JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER $3,500 ($2,000/$2500 for Construction/Services) AND
UP TO $150,000
(See FAR 13.106-1)
Date: 7/13/2022 PR Number: _________________________
1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
Replace three (3) Cla-Val brand pressure reducing valves (PRVs) and rebuild eleven (11) Cla-Val brand pressure reducing valves (PRVs) within the municipal water distribution within Cow Creek and Furnace Creek in Death Valley National Park. .
2. Sole Source Justification rationale (Check one and explain below):
______X Only one responsible source. (for valve brand)
______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
_____ Other _____________________________________________________
Explain:
Multiple small business vendors have the capability to perform as the general contractor for this requirement. However, the brand of Cla-Val is the only acceptable manufacturer to supply PRVs to the water systems. While the water systems could be made to operate safely utilizing different manufacturer of valves, the government does not have the expertise nor staffing that would be required to re-design, specify, install, and monitor the public water systems performance to ensure:
- Safety of the water delivered to the public
- System pressures that are low enough to prevent pipe and fixture bursting/leaking
- System flows that meet the requirements for fire flow at fire hydrants
There are no system warranties that would be effected by utilizing a different brand of PRV. However, it is estimated that the level of effort required by the government in order to change brands for the three replacement valves would include approximately 40 hrs of park engineer time, 10 hrs training per utility operation staff member x 7 staff, plus 40 hrs of Utility Administrator time in adjusting, verifying, and certifying the system post-install.
The industry for manufacture of valves for municipal water systems is very specialized. Other manufactures provide valves, but the performance of the valves within the very specific conditions of the water systems cannot be guaranteed. DEVA has recently experienced this situation with another brand valve that was discovered to provide appropriate pressure control for potable water, but when fire flows were tested the valve failed to allow adequate pressure/flow to the fire hydrants. With the staffing shortages at DEVA, this condition existed for several years without adequate flow to hydrants before it was recently discovered.
Additionally, this requirement includes the rebuilding of eleven existing Cla-Val brand PRVs. The manufacturer of the valves authorizes and licenses one vendor in each geographic region to represent the manufacturer, sell the valves, and support the product. This vendor is the only vendor in the region that can provide Cla-Val manufacturer authorized rebuild services for Death Valley National Park.
The requirement also fulfills the purpose of training DEVA utility staff on the rebuilding of Cla-Val brand PRVs, which are present in four different water systems at DEVA.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:
Purchase and install of the three (3) requires a general contractor with the capability and experience to perform underground work on municipal utility piping. This includes knowledge of piping, specialized fittings, and disinfection processes that are required by regulating agencies. Numerous small business contractors perform this work as confirmed by searching the SBA DSBS database.
Rebuilding of the eleven (11) existing Cla-Val brand valves and training of DEVA utility system operators can only be performed by a manufacturer representative. There is only one manufacturer representative that serves the geographic region where Death Valley National Park is located.
The Cla-Val authorized vendor for the region in which Death Valley National Park is:

4. If this is a determination for sole source, the contracting officer certifies:
a. Only one source is available, or urgent and compelling circumstances exist.
b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
