About this file

This is an Important Tax Notice issued by the State of South Carolina addressing nonresident withholding requirements for contractors and service providers. The notice informs bidders and contractors on the Legal Case Management Software contract opportunity in South Carolina of applicable tax obligations under South Carolina Code of Laws Section 12-8-550 and Section 12-8-540.

Section 12-8-550 requires that governmental entities withhold 2% from payments made to nonresidents conducting business or performing temporary personal services within South Carolina, with specific exemptions for tangible personal property purchases without accompanying services, nonresidents not conducting business in the state, contracts under $10,000 annually, and nonresidents who register with the South Carolina Department of Revenue or Secretary of State and submit Form I-312 (Nonresident Taxpayer Registration Affidavit - Income Tax Withholding). Section 12-8-540 separately requires withholding of 7% for payments to nonresident individuals or 5% for corporations receiving rentals or royalties of $1,200 or more annually for use of property in South Carolina. Nonresidents must submit a separate Form I-312 to each Using Entity making payments under this solicitation, and the affidavit remains valid for all contracts between the nonresident and the entity unless revoked by the Department of Revenue. Inquiries regarding registration should be directed to the License and Registration Section at 803-898-5872 or the South Carolina Department of Revenue Registration Unit, while withholding questions should be directed to the Withholding Section at 803-896-1420.
