About this file
Amendment #2 to the Bridge Asset Management Solicitation 5400018935 issued by the South Carolina Department of Transportation (SCDOT) addresses clarifications and modifications to contract requirements. The base contract term is four years with a 24-month renewal option available. Key amendments include modifications to payment bond requirements, financial documentation submission processes, and pricing terms. The department has clarified that payment bonds may be provided on an annual renewable basis rather than covering the entire four-year contract term, aligning with industry standards for asset management contracts. Pricing must be submitted for the full 48-month base term and 24-month renewal option on the provided pricing spreadsheet, with failure to complete all items potentially resulting in non-responsive proposals. Technical proposal page count exclusions have been clarified to not include section dividers.
The amendment addresses financial documentation requirements by removing the mandatory submission of two-year balance sheets and profit/loss statements from initial proposals while reserving the department's right to request such information from the highest-ranked offeror through direct communication to protect confidential information from disclosure. Payment bonds must be issued by surities licensed to do business in South Carolina and must remain in effect for at least one year following substantial completion. Subcontractors at any tier level must be identified with supporting documentation including business history, current financial position information, three recent comparable contracts with contact details, a statement regarding failed projects or suspensions, and Dun and Bradstreet numbers. The amendment also addresses operational status questions regarding fog mitigation systems outlined in Attachment B.3 and clarifies that dividers in technical proposals do not count toward page limits.

1. In SCDOT’s response to Questions 6 and 9 in Amendment #1 of Bridge Asset Management Solicitation 5400018935, the Department’s response requires a Payment Bond in an amount equal to the total contract price. Given the base term on this contract is 4 years in duration; the total contract price would be for an amount inclusive of all four years. The Industry standard for similar asset management contracts is an annual renewable bond for the annual dollar amount of the contract which is what the Department is currently accepting on this current contract. Requiring a 4-year bond of a 4-year amount is not readily available in the market and such a requirement may likely eliminate most if not all proposers. Will the Department reconsider and accept the originally required $5 million payment bond on a recurring annual renewable basis or accept an annual renewal payment bond for 100% of the annual contract value? This would be in alignment with the Industry Standard for similar Asset Management contracts around the country and consistent with the practice on the current contract.
The Payment Bonds shall:
1 - be issued by a surety company licensed to do business in South Carolina 2 - be accompanied by a current power of attorney and certified by the attorney-in-fact who executes the bond on the behalf of the surety company 3 - remain in effect for a period not less than one (1) year following the date of Substantial Completion or the time required to resolve any items of incomplete Work and the payment of any disputed amounts, whichever time period is longer 4 - Any bonds required by this Contract shall meet the requirements of the South Carolina Code of Laws and Regulations, as amended 5 – Contractors will need to have in place a bond for the life of the contract. As long as you are doing work under this contract you will require a payment bond. If contractors want to provide a bond yearly that is fine as long as each year we have a new bond in place. Comment by Santandreu, Kathy: Need to run this by Phill.
1. Financial Statements contain highly sensitive information that can have competitive implications. Furthermore, a vast majority of subcontractors are privately held companies and sharing this sensitive financial information is very difficult. The SCDOT contract is with the Prime Contractor with which 100% of the risk and responsibilities lie. Is there another compilation of financial information that the subcontractors can provide in lieu of these very confidential financial statements to satisfy what the Department is looking for while protecting this private information from disclosure? If not, can the Department provide a mechanism to accept and confirm acceptance of these statements directly from the Subcontractor so that this confidential information can be protected even within the context of the pursuit teams?
Clause has been amended to read:
QUALIFICATIONS -- REQUIRED INFORMATION (modified)
Submit the following information or documentation for you and for any subcontractor (at any tier level) that you identify pursuant to the clause titled Subcontractor - Identification. Err on the side of inclusion. You represent that the information provided is complete. (a) The general history and experience of the business in providing work of similar size and scope. (b) Information reflecting the current financial position (2 years balance sheet and profit/loss statement) (c) A list of the three most recent, comparable contracts (including contact information – business name, contact information, email and direct phone number) which have been performed. (d) List of failed projects, suspensions, debarments, and significant litigation – if there aren’t any, please submit a statement stating there aren’t any. (e) Dun and Bradstreet number.
Note: While we are removing letter (b) from the above requirements as a document you must submit with your solicitation response, we may require information reflecting the current financial position from the highest ranked offeror. If that is the case, we will communicate with that offeror to discuss how that information will be sent.
1. Question 6 - Is a performance bond required? If so, is it an annual performance bond or does it need to cover the term of the contract? A payment bond is required.
1. Question 11 - In regards to the electrical components outlined in Attachment B.3, what is the current operating status of the fog mitigation systems today and are they 100% operable?
1. Question 20 - Please confirm that pricing needs to be included for the full term of the contract (48 months base term and 24 months renewal option) Pricing spreadsheet has been provided and needs to be fully completed. Failure to provide pricing on any of the items listed on the cost sheet may result in your entire offer being deemed as non-responsive.
1. Question 21 - Please confirm that pricing needs to be included for the full term of the contract (48 months base term and 24 months renewal option) See answer to #5 above.
1. Question 30 - Given that all RFP requirements provided in the technical proposal count towards the page count, does SCDOT want any dividers separating sections and types of information provided, if so will those count towards the page count or will they be excluded? Dividers separating sections will not count towards page count.
