About this file

This is a wage theft prevention certification form issued by the City of Boston, Massachusetts, establishing mandatory compliance requirements for all vendors bidding on city contracts. The form requires prospective bidders to certify their compliance with an Executive Order designed to prevent wage theft and to disclose any violations of Massachusetts General Law Chapter 149, Chapter 151, or the Fair Labor Standards Act within three years prior to bid submission. Vendors must select one of two certification statements: either certifying that neither the firm nor any subcontractor has been subject to federal or state criminal, civil, administrative judgments, citations, determinations, or debarment resulting from wage and labor law violations, or disclosing such violations and including supporting documentation with their bid. Additionally, all vendors must commit to reporting any such violations that occur while a bid is pending or during contract performance within five days of receiving notice.

Vendors who have disclosed violations or been found in violation during contract performance are subject to enhanced oversight requirements, including submission of monthly certified payrolls to the city official and potential requirement to obtain wage bonds or suitable insurance equal to one year's aggregate gross wages for all contract employees. Vendors subject to state or federal debarment for wage law violations or prohibited from contracting with the Commonwealth are ineligible to contract with the City of Boston, and any such debarment or prohibition finding may result in immediate contract termination. All awarded contractors must post Massachusetts Wage and Hour Laws notices informing employees of their protections under applicable local, state, and federal law in conspicuous workplace locations. This certification form must be completed and signed under penalties of perjury, included with all bid or proposal submissions, and for multi-year contracts, completed annually on each contract anniversary date.
