About this file
This is a Bid Bond form required by the South Carolina Department of Transportation for the Canady Branch Road Bridge Repair project. The bid bond serves as the sole accepted form of bid security and establishes a binding agreement between the proposer (principal), surety, and the Department. The bond amount equals 5% of the total cost to complete as shown on the cost proposal bid form. Upon acceptance of a proposal, the proposer must execute a contract within twenty (20) days of receiving contract forms from the Department and simultaneously provide a Performance and Indemnity bond in the full amount of the Contract Price and a Payment bond equal to 100% of the Contract Price, both conforming to standard forms located on the Design-Build website.
The bid bond functions as a guarantee of the proposer's commitment to enter into the contract based on the terms and conditions set forth in the Request for Proposal and the proposer's response. Failure to fulfill these conditions results in forfeiture of the bid bond amount to the Department as agreed liquidated damages, deemed reasonable to compensate for losses incurred due to the proposer's failure to execute the contract. The document requires execution by authorized representatives of the principal (individual, partnership, or corporation) and the corporate surety, with all signatures, witness attestations, and corporate seals affixed as applicable. The note clarifies that failure to affix a corporate seal does not invalidate the document under S.C. Code 33-1-200.
