About this file

This is a certification form related to Pennsylvania's Anti-Sweatshop Procurement Policy (BOP-1302) issued by the Commonwealth of Pennsylvania's Department of General Services, applicable to all apparel and apparel laundering contracts with state and local agencies. The policy requires contractors to certify compliance with labor standards in connection with the manufacturing or laundering of apparel products. Contractors must select one of two compliance pathways: either guarantee that all employees involved in apparel manufacturing or laundering receive hourly wages at least equivalent to the Poverty Threshold (as defined in the policy) and work conditions meeting International Labor Organization standards, with these same requirements extending to all subcontractors and affiliated entities; or demonstrate that a collective bargaining agreement is in effect between the manufacturing facility operator and its employees that will remain valid throughout the contract term. Contractors must provide a comprehensive list of all proposed manufacturing and laundering facilities, including subcontractors and affiliated corporations, with complete facility addresses, owner/operator information, and contact details.

The Commonwealth retains the right to conduct facility inspections during normal business hours and request supporting documentation to verify the certifications made. Contractors who refuse to provide access or documentation must reimburse the Commonwealth for all costs and expenses incurred in pursuing legal or equitable proceedings. The definition of "apparel" encompasses products manufactured, woven, cut, sewn, or otherwise processed from fabrics, leather, or cloth for use as clothing, shoes, or other attire. The "Poverty Threshold" is calculated using the United States Department of Health and Human Resources poverty threshold for a family of three, adjusted by adding twenty percent if health benefits are not provided and reduced by mandatory deductions for housing, transportation, meals, or required job equipment; for non-United States facilities, the purchasing agency may adjust the threshold using factors such as purchasing power parity or relative standard of living. All information provided by contractors may be shared with the public, and any misstatement is treated as fraudulent concealment punishable under Pennsylvania law.
