Leading by Example Executive Order 594: Decarbonizing and Minimizing Environmental Impacts of State Government Executive Order 594 (https://www.mass.gov/info-details/leading-by-example-executive-order-594-decarbonizing-and-minimizing-environmental-impacts-of-state-government) sets goals and requirements that will accelerate the decarbonization of fuels used to heat and cool state facilities, help to demonstrate new technologies and strategies necessary to meet the Commonwealth’s energy goals, and quicken the shift to electric heating and vehicles. EO 594 also includes provisions directing state entities to improve energy efficiency, conserve water, and reduce embodied carbon in the built environment, among other sustainability directives. Bidders are encouraged to review the directives of this Order and offer products that will help state facilities achieve these decarbonization and sustainability targets. Although municipalities are not subject to EO 594, Massachusetts Green Communities have a number of similar decarbonization and energy efficiency targets; see https://www.mass.gov/orgs/green-communities-division.

New Specifications During the life of the contract, the Commonwealth may revise and/or update the specifications to accommodate changes in third- party certifications.

Embodied Carbon and Environmental Product Declarations Executive Order 594 directs state agencies to: “Evaluate and implement strategies to reduce embodied carbon contained in building materials.” Buyers off this contract may request Type III Environmental Product Declarations (EPDs) for construction materials for which EPDs are typically available, including roofing products, lumber products, envelope systems, and concrete and masonry supplies. It is desirable that vendors on this contract provide EPDs upon request that detail the total global warming potential (GWP) of the products based on a Life Cycle Assessment (LCA). Where already available, construction materials offered on this contract shall provide a Type III EPD in a public and freely accessible database. Buyers may use these EPDs to select products with lower global warming potential; as such, vendors are encouraged to provide products with low global warming potential where available.

Embodied carbon reduction is an area of interest for the Commonwealth, and during the life of this contract vendors may be required to work with OSD and/or partner state agencies to ensure EPDs are available for specific products.

Energy-Efficient Products Pursuant to G.L. c. 25B, the Department of Energy Resources (DOER) has adopted regulations at 225 CMR 9.00 (Appliance Efficiency Standards) for testing and certifying the energy and water efficiency standards of certain appliances and lamps. Specified products found to be non-compliant with these standards are prohibited from sale in Massachusetts. The regulations promulgated December 2021, and the Guidelines were released November 2022. Visit the Appliance Energy and Water Efficiency Standards website for more information, and the State Appliance Standards Database to verify that appliance is approved for sale in Massachusetts: (https://neep.org/SASD) In addition, for other products, Executive Order 515 directs state agencies to: “procure only ENERGY STAR-rated office equipment, appliances, HVAC equipment and other ENERGY STAR rated products unless such products can be demonstrated to be cost-prohibitive over their life”; and “support the procurement of other energy-efficient products whenever possible, including but not limited to high efficiency motors, tankless water heaters, programmable thermostats, heating, ventilation, and air conditioning units/systems, and food service equipment.”

Mercury Products Vendors must confirm compliance with the Massachusetts Mercury Management Act of 2006 and the subsequent regulations promulgated as a result of the law (www.mass.gov/dep/toxics/laws/regulati.htm#hg). Vendors must ensure that their processes for the selling, handling and disposing of products containing mercury meet the specifications detailed in these regulations and as outlined below. See Summary: Massachusetts Mercury Management Act http://www.mass.gov/eea/docs/dep/toxics/laws/hglawfax.pdf. This also includes phasing out the sale of specific products containing mercury; vendors must not sell the following products that contain mercury: Thermostats, Barometers, Flow meters, Hydrometers, Hygrometers and Psychrometers, Manometers, Pyrometers, Switches and Relays. The sales ban does not apply if the use of a product is a federal requirement or if a specific exemption is obtained from MassDEP.

Products with Low Volatile Organic Compounds (VOCs) Executive Order 515 directs Massachusetts’ Agencies “to procure products that contain no or low amounts of Volatile Organic Compounds (VOCs), wherever feasible, including but not limited to, office equipment, furniture, flooring, paint, and construction materials.” Vendor shall provide low- or no-VOC product options in applicable categories. To the greatest extent possible, vendors shall offer and label products that are low emitting and that contain zero or low VOCs including products that are certified as low emitting by organizations such as Scientific Certification Systems (SCS) under its Indoor Air Advantage standard or UL, under its GREENGUARD standard.

Packaging Packages, packaging components, and packaged retail-ready products offered to the Commonwealth of Massachusetts shall use packaging materials with recycled content to the greatest extent possible, and contain recycled content consistent with the EPA’s Comprehensive Procurement Guidelines. It is desirable that packaging meet the Toxics in Packaging requirements located here: https://toxicsinpackaging.org/.

Products with Recycled Content Bidders shall offer products that meet the minimum recycled-content standards in the Federal Comprehensive Procurement Guidelines (CPG) in all applicable categories: https://www.epa.gov/smm/comprehensive-procurement-guideline-cpg-program#products.
