About this file

This is a Special Conditions document for RFP-48-27, a Construction Manager/General Contractor (CM/GC) project at Kentucky State University's Health Sciences Center, administered by the Commonwealth of Kentucky through the Finance and Administration Cabinet's Division of Engineering and Contract Administration. The project involves the total construction of work as defined in the contract documents, with substantial and final completion dates to be established for each phase through Change Order prior to the beginning of that phase. The contract specifies that work must accommodate full Owner occupancy of adjacent sites and existing buildings during the entire construction period, maintain access to existing walkways and facility circulation, and provide one week advance notice for activities affecting Owner operations. Work restrictions and blackout dates will be established during Phase C Design, and the contractor must comply with all DECA and KSU security requirements. Testing and balancing and commissioning activities are considered critical project requirements and must be incorporated into the baseline construction schedule with adequate duration and logical sequencing to ensure completion without delaying substantial or final completion.

The contract establishes liquidated damages for failure to meet substantial and final completion dates on a per-calendar-day basis, with specific amounts to be determined during Phase C Design. The Construction Manager is responsible for providing all utilities, paying for and coordinating utility company work including relocations, and providing a full-time resident inspector trailer furnished with specified equipment and utilities for the duration of the project. Special inspections for structures and sites are Owner-provided, while all other testing is Contractor-provided. The Owner may pre-order long lead time items with delivery to an Owner-specified location, which the Construction Manager must receive and offload. Allowances and unit prices for work items are permitted only with prior written Owner approval and will be identified during Phase C Design, as will additive alternates, special project site security requirements, special delegated design requirements, and pre-purchased materials. Hot work involving open flames or heat and sparks in occupied buildings requires specific approval from the Construction Manager.
