About this file
This is an Amendment #3 Questions & Answers document issued by Colorado Parks and Wildlife (CPW) in response to contractor inquiries regarding RFP PMAA 2027_0001 for Forest Habitat Improvement work at Cherokee State Wildlife Area (Upper Unit). The project involves forest management activities at a state wildlife area property. The amendment addresses three primary contractor questions: clarification on responsibility for removing concrete mats and reclaiming temporary access roads from George Creek to the state property (contractors are not responsible for these tasks per the USFS Temporary Access Permit); guidance on material hauling and decking services (CPW requests option pricing to determine best value and reserves the right to decline these services if pricing is unfavorable); and work restrictions during fire season (CPW will not implement restrictions unless a wildfire event threatens the area and safety, with provisions for contract amendment if state-caused delays occur).
The amendment maintains all other existing terms and conditions of the original RFP PMAA 2027_0001. Contractors should refer to Exhibit A, Scope of Work, for detailed requirements regarding fire prevention and safety protocols. The questions and answers provide clarity on contractor obligations and risk allocation, particularly regarding forest management operations, material handling options, and force majeure provisions related to wildfire events that could delay project completion and acreage percentage milestones.

Amendment #3 - Questions & Answers (Q&A)
RFP PMAA 2027*0001
Cherokee State Wildlife Area (Upper Unit) Forest Habitat Improvement
A. The following questions, and the answer to each, were received:
1. Does the contractor need to remove the concrete mat and/or reclaim the temporary access road on USFS coming from George Creek to the State
Wildlife Area gate?
i. Pertaining to the provision stated in Exhibit B of the USFS
Temporary Access Permit for concrete mat removal and reclamation, Contractors are not responsible for removing the concrete mats at George Creek nor are they responsible for reclaiming and reseeding the temporary access road coming from
George Creek to the Cherokee State Wildlife Area (Upper Unit) property.
2. Would we be able to get more information about plans for hauling material before putting numbers to it?
i. CPW desires to see option pricing for hauling off material as well as decking logs on site to determine if CPW can receive best value through the awarded contractor resulting from this RFP for these services. If it is determined that the option pricing will not provide best value to CPW, then CPW reserves the right to not accept the option(s) for material removal and/or decking services and seek other avenues for hauling/decking materials.
3. Will there be restrictions from working under fire restrictions if work is taking place in the middle of next summer?
i. Unless there is a wildfire event that is threatening the state wildlife area and or surrounding federal lands, CPW will not be implementing any restrictions as long as life and safety are not threatened. Should safety be threatened and the project delayed by a wildfire event, CPW will communicate with the Contractor and
USFS to remedy the delay. To the extent any delay is caused by failure of the State or other third party not under Contractor’s control, all Project acreage percentage completion dates and the final completion date, shall be modified by up to the number of days of the State or other third party’s delay, which shall require a fully and properly executed Contract amendment in accordance with
State of Colorado Fiscal Rules and State of Colorado Controller
Policies and Guidelines. See the “Important Considerations” section of Exhibit A, Scope of Work for more specific details regarding preventing fires and overall safety as it relates to this project.
B. All other terms and conditions of RFP PMAA 2027*0001 - Cherokee State Wildlife Area (Upper Unit) Forest Habitat Improvement remain the same.
