About this file

This is a Professional Services Agreement (DC784) between the State of Florida Department of Environmental Protection (DEP) and Post, Buckley, Schuh & Jernigan, Inc. (PBS&J), a Florida corporation headquartered in Tampa. The agreement establishes an indefinite delivery vehicle for professional architectural and structural, civil, mechanical, and electrical engineering services within Districts 3, 4, and 5 of the Division of Recreation and Parks. The contract was executed on April 18, 2008, and is governed by Florida law. The agreement incorporates by reference the Request for Statement of Qualifications (RFSOQ) No. RFSOQBDC12-06/07, the consultant's response thereto, and supporting attachments including a Scope of Work, AutoCAD Drafting Standards, and wage rate tables.

Services are provided on a task assignment basis with compensation structured as a combination of fixed fees, cost reimbursement, and hourly wage rates negotiated during the negotiation phase. The initial contract term is three years from execution, with the option to renew for up to three additional one-year periods, contingent upon satisfactory performance and fund availability. Work is authorized through executed Task Assignment Notification forms and Task Assignment Change Orders, which specify project scope, schedule, fixed price costs, and cost reimbursement not-to-exceed amounts. Payment terms require monthly invoice submission supported by certificates of wage accuracy and travel expense documentation compliant with Florida Statutes §112.061. The Department processes and pays invoices within timeframes specified in §215.422, Florida Statutes. The State's performance obligation is contingent upon annual legislative appropriation. Professional services include schematic design, budgeting, infrastructure design, surveys, construction documents, construction supervision, and payment certification. The consultant must maintain professional liability insurance of $1,000,000 per occurrence, commercial general liability of $1,000,000, and general aggregate coverage of $2,000,000, with the Department named as additional insured. All work products, drawings, and specifications become property of the Department upon creation, except for materials previously patented or copyrighted by the consultant or subconsultants.
