Amendment No. 16 – DEP Agency Term Contract No. GC743

This document is Amendment No. 16 to Agency Term Contract No. GC743, a rate increase amendment executed between the Florida Department of Environmental Protection (DEP) and Earth Systems, LLC. The contract, originally executed on February 21, 2014, provides petroleum contamination site response action services in the Central Region of Florida. The amendment was executed on May 31, 2024, by James Poston (Operations Manager) for Earth Systems, LLC, and Jessica Kramer (Deputy Secretary) for the Florida Department of Environmental Protection.

Amendment No. 16 implements rate increases to the contractor's Rate Schedule (Attachment D, Version 3.5) for 76 pay items related to environmental remediation services, effective June 10, 2024, for all new work assignments offered on or after the Rate Change Date. Rate increases range from 2.99% to 5.00%, with most increases falling between 3% and 4.99%, all within the maximum 5% threshold permitted under contract provision 11.B.ii. The increases apply to services including site assessment and remedial action plans (ranging from $151 to $13,550), soil and water laboratory analysis (ranging from $18 to $100), equipment mobilization and transportation (ranging from $36.75 to $993), remedial technologies such as air sparging and soil vapor extraction systems (ranging from $541 to $6,000), and professional engineering and geological certifications and reviews (ranging from $158 to $1,394). Pre-existing work assignments and previously offered work assignments continue under the prior rate schedule, ensuring no retroactive rate application.
