PERFORMANCE WORK STATEMENT
CUSTODIAL SERVICES
PART 1
GENERAL INFORMATION
1. GENERAL: This is a personal services contract to provide supplemental Custodial Services to the National
Bio and Agro-Defense Facility (NBAF) Campus. The goal is to support mission accomplishment by assisting the five USDA government employed daytime custodians in providing safe and clean campus for occupants, users, and visitors to facilities identified under this contract. To meet this goal, close coordination is required between the Contractor and the Contracting Officer’s Representative (COR) to efficiently provide Custodial Services while minimizing disruptions to operations within the facilities and meeting security requirements. USDA-ARS shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to USDA-ARS.
1.1 Definitions:
USDA – United States Department of Agriculture

NBAF -
1.2 Objectives: The objective of this contract is to support mission accomplishment by providing evening cleaning of the NBAF Campus for occupants, users, and visitors to NBAF through this contract. To meet this objective, close coordination is required between the Contractor and the
Contracting Officer’s Representative (COR), to efficiently provide Custodial Services while minimizing disruptions to operations within the facilities and meeting security requirements. The level of effort required would be similar to what the government custodians accomplish each day.
1.3 Scope: The Contractor shall provide all management, and labor necessary to ensure that custodial services are performed at NBAF, in a manner that will maintain a satisfactory facility condition and present a clean, neat, and professional appearance. The Contractor shall accomplish all cleaning and disinfecting tasks and be required to supplement the workload of the five daytime USDA
Government employed custodial staff, in order to meet the requirements of this PWS the contract shall be performed in accordance with all applicable laws, regulations, final governing standards, instructions, and commercial practices.
1.4 Licenses, Permits and Bonds: The Contractor shall provide at the contractor’s own expense all licenses, permits and bonds as required by the Federal, State, Counties and Municipalities to provide
Custodial cleaning under the terms of this contract.
1.5 Period of Performance: The period of performance (POP) shall be for one (1) Base Year of 12 months and four (4) 12-month option years. The POP reads as follows:
Base Year 2022.XX.XX to 2023.XX.XX
Option Year I 2023.XX.XX to 2024.XX.XX
Option Year II 2024.XX.XX to 2025.XX.XX
Option Year III 2025.XX.XX to 2026.XX.XX
Option Year IV 2026.XX.XX to 2027.XX.XX
1.6 Place of Performance: The work to be performed under this contract will be performed at the United
States Department of Agricultural NBAF facility, located 1980 Denison Ave in Manhattan Kansas
1.7 Hours of Operation: The Contractor is responsible for providing services between the hours of 1500 to 2400, Monday through Friday except Federal holidays or when the USDA-ARS facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must always maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the USDA-ARS facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.7.1 Work Coordination: The Contractor’s service personnel shall contact the ARS Contracting
Officer Representative (COR) on each visit to the Facility prior to beginning work that day to coordinate work efforts with the dayshift USDA ARS custodial staff. Within 72 hours of service rendered the contractor shall provide, in writing a list of all work that was completed.

1.9 Quality Control Program (QCP): The Contractor shall develop, implement, and maintain an effective
QCP to ensure services are performed in accordance with (IAW) this PWS. The QCP, including changes, shall be forwarded to, and accepted by the CO. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of deficiencies and shall review the plan with the contractors’ onsite personnel to ensure complete understanding. The
Contractor’s QCP is how the Contractor assures that the work complies with the requirement of the contract. The QCP must be provided within 30 days of the notice to proceed and shall be kept current, reflecting the pertinent contract modifications, and building changes or conditions, with updates being submitted within five (5) days of changes being made. The plan shall include but is not limited to the following:
• The name of the Project Manager
• A communication plan that shall describe methods of direct and indirect communication with
USDA-ARS regarding performance of the contract.
• The Contractor shall give immediate written notice to the CO or COR of any condition which is discovered that may present a hazard to the equipment.
• The method(s) for identifying and preventing defects in the quality of service performed before the level of performance becomes unacceptable.
• On site records of all inspections conducted by the Contractor and necessary corrective action taken. This documentation shall be made available to the CO and/or COR during the term of the contract.
• A contingency plan to provide for continuing Custodial Services in the event of employees’ absences, strikes or work stoppages. Work stoppage or strike participation by Contractor personnel against the Contractor does not relieve the Contractor of responsibility to fulfill the requirements of this PWS.
1.10 Type of Contract: USDA-ARS will award a performance-based commercial services contract. This means that USDA-ARS has described WHAT is to be accomplished, not HOW to accomplish it, and states a basis for determining whether finished work meets USDA-ARS quality requirements. It does not state detailed procedures for accomplishing the requirement unless there are safety, security, or communication requirements. It is the intent of USDA-ARS to provide the Contractor the maximum amount of flexibility to propose an innovative approach, and to find the most efficient and cost-effective method for meeting the stated objectives and requirements.
1.11 Post Award Conference / Performance Evaluation Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with FAR Subpart 42.5. The CO and COR shall have performance evaluation meetings with the Contractor to review the Contractor's performance as needed. At these meetings the CO will apprise the Contractor of how the Government views the Contractor's performance and the
Contractor will apprise USDA-ARS of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. Meetings may be held quarterly thereafter as determined beneficial by USDA-ARS and Contractor.
1.12 Contracting Officer’s Representative (COR): The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions:
Assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, and specifications; monitor Contractor's performance and notifies both the CO and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. The COR is not authorized to change any of the terms and conditions of the resulting order.
1.13 Personnel
1.13.1 Contractor Key Personnel: The Contractor shall provide a contract manager who shall be responsible for the performance of the work and shall be the central point of contact with the
Government. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the CO. The contract manager or alternate shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available from 0800 to
1500, Monday through Friday except Federal holidays or when the USDA-ARS facility is closed for administrative reasons. Since this is a performance-based contract, the manpower and labor mix of employees to perform this contract remain the discretion of the Contractor for all services.
1.13.2 Special Qualifications: Contractor personnel shall be certified by appropriate federal and state regulatory agencies to meet federal and local certification requirements in Custodial services. All work shall be performed with, and under the supervision of, skilled and experienced Custodial Staff directly employed by the Contractor, and certified.
1.13.3 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are
USDA/Government officials. They must also ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.
1.13.3.1 Rosters: For NBAF Facility security purposes, the Contractor shall provide the
CO a list of all employees who will perform work under this contract. The list shall include name and work assignment of each employee. The Contractor shall maintain revisions and updates to this list and submit them to the COR monthly.
1.13.3.2 Employee Badges: The Contractor shall furnish each employee a contract identification badge that shall be conspicuously displayed when working. The
ID badge shall include the full name of the employee, company name, a badge serial number and the employee’s picture.
1.13.4 Contractor Personnel Conduct: Contractor personnel’s conduct shall not reflect discredit upon USDA-ARS. The Contractor shall ensure that personnel present a professional appearance. The Contractor’s employees shall observe and comply with all local policies and procedures concerning fire, safety, environmental protection, sanitation, security, and possession of firearms or other lethal or illegal weapons or substance. The Contractor is responsible for ensuring that any contractor employees providing services under this contract conduct themselves and perform services in a professional, safe, and responsible manner. The Contractor shall remove from the job site any employee for reasons of misconduct or security. Particular attention should be paid to acceptance of gifts/ gratuities, and on non-disclosure of sensitive or classified information. The Contractor shall ensure employee conduct complies with 41 USC 423 relative to release of acquisition related information, or actions or discussions which may prejudice future competitions. The
Contractor shall ensure no contractor employees conduct political related activities or events on the Installation.
1.14 Reporting and Record Keeping Requirements:
1.14.1 Inspection, Serviced, Certification Reports and Performance Testing Results: The
Contractor shall provide a work schedule for all the Custodial Services that includes plans for cleaning. Work schedules shall be designed for all procedures to be performed. The annual schedule shall be submitted to the COR NLT than 14 working days prior to commencing work on this PWS. Updates to the schedule shall occur as needed but not less than annually. All cleaning, routine work, and other activities shall be performed in accordance with schedules submitted by the Contractor. If deficiencies are identified that require services outside the scope of this contract, the Contractor shall notify the COR in writing within 24 hours upon discovery of the deficiency. Reports should be submitted to the COR 14 working days after the inspection is complete.
1.14.2 Work Action Reports: The Contractor shall notify the COR each day in writing of all work that was completed. Work hours and tasks preformed will be recorded in NBAF’s CMMS.
1.15 Payments: Payments for preventative maintenance, service calls and repairs shall be on a monthly, fixed price basis.
1.15.1 Other than Custodial Services: A service call that falls outside the scope of normal
Custodial services schedule identified in paragraph 3, shall be billed separately, according to an agreed upon service rate proposed in the applicable CLIN. Service calls that are identified in paragraph 3 are part of the firm fixed monthly price, and not available to be billed under 1.17.1 procedures.
1.15.2 Parts and Materials: The Contractor will be reimbursed for parts and materials required to perform service call work within of the scope of this contract, in accordance with the applicable contract line items and as described herein
1.15.2.1 Pre-approval of Pricing for parts, materials, and any special equipment shall be unburdened and supported with a quote. The amount billed shall be the lowest cost that is reasonably available to the Contractor. All parts and materials billed for have approved supporting documentation submitted in conjunction with the invoice and shall be included on the invoice under the appropriate CLIN, for the period of performance that the work was completed.
1.15.3 Equitable Adjustments: Equitable adjustments that are deemed fair and reasonable by the
CO, shall be applied if necessary.
1.16 Environment and OSHA: The Contractor shall comply with all local, state, and Federal environmental and occupational safety laws, rules, and regulations. Any apparent conflict between compliance with such local, state, and Federal laws, rules and regulations, and compliance with the requirements of the contract shall be immediately brought to the attention of the CO and/or the COR for final resolution. The Contractor shall notify the CO and COR in writing in addition to any verbal notification of such conflicts within 24 hours of occurrence. The Contractor shall be liable for all fines, penalties, and costs which result from violations of, or failure to comply with, all such local state, or Federal laws, rules, and regulations. All unsafe acts or conditions fostered by the Contractor or Contractor personnel may be grounds for the CO or COR, to halt all Contractor performance with a commensurate deduction of monies due the Contractor until such unsafe conditions are corrected.
The Contractor shall take due caution not to endanger personnel during performance of this contract.
Upon discovery of any hazard such as, but not limited to, fire, or large fuel spill, the Contractor shall immediately notify the CO or COR.
1.17 Security Requirements: Personnel employed by the Contractor or any representative of, or agent of the Contractor, entering this facility shall conform to the facility security regulations. Each person accessing the site will be required to provide personal details, (full name, DOB, SSN, DL#) and will undergo a routine background check, such as a National Agency Check with additional inquiries, which may include a criminal and credit check. Details required for the check should be submitted to the security office NLT 5 days prior to the visit. Results of this check may return earlier.
However, it should not be planned to have results earlier than 5 days. The contractor will need to get a local badge to perform work at NBAF. Contractors needs to follow Title 41, Code of Federal
Regulations, Part 102-74, Subpart C Rules, and Regulation Governing Conduct on Federal Property.
1.17.1 If, while on site the contractor/vendor will have access to sensitive information, they must complete a National Disclosure Agreement, along with the required training. This training will most likely be completed by reviewing a series of slides covering the topics of the definition of controlled unclassified information (CUI), access, handling, distribution, storage, and destruction of CUI. Each person will acknowledge receiving and understanding the training on the NDA. The process should not exceed two hours. Acknowledgement and completion of the
NDA will be turned in with the form required for the background check. Results will be returned through the Contracting Officer or Contracting Officer Representative.
1.17.2 Physical Security: The Contractor shall safeguard all USDA-ARS equipment, information and property provided for Contractor use. At the close of each work period, USDA-ARS facilities, equipment, and materials shall be secured.
PART 2
GOVERMENT FURNISHED ITEMS AND SERVICES
2. GOVERMENT FURNISHED ITEMS AND RESPONSIBILITIES
2.1 General: The Government shall provide and maintain all equipment necessary to perform the requirements of this contract. The Contractor may perform cleaning, and other normal maintenance requirements of equipment on site.
2.2 All equipment used in the performance of this contract shall be in good operable condition and carry a U/L (Underwriters Laboratory) listing. Equipment found to be unsafe and unable to function as designed, shall not be used in performance of this contract. Any damage to equipment or equipment malfunctions must be reported to the CO or COR immediately.
2.3 GOVERMENT FURNISHED TRASH LINERS AND RESTROOM SUPPLIES
• Plastic Trash Can Liners/Bags: Suitable for the type of trash receptacle.
• Toilet Tissue: Two-ply.
• Paper Towels: Bi-Fold, Tri-Fold, Dispenser type.
• Hand Soap: Liquid anti-bacterial soap for installed liquid soap dispensers, and/or hand size push/pump liquid anti-bacterial soap when installed dispensers are non-operational.
• All cleaning and disinfecting chemicals needed to complete the tasks listed in this PWS.
2.4 The Government shall provide adequate numbers of equipment items to effectively fulfill the scope of this contract. In addition, the Government shall maintain or have backup capability to provide continued service in the event primary equipment is down for extended maintenance or repairs. Equipment failure shall not alleviate the Contractor from performing any requirement contained in this contract.
2.5 No government furnished supplies or equipment are to leave the premises.
CONTRACTOR FURNISHED ITEMS AND SERVICES
3. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES
3.1 General: The Contractor shall provide and maintain any Vehicles necessary to perform the requirements of this contract. Maintenance and repair of Contractor vehicles or their privately owned vehicles shall not be accomplished on site. Contractor vehicles shall have the company name prominently displayed on both sides of the vehicle and be maintained to present a neat, professional appearance.
3.2 UNIFORMS: The Contractor shall provide Uniforms for staff that have the company name prominently displayed and be maintain a present a neat, professional appearance.
3.3 (OPTION) All equipment used in the performance of this contract shall be in good operable condition and carry a U/L (Underwriters Laboratory) listing. Equipment found to be unsafe and unable to function as designed, shall not be used in performance of this contract. The CO or contracting officer designated representative (COR) may inspect the Contractor’s equipment and vehicles at any time and direct the removal of any unsafe or unusable equipment or vehicle from the installation.
3.4 (OPTION) CONTRACTOR FURNISHED TRASH LINERS AND RESTROOM SUPPLIES

3.5 (OPTION) The Contractor shall provide adequate numbers of equipment items to effectively fulfill the scope of this contract. In addition, the Contractor shall maintain or have backup capability to provide continued service in the event primary equipment is down for extended maintenance or repairs. Equipment failure shall not alleviate the Contractor from performing any requirement contained in this contract.
3.6 (OPTION) Manufacturer's Parts: The Contractor shall provide only new parts used by the manufacturers of the equipment for replacement or repair, and to use only those lubricants obtained from and/or recommended by the manufacturer of the equipment. Equivalent parts, rebuilt parts or lubricants may be used only if approved in writing by the CO or COR.
3.7 Compatibility: All Contractor-furnished property and services shall be compatible with existing
Government systems.
3.8 Billing: All parts and materials shall be billed IAW
PART 3
SPECIFIC TASKS
4. SPECIFIC TASKS: The Contractor shall be responsible for cleaning areas unable to be cleaned by the daytime government custodians including Government requested service calls, and safety/performance inspections. Work shall be performed in such a matter to meet the performance requirements stated herein.
See frequency schedule for specific tasks in attachments of this PWS.
4.1 Performance Standards: Services will be provided 5 day a week Mon-Fri between the hours of 1500 and 2400
4.1.1 NON-CARPETED FLOORS (HARD FLOORS: VINYL TILE, CERAMIC TILE, WOOD,
CONCRETE, ETC.) Hard floors shall be maintained free of grit, soil, dust, scuff and heel marks, stains, spills, debris, litter and other foreign matter by effective routine cleaning.
Cleaning shall be accomplished by the most appropriate method (vacuum, sweep, dust mop, damp mop, spot clean, and machine scrub etc.) and with cleaning solutions for the specific floor type. After cleaning, floor surfaces to include grout shall have a uniform, clean appearance without streaks, swirl marks, detergent residue, or any evidence of soil, stain, film, or standing water.
4.1.2 CARPETED FLOORS. Carpets shall be maintained free of soil, dirt, debris, litter and other foreign matter by effective routine vacuuming. The contractor shall use efficient vacuum cleaners shall offer high airflow, high efficiency filtration, and an adjustable rotating brush agitation for more effective soil removal. Any spots and/or spills shall be removed by the carpet manufacturer’s approved methods or other commercially accepted practices as soon as noticed. All tears, burns, and raveling shall be brought to the attention of the facility manager. Area and throw rugs shall also receive this service. Chairs, trash receptacles, and other easily moveable items shall be moved to maintain floors underneath these items and returned to their original and proper position after cleaning.
4.1.3 STAIRWAYS/ELEVATORS. All floor surfaces shall be cleaned in accordance with paragraph 4.1.1 or 4.1.2, as appropriate. Stair guards, handrails, wall caps and baseboards shall be free from grease and grime. The Contractor shall remove all marks, dirt, smudges, scuffs, and other foreign matter from adjoining stairwell walls, up to 72 inches height from stair tread level, to provide or maintain a clean, uniform appearance.
4.1.4 CLEAN FLOOR (WALK-OFF) MATS Vacuum and/or clean interior and exterior floor mats. Mats shall be free of all visible lint, litter, debris, soil, and other foreign matter. Soil and moisture underneath mats shall be removed, and mats returned to their normal location prior to departure.
4.1.5 TRASH COLLECTION All trash containers shall be emptied and returned to their original location. Trash receptacles shall be left clean, free of foreign matter, and free of odors upon service. Trash containers may be added or removed at no additional cost to the
Government.
4.1.6 TRASH CONTAINER LINERS The Contractor is required to replace liners in containers from individual desks.
4.1.7 TRASH DISPOSAL LOCATION All trash collected will be discarded in the compactor at the Transshipping building daily.
4.1.8 PERIODIC CARPET RESTORATIVE CLEANING Carpets shall be deep cleaned in order to remove embedded soil from carpet fibers. Deep cleaning shall employ an effective technique and/or method to address soil suspension, soil extraction and drying. After deep cleaning, the carpeted area shall show an improvement in visible appearance.
4.1.9 Periodic Hard Floor Maintenance. Hard floors shall be cleaned, scrubbed, sealed, polished, waxed, Oiled, and stripped as required for the appropriate surface to maintain, protect, and ease normal routine floor cleanings. After periodic maintenance, floor surfaces to include grout shall have a uniform, clean appearance without streaks, swirl marks, detergent residue, or any evidence of soil, stain, film, or standing water.
4.1.10 DUSTING Low dusting includes surfaces within 6 feet of the floor and must be free of dust, lint, cobwebs, and litter. High dusting includes surfaces above 6 feet up to 10 feet.
Surfaces could include items such as tables, shelves, bookcases, storage lockers, windowsills, handrails, pictures, clocks, window blinds, ECT.
4.1.11 INTERIOR WINDOWS AND OTHER GLASS SURFICES Contractor shall wash and dry interior windows, partition glass, and all other glass surfaces. All foreign matter shall be removed and cleaned from frames, casing, and sills. Windows shall be clear and free of dirt, film, smudges, streaks, paint drips, water, and other foreign matter. Cleaning methods and solutions used shall not scratch, discolor, or damage the glass or window finish. Contractor shall raise blinds or shades to clean windows and return to original position prior to departure.
4.1.12 CLEAN DRINKING FOUNTAINS Contractor shall clean all facility drinking fountains when basic cleaning is performed. All porcelain and polished metal surfaces, including the orifices and drain, as well as exterior surfaces of fountains shall be cleaned and disinfected.
Drinking fountains shall be free of streaks, stains, spots, smudges, scale, and other obvious soil.
4.1.13 RESTROOMS/LOCKER ROOMS All surfaces including floors, sinks, countertops, mirrors, toilets, urinals, lavatories, showers, shower mats, dispensers, plumbing fixtures, doors, walls, partitions, stalls, stall doors, entry doors (including handle, kick plates, ventilation grates, metal guards), walls, and other such surfaces shall be cleaned and disinfected using a germicidal detergent. Restrooms shall have a clean scent or no odor at all. Showers, toilets, and urinals will be free of spots, water spots, scale buildup, soap scum, odors, and any other deposits. Mirrors shall be clean and have no streaks or other removable matter. Partitions shall be smudge, dust, and stain free. Vents shall be clean.
Restroom sinks, countertops, and fixtures shall be free from water and scale deposits, soil, streaks, and other removable matter. Walls and grout shall be free of all film, spots, and detergent buildup.
4.1.14 BREAKROOMS/EATING AREAS All surfaces including floors, sinks, counter tops, dispensers, plumbing fixtures, doors, walls, entry doors (including handle, kick plates, ventilation grates, metal guards), walls, and other such surfaces shall be cleaned and disinfected using a germicidal detergent. Breakrooms shall have a clean scent or no odor at all. Vents shall be clean. Sinks, countertops, and fixtures shall be free from water and scale deposits, soil, streaks, and other removable matter. Walls and grout shall be free of all film, spots, and detergent buildup. Appliances shall be free from food debris and cleaned inside and out.
4.1.15 STOCK RESTROOM SUPPLIES Contractor shall ensure restrooms are stocked sufficiently so any provided supplies including trash bags, toilet tissue, paper towels, and hand soap do not run out and all dispensers are filled without promoting waste at time of service.
4.2 Contractor Responsibility: The Contractor shall be responsible for giving immediate notice to the
CO and/or COR of any condition that is discovered that may present a hazard to the equipment. The
Contractor shall be responsible for notifying the CO or COR in writing, of the existence or development of any defects in, or repairs required which they do not consider to be their responsibility under the terms of the contract.
4.3 Contractor Negligence or Omission: The Contractor, at no additional cost to the Government, shall accomplish all repairs resulting from prior acts of negligence on the contractor part, or the part of the contractor employees and agents, or omission in performing maintenance or repairs required in this contract. Should the Contractor and the CO be unable to agree as to whether damage was caused by a negligent act or omission of the Contractor, such dispute shall be settled pursuant to FAR 52.212-4

4.4 Repairs Necessitated by Other than Fair Wear and Tear: The Contractor shall immediately notify the COR whenever they find evidence that repairs are required due to other than fair wear and tear.
This includes fire, theft, vandalism, negligent acts, misuse, or abuse by anyone other than the
Contractor, the contractor agents, or employees. Should USDA-ARS deem a criminal investigation warranted due to the evidence, the Contractor shall provide any technical information needed by the law enforcement agency performing the investigation. The Contractor shall not be required by this contract to make renewals or repairs necessitated by proven negligence or misuse of the equipment by persons other than the Contractor, their representative and employees, or by reason of any other proven cause except for normal wear and tear, beyond the control of the Contractor. The CO reserves the right to make the final determination concerning the responsibility for such defects, corrections, or repairs.
4.5 Equipment / Service Responsibilities:
4.5.1 Preform Custodial services for the NBAF campus (All buildings on the attachments).
Custodial hours of operation will be between the hours of 1500 and 2400 (Option for additional shift 0700 – 1530 at the governments discretion to meet custodial needs).
4.5.2 Clean all windows and glass, interior.
4.5.3 (OPTION) Clean all windows and glass, Exterior. Square footage is included in the attachments. (This option will be paid for by a separate CLIN)

5.1 Insurance:
The Contractor’s Workers’ Compensation Insurance shall cover all Contractor personnel. All contractor personnel work related injuries shall be handled by the Contractor’s Workers’ Compensation Insurance.
Additionally, the Contractor shall maintain insurance to cover any site damages caused as a direct or indirect result of the janitorial services provided under the terms of this contract.
5.2 Liability & Bonding:
Proof of bonding and liability insurance of a minimum of $10,000.00 will be required after award of contract and before commencement of work.
5.3 Biobased Products Requirements:
This procurement requires the use of biobased products to the extent that such products are reasonably available, meet agency or relevant industry performance standards, and are reasonably priced. Where available, these products should first be acquired from among qualified products that fall under the umbrella of items designated through the USDA Bio Preferred SM Program
The Contractor must comply with the Agricultural Act of 2014; the Food, Conservation and Energy Act of
2008 (FCEA), 7 U.S.C. 8102; the Farm Security and Rural Investment Act of 2002 (FSRIA), 7 U.S.C.
8102; the Federal Acquisition Regulation; Executive Order (EO) 13514, “Federal Leadership in
Environmental, Energy and Economic Performance,” dated October 5, 2009; EO 13423, “Strengthening
Federal Environmental, Energy, and Transportation Management,” dated January 24, 2007; and
Presidential Memorandum, “Driving Innovation and Creating Jobs in Rural America through Biobased and
Sustainable Product Procurement,” dated February, 2012 to provide biobased products.
The Contractor shall utilize products and material made from biobased materials (e.g. biobased greases;
biobased hydraulic fluids, biobased absorbents) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the
Location Site Manager (LSM).
The following is an example list of products that may be used in this contract for custodial services for which biobased products are available. The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of biobased products listed meeting the health and environmental specifications.
All-purpose cleaner, Heavy duty cleaner, Carpet shampoo, Gum remover, Degreaser/cleaner, Deodorizer, Floor finish, Floor finish restorer, Disinfectant sanitizer, Extraction fluid, Floor stripper, Floor sealer, Furniture polish, Glass cleaner, Neutral cleaner (liquid), Stain remover, Air freshener including dispenser, Bathroom cleaner, Chrome polish/cleaner, Liquid hand soap including dispenser, Lime and scale remover
(tub and tile cleaner), Grout sealer, Stainless steel polish, Toilet bowl cleaner, White board cleaner, Cream cleaner, Solvent.
Biobased products that are designated for preferred procurement under USDA's' Bio Preferred program must meet the required minimum biobased content as stated in the
USDA Final Rule available at www.biopreferred.gov. The Contractor should provide data for their biobased products such as biobased content.
In addition to the biobased products designated by the U.S. Department of Agriculture in the Bio Preferred
Program, the Contractor is encouraged to use other biobased products.
The Contractor shall submit with the initial proposal a complete list of biobased products, indicating the name of the manufacturer, cost of each material, and the intended use of each of the materials that are to be used in carrying out the requirements of the contract. Additionally, the winning Contractor on each anniversary date of the contract shall compile a complete list of biobased products, including the information above, purchased to carry out the contract requirements. The Contractor shall list volume to be used and total cost for each individual product. This information will be used for reporting purposes.
The Contractor shall comply with tile provision at FAR 52.223-1, Biobased Product Certification.
The Contractor shall comply with the clause at FAR 52.223-2, Affirmative Procurement of Biobased
Products under Service and Construction Contracts.
Within thirty (30) days of contract award, the Contractor shall submit an Operations and Maintenance Plan.
This submittal shall be approved by the LSM in writing. The Contractor shall not commence work until this submittal is approved by the LSM in writing.
The Plan must be reviewed and updated annually, and as required by the LSM. The Plan must contain and define the following elements:
• The Contractor's written policy stating its commitment to the use of biobased products, employee health and safety, and sound environmental management practices.
• NOTE: A Contractor may propose more than one product within a product category and/or propose a product or products addressing more than one product category.
• The product guides which define standard operating procedures for instructing staff in the proper use, storage, and disposal of biobased products; proper maintenance of equipment; and other procedures/instructions to accomplish work under this contract.
The Contractor shall provide data on the quantity and dollar values of biobased products used in this contract. The data will be submitted to the LSM quarterly. A demonstration of proper use, an effective training program, and technical assistance are essential to the success of the purchase and use of some biobased products that may function differently than a conventional product. Therefore, we will look for a
Contractor who will 1) demonstrate products, and 2) when selected, offer any necessary training to all of the construction staff and 3) be available with technical assistance to trouble shoot problems.
