About this file
Attachment K is a Certification of Drug Free Workplace form for a state government procurement process in Florida, specifically related to a competitive proposal submission. The document outlines a standardized certification process where respondents must demonstrate they have implemented a comprehensive drug-free workplace program as part of their proposal. The form provides a mechanism for potential contractors to verify their workplace drug policies, which could provide a preference in the event of equally rated proposals under Section 287.087 of Florida Statutes.
The certification requires respondents to detail six specific elements of their drug-free workplace program, including publishing employee statements about controlled substance prohibitions, informing employees about drug abuse dangers and consequences, distributing policy statements, requiring employee notification of drug-related convictions, imposing sanctions on employees with drug convictions, and maintaining a good faith effort to sustain a drug-free workplace. By completing this form, respondents can potentially gain a competitive advantage in the proposal evaluation process, with the understanding that false statements are legally punishable.

(4) In the statement specified in (1), above, notifying the employees that, as a condition of working on the commodities or contractual services that are being competitively procured, the employees will abide by the terms of the statement and will notify the employer of any conviction of, or plea of guilty or nolo contendere to, any violation of Chapter 893 or of any controlled substance law of the United States or any State, for a violation occurring in the workplace no later than five days after such conviction.
(5) Imposing a sanction on or requiring the satisfactory participation in a drug abuse assistance or rehabilitation program if such is available in the employee's community, by any employee who is so convicted.
