Justification and Approval
For Other Than Full and Open Competition
1. Contracting Activity:
Veterans Health Administration (VHA), Program Contracting Activity Central (PCAC)
The proposed procurement is for the Electronic Health Records Modernization (EHRM) Infrastructure Upgrades Construction project at the VA Black Hills Health Care System, Hot Springs VA Medical Center (VAMC).
2. Nature and/or Description of the Action Being Processed:
This justification is to support the EHRM Infrastructure Upgrades Construction project at the VA Black Hills Health Care System, Hot Springs VAMC, that will be awarded as a firm-fixed price contract. This justification is for other than full and open competition for the procurement of certain construction materials. The use of a particular brand name for the items listed below accommodates standardization of these items throughout the facility.
a. Acoustic ceiling tiles that may get damaged:
i. Armstrong, 915 2x4 grid
b. Campus fire Alarm system:
i. Johnson Controls
c. Campus physical security system:
i. Johnson Controls
d. HVAC Direct Digital Controls (DDC)
i. Schneider Electric, supported by Temperature Technology Inc.
e. Uninterrupted power supply’s (UPS’s)
i. APC
f. Door Hardware:
i. Corbin Russwin or LSDA (BEST Core compatible), CL-33 x NZD x 626 x M08, qty 35
g. Infection Control:
i. HEPACART 55 Crew Capacity (1+) and Supporting Accessories
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
This procurement is for the EHRM Infrastructure Upgrades project at the VA Black Hills Health Care System, Hot Springs VAMC. The scope includes everything necessary to construct the EHRM Infrastructure Upgrades that meets the requirements of the Department of Veterans Affairs. There are seven (7) brand name items listed for which the VA is not able to accept equal or alternate items. The value of these items is listed below and the VAAR Construction magnitude for the entire project is between $10,000,000 and $20,000,000.
a. Acoustic ceiling tiles that may get damaged:
i. Armstrong, 915 2x4 grid
ii. Value:
iii. Description/Impact: This tile is currently used at both campuses. Note each room or area must match.
b. Campus fire Alarm system:
i. Johnson Controls:
ii. Data Center fire suppression system not fully defined; includes miscellaneous support due to significant remodel efforts.
iii. Value:
iv. Description/Impact: This fire alarm system is currently used at the VA campus and maintained by Johnson Controls. This system software, network connections have passed OIT security requirements. Multiple VA departments are trained on this system and have implemented standard operating procedures (SOPs) to ensure continuous hospital operations.
c. Campus physical security system:
i. Johnson Controls: Johnson Controls, PIV, P2000 physical access control, qty 28
ii. Johnson Controls: Johnson Controls, PIV, P324X-LV (varies by type), qty 28
iii. Johnson Controls: Johnson Controls, Panic Button, varies (with wireless), qty 1
iv. Total Value:
v. Description/Impact: This security system is currently used at the VA campus and maintained by Johnson Controls. This system software, network connections have passed OIT security requirements. Multiple VA departments are trained on this system and have implemented standard operating procedures (SOPs) to ensure continuous hospital operations.
d. HVAC Direct Digital Controls (DDC), supported by Temperature Technology Inc.
i. Schneider Electric, SXWASPXXX10001, qty 28

vi. Description/Impact: The HVAC system, software, standard operating procedures (SOPs), virtual LAN (VLAN), and email/texting notification have passed OIT requirements to run on the existing medical network. Temperature Technology has the contract to maintains the DDC for the campus during normal and emergency events. Deviating from this system/setup will impact hospital operations in a critical manner. Multiple departments and Temperature Technology Inc. are trained on this setup and construction security requirements to ensure continues hospital operation.
e. Uninterrupted power supply’s (UPS’s)
i. APC, specific models have not been specified, just the capacity and voltage.
ii. Value:
iii. Description/Impact: APC manufacturer is known to communicate status across VA campus network and has passed all OIT security requirements. Staff are currently trained on how to support, standard operating procedures (SOP’s) are established, and email status distribution lists have been setup for the solution.
f. Door Hardware:
i. Corbin Russwin or LSDA (BEST Core compatible), CL-33 x NZD x 626 x M08, qty 35
ii. Value:
iii. Description/Impact: This door hardware key system is currently supported by the campus. A multitude of key number schemes for each department are based on the existing system. Deviating from this system would require countless standard operating procedures to be updated with significant resistance.
g. HEPA Cart
i. HEPACART 55 Crew Capacity (1+) and Supporting Accessories (a-g)
a. HEPACART – Multiple Tile Adapter (Fits HALO)
b. HEPACART – Adjustable Ladder Extension Module
c. HEPACART – Wall Access Enclosure with Vision Panels HC55U Series
d. HEPACART – Vinyl/Dust Top Cover HC55U Series
e. HEPACART – Replacement Pre-Filters
f. HEPACART – Clean Mat
g. HEPACART – Cleaning Kit
ii. Value:
iii. Description/Impact: Contractor to use during the project and our facility is in need on a HEPA cart to maintain ICRA/PCRA requirements for patient and employee safety on this and future projects. This will become the property of the VA once the project is complete. The size will work with our smaller elevators.
4. Statutory Authority Permitting Other than Full and Open Competition:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
These items have been standardized throughout the Hot Springs VAMC. Installing a different manufacturers’ system will create significant duplication in cost for the facility, and in most cases the equipment will not function properly. The specific impact for not using the brand name items is listed below:

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small-Business (SDVOSB) Set-Aside. This Justification for Other Than Full and Open Competition will be posted to Federal Business Opportunities with the solicitation.
7. Determination by the Contracting Officer (CO) that the Anticipated Cost to the Government will be Fair and Reasonable:
Government estimate was prepared and provided by the Contracting Officer’s Representative (COR). The anticipated price to the Government for the items requested to be brand name is approximately (this is the total value of all items from section #3).
The items for which brand name approval is being requested are subsequent components to the overall construction project. This procurement will be competed and based on competition; the CO will make a determination of fair and reasonable pricing prior to award.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted:
The market research for the equipment was conducted and prepared by the COR and shared with the CO for further review. The CO was in concurrence with information provided in the estimate
