About this file

This is a Wage Theft Prevention certification form (CM-16) issued by the City of Boston in May 2025 that establishes mandatory compliance requirements for all vendors bidding on City contracts. The form requires prospective vendors to certify their compliance with an Executive Order designed to prevent wage theft and violations of wage and hour laws. Vendors must select one of two certification boxes: either certify that neither the firm nor any subcontractor has been subject to federal or state criminal or civil judgment, administrative citation, or debarment related to violations of Massachusetts General Laws chapters 149 and 151 or the Fair Labor Standards Act within three years prior to bid submission, or disclose any such violations and include documentation in the proposal. All vendors must also certify that any violations occurring while a bid is pending or during the contract term will be reported to the City Official within five days of receiving notice. Additionally, vendors awarded contracts must post the Massachusetts Wage and Hour Laws notice at conspicuous worksite locations informing employees of protections under relevant state and federal law.

Vendors that have disclosed wage and hour violations within three years prior to bidding or during contract performance must submit monthly certified payrolls to the City Official for all employees working on the contract and may be required to obtain a wage bond or suitable insurance equal to one year's aggregate gross wages for all employees. Vendors subject to state or federal debarment for wage and hour violations or prohibited from contracting with the Commonwealth are ineligible to contract with the City, and any finding of debarment authorizes contract termination. Completion of this form is mandatory for bid acceptance, and for multi-year contracts, the certification must be renewed annually on each contract anniversary.
