was executed on April 2, 2014, and this amendment modifies pricing effective May 22, 2018. The amendment applies only to new work assignments offered on or after the Rate Change Date, while all pre-Rate Change Date work assignments continue to apply the contractor's prior rate schedule.

The amendment implements rate adjustments across the contractor's comprehensive rate schedule for petroleum contamination response services, including drilling and boring, well installation, sample collection and analysis, excavation, debris removal, remedial action construction, pilot testing, system operation and maintenance, and professional engineering and geology services. The requested rate increases do not exceed the contractually permitted maximum of 5% under provision 11.B.ii, with most adjustments at approximately 5%, while selected items received rate decreases of 10% to 20%. The contractor submitted detailed justifications for the requested increases, which the Department reviewed and approved. The new rates in Attachment D (V2.2) establish the maximum authorized payment amounts for all applicable pay items, with the Rate Change Date of May 22, 2018, identified in the Department's Data Processing Information section. All other contract terms and conditions remain in effect, and any inconsistencies between the original contract and this amendment are resolved in favor of the amendment's provisions.
