About this file
Attachment K is a Certification of Drug Free Workplace form from the Florida Department of Management Services, which is part of the Management Consulting Services Request for Proposal (RFP No. 25-80101500-RFP-V2). The document outlines a required certification for vendors seeking to bid on the state contract, detailing six specific provisions for implementing a drug-free workplace program. These provisions include publishing statements prohibiting controlled substance use, informing employees about drug abuse dangers, providing employees with drug-free workplace policy statements, requiring employees to notify employers of drug-related convictions, imposing sanctions on employees convicted of drug offenses, and making good faith efforts to maintain a drug-free workplace.
The certification serves as a potential tiebreaker in the procurement process, with the document explicitly stating that if the Department receives equal proposals in terms of price, quality, and service, preference will be given to respondents who have signed and submitted this form certifying a drug-free workplace program. The form requires the respondent's authorized representative to sign, affirming compliance with the listed requirements, with a clear warning that false statements are punishable under law. This document is a mandatory attachment for vendors participating in the Management Consulting Services RFP, which aims to establish a new State Term Contract potentially worth approximately $90 million annually.

(4) In the statement specified in (1), above, notifying the employees that, as a condition of working on the commodities or contractual services that are being competitively procured, the employees will abide by the terms of the statement and will notify the employer of any conviction of, or plea of guilty or nolo contendere to, any violation of Chapter 893 or of any controlled substance law of the United States or any State, for a violation occurring in the workplace no later than five days after such conviction.
(5) Imposing a sanction on or requiring the satisfactory participation in a drug abuse assistance or rehabilitation program if such is available in the employee's community, by any employee who is so convicted.
