About this file
This is a Wage Theft Prevention Certification Form (CM-16) issued by the City of Boston for use in municipal contract bidding and procurement. The form establishes mandatory wage theft prevention requirements that all prospective vendors must acknowledge and certify compliance with prior to bid or proposal submission. Vendors are required to select one of two certification statements: either certifying that neither the firm nor any subcontractor has been subject to federal or state criminal or civil judgment, administrative citation, final administrative determination, order, or debarment resulting from violations of Massachusetts General Laws Chapter 149, Chapter 151, or the Fair Labor Standards Act within three years prior to bid submission, or alternatively disclosing that such violations have occurred and including supporting documentation with the bid submission. Additionally, all vendors must certify that they will report any violations occurring during the pendency of a bid or during the contract term within five business days of receiving notice.
Vendors who have disclosed wage and hour violations within three years prior to bidding or during contract performance must submit monthly certified payrolls to the City Official for all employees working on the contract and may be required to obtain a wage bond or other suitable insurance equal to one year's aggregate gross wages for all employees. Vendors subject to state or federal debarment for wage law violations or prohibited from contracting with the Commonwealth are barred from City contracting, and the City may terminate any awarded contract upon such a finding or order. All vendors awarded contracts must post the Massachusetts Wage and Hour Laws notice informing employees of protections under the applicable state and federal wage laws in conspicuous workplace locations. For multi-year contracts, the certification must be completed annually on the contract anniversary date. The form was published in May 2025 and approved as to form by Corporation Counsel in April 2025.
