About this file

This is an Annual Affidavit document required by the Commonwealth of Kentucky for bidders, offerors, and contractors seeking state contracts. The affidavit establishes compliance requirements across multiple statutory provisions and must be executed under penalty of perjury by a duly authorized representative of the bidding entity. The document addresses compliance obligations for all bids and contracts in general, including adherence to Kentucky campaign finance laws (KRS 45A.110 and 45A.115), disclosure requirements under KRS 45A.485, sales and use tax registration requirements under KRS Chapter 139, state tax payment obligations, trade boycott prohibitions under KRS 45A.607, and restrictions on gift-giving and conflicts of interest under KRS 11A.236. The affidavit is valid for a maximum period of one year from the effective date and must be notarized. The affiant acknowledges that the Commonwealth is relying on the accuracy of all statements and that non-compliance may result in contract termination, repayment of funds, and other legal remedies.

The document includes additional affidavit sections specific to non-bid contracts (sole-source, non-feasible to bid, or emergency contracts), which impose heightened campaign contribution limitations on contractors and their affiliates under KRS 121.056 and KRS 121.330. Separate affidavit provisions address resident bidder status claims under KRS 45A.494(2), requiring bidders to demonstrate authorization to conduct business in Kentucky, filing of corporate income taxes, unemployment insurance contributions, and maintenance of workers' compensation insurance for one year prior to contract advertisement. The document also includes provisions for qualified bidder status claims, including nonprofit corporations under KRS Chapter 163 and qualified nonprofit agencies for individuals with severe disabilities under KRS 45A.465(3), which must employ individuals with severe disabilities for at least seventy-five percent of direct labor hours. The bidding agency retains the right to request supporting documentation for any status claims and may disqualify bidders or terminate contracts for failure to provide such documentation or for non-compliance with affidavit statements.
