EVALUATION FACTORS
ATTACHMENT 4
52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. TECHNICAL
2. PRICE
Technical and Past Performance, when combined, are approximately equal when compared to price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). This solicitation contains 52.217-8, the Government will assume that the prices in OY 4 are the same for the period covered under 52.217-8 and the Government will add ½ of OY 4 to the total in order to determine the overall evaluated price.
(c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
ADDENDUM TO 52.212-2
BASIS FOR CONTRACT AWARD: This is a best value source selection, in accordance with FAR Part 12.602, in which competing offerors’ price and technical will be evaluated. By submission of its offer, the offeror agrees to all solicitation requirements, including terms and conditions, representations, and certifications, and technical requirements, in addition to those identified as evaluation factors. Failure to meet a requirement may result in an offer being determined technically unacceptable. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforms to the solicitation, has the lowest price and is considered to be technically acceptable. The Government will evaluate offers on these factors:
A. Technical Approach. Initially, the Government technical evaluation team will evaluate the technical approach on a pass/fail basis, assigning ratings of Acceptable or Unacceptable based on these factors.
• The Offeror shall provide repairs and services on Smiths Detection cabinet models 6040-2is, 6046si, 100100v-2is and 7555si machines CONUS and OCONUS. This includes technicians that can perform the annual PMI listed in the machine user manual to include a radiation survey.
• The Offeror shall provide technicians that are U.S. Citizens or resident aliens authorized to work in the United States, certified by the manufacturer to service the aforementioned x-ray models and can or currently possess a favorable national criminal background check. This includes technicians that possess a valid government issued identification with photograph for visual recognition.
• The Offeror shall respond to service and repair calls and have the machine repaired within five
(5) working days. This includes having the parts on site in order to complete the repairs on time.
• The Offeror shall provide parts shipping to and from the location of need at no additional cost to the USMS.
• The Offeror shall provide a primary and alternate point of contact. This includes telephone with voicemail and email.
• The Offeror shall provide a toll-free service number and e-mail address for service calls.
• The Offeror shall relocate the aforementioned x-ray models upon request CONUS and OCONUS.
This can include roller tables and other accessories associated with the machine.
• The Offeror shall provide a Quality Control Plan. At a minimum, the Contractor shall discuss:
a. Scheduling and reporting
b. Training of employees and subcontractors
c. Ability to acquire and install parts and software, including original equipment manufacturer (OEM) parts
d. Ability to deliver an x-ray repair response time of at least five (5) working days
Technical Acceptability will be evaluated in accordance with the following Table:
TABLE 1 – TECHNICAL EVALUATION FACTORS
RATING DESCRIPTION
ACCEPTABLE The technical quote offers the minimal requirements of the SOW. The Government has a moderate expectation that the offeror will successfully perform with required effort.
UNACCEPTABLE The technical quote does not offer minimal requirements of the SOW. The Government has a low expectation that the offeror will successfully perform the required effort.
The Government intends to award a contract without discussions with respective offerors. The Government, however, reserves the right to conduct discussions if deemed in its best interest.
B. Price Evaluation. Next, the Government shall rank all technically Acceptable offers by price, including any option prices if applicable. An offerors proposed price will be determined by the use of Attachment 3 – Pricing Template. Please see the instructions on Attachment 3 for filling out the template. The price evaluation will document the reasonableness of the proposed total evaluated price.
C. Other Notifications. An offeror receiving an ‘Unacceptable’ rating in any factor will not be considered for award regardless of ratings in other factors or total evaluated price. Offerors may be asked to clarify certain aspects of their quote or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system.
Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for quote revision.
