Additional Contractor Notes:
1. This will be an Indefinite Delivery, Indefinite Quantity contract which means that the Government does not currently know the exact amount and timing of the work to be done.
Actual task orders will be issued as needed during the life of the contract.
2. This acquisition is set aside for HUBZone Certified concerns. The solicitation will result in the award of a firm-fixed price Indefinite Delivery / Indefinte Quantity (IDIQ) contract. One or more awards may be made to the responsible Offeror(s) whose proposal(s) are determined to offer the best value to the Government price and other evaluation factors considered. Task orders for identified work will then be competed between the contractors receiving IDIQ contract awards from this solicitation.
3. In order to be eligible for a contract award under this solicitation, you must comply with all requirements of FAR Clause 52.204-7 – System for Award Management. Contractors may register in SAM at www.sam.gov; registration in SAM is free. If you do not have an “Active” profile or you do not submit the requested information according to the solicitation provision, you will be considered non-responsive.
4. The Government intends to evaluate proposals and award a contract(s) without further negotations or discussion, unless clarification is required. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a price and technical standpoint. The Government reserves the right to enter into discussions later, if the Contracting Officer deems that it is in the interest of the Government to do so.

7. The pricing offered is considered by the Forest Service to be contractually binding unit ceiling pricing. If a contract is awarded, the Contractor is bound to this offered pricing as the maximum pricing that can be offered when a task order is solicited. When offering a task order proposal, the IDIQ Contractor can elect to offer less than the contractually established ceiling pricing; however, this reduction is only in effect for that specific task order solicitation / issued task order, and does not constitute a contractual change to the unti ceiling pricing. IDIQ contracts will not be awarded to Offeror(s) who do not propose reasonable initial (ceiling) pricing.
8. There are tasks in this contract that are classified as “construction”. Construction work has the following bonding requrirements: Payment Protection (a Payment Bond or Irrevocable Letter of Credit) will be required for task orders requiring more than $30,000 and less than or equal to $150,000 in construction items (See Section I). Payment protection documentation must be submitted to the Contracting Officer within 10 days of each applicable task order award.
AGRICULTURE ACQUISITON REGULATION (48 CRD CHAPTER 4) CLAUSES
AGAR 452.216-73 Minimum And Maximum Contract Amounts (FEB 1988)
During the period specified in FAR Clause 52.216-18, ORDERING, the Government shall place orders totaling a minimum of $2,500 (per contract; base year only), but not in excess of $1,000,000 (all contracts combined over the life of the contract).
SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C.1: SCOPE OF CONTRACT
The Forest Service (FS) has a requirement for a Performance Based Service Contract for Forest-Wide Trail Maintenance and Construction on the Wayne National Forest.
Multiple awards are expected. The FS anticipates award of at least one Indefinite Delivery Indefinite Quantity (IDIQ), Firm-Fixed Priced Contract for each Zone as described in the Schedule. There will be two zones, the Ironton District –Zone 1 and the Athens District – Zone 2. The contractor(s) shall provide all expertise, labor, supervision, services, equipment, tools, supplies, permits (when and if required), coordination with utilities, transportation, and incidentals necessary to perform trail maintenance, construction and other services directly related to trail activities on the Wayne National Forest in Ohio. The desired outcome will be in strict accordance with the standards attached to each Task Order and will adhere to the contract awarded from this solicitation. Performance of individual tasks will be accomplished by the issuance of Task Orders (TO) against the IDIQ contract (process defined in C.5 Task Orders). Task Orders must be completed to meet or exceed the Acceptable Quality Level (AQL) as described in the Quality Assurance Plan (Attachment #1). The awarded contract and task orders shall constitute the entire agreement including all terms and conditions applicable to the contract.
C.2: PROJECT LOCATION
Work will be performed on various Forest Service trails within the two zones of the Wayne National Forest.
C.2.1: Zone 1: Ironton Ranger District – Counties: Majority of work in Lawrence, Gallia, and Scioto; minor amounts possible in Jackson County.
C.2.2: Zone 2: Athens Ranger District - Counties: Majority of work in Athens, Hocking, and Perry; minor amounts possible in Monroe and Washington Counties.
Please bid on either zone individually or both together. If awarded both zones, you may be required to do work in both zones simultaneously and must have enough resources to accomplish activities at the same time in both zones.
C.3: BACKGROUND
The Wayne National Forest has approximately 150 miles of all-terrain vehicle (ATV) trails, 85 miles of horse (pack and saddle) trails, 48 miles of mountain bike trails, and 159 miles of hiking trails that are a combination of aggregate and native surface. Structures such as bridges, gates, helicopter evacuation pads, parking areas, and trailheads are integral features of the trail systems. Typical trails contain an average of 1-2 culverts and numerous drainage dips per mile of trail. A typical mile of trail also has up to 1/8 of a mile of side ditches, lead-off ditches, and collection basins for sediment control. Most trails are located in forested areas with moderate to heavy vegetation alongside and overhead the trail corridor. Due to the restricted width of the maintained trails, most locations do not allow access for over-road vehicles. This makes placement of aggregate difficult. Access roads are available for use to trailheads and access points along the trail, but the haul distances could be over 2.0 miles on some of the trails in both zones. You will be required to haul aggregates over the trail in vehicles suited for the narrow trails from the closest on-road stockpile site.
A majority of the hauls are less than a ½ mile but significantly longer distances in some locations are expected. Access roads for your use are available in some locations. These include both County, Township, Forest Service and Special Use (forest roads developed by private parties, generally oil and gas companies) roads on National Forest lands.
Some National Forest roads and oil and gas roads could be very difficult to traverse due to the poor condition of the road surface and may require work before suitable for over-road equipment. Repair of these roads is acceptable, but will not be paid for directly under this contract unless agreed to in writing by the Contracting Officer (CO). In most cases it will be for the contractor’s convenience and is incidental to the work being performed. On County or Township roads the Forest Service does not have jurisdiction and you will need to cooperate with the governmental agency having jurisdiction before you do any work on the road.
C.4: CONTRACT REQUIREMENTS
This contract requires all services and related work to be in compliance with its terms, specifications, and provisions. This includes furnishing labor, equipment, supervision, transportation, operating supplies, and incidentals.
C.5: TASK ORDERS
Task Orders for Trails Construction and Maintenance Services on the Wayne National Forest will be competed among the IDIQ contractors. In determining who will receive the Task Order, the Forest Service will consider the price, past performance (including past performance on previous orders under this contract), and any other factors indicated on the Task Order. The Contracting Officer may issue a task order without further competition for such reasons as: 1) meeting the required contract guarantee (base year only); 2) new work that ties directly with previously completed work; 3) or an emergency situation.
Each Task Order will list the tasks and the estimated quantities of those tasks that will be performed. The IDIQ contractors are encouraged to visit the job site prior to submitting a task order proposal to confirm quantities and the overall scope of work; failure to do so will not later be ground for a claim.
IDIQ contractors are authorized to adjust their contractually established line item pricing downward to allow for a better opportunity of task order award; however, the adjusted pricing is only applicable for that specific Task Order and does not constitute a change in the actual contract unit line item(s) ceiling price.
Task Order submittals from each vendor for each Task Order will include the following:
• Work Plan & Schedule – Provide start date, production schedule, completion date, labor and equipment list
• Material Records – At a minimum, provide a copy of material compliance certificates (aggregate, posts, culvert, etc.)
C.6: GENERAL NOTES
1. Trail maintenance will follow the Standard Specifications for Construction of
Trails and Trail Bridges on Forest Service Projects (National Technology and Development Program, 2014) and Standard Trail Drawings.
2. Unless otherwise noted on the Task Order, trails will be maintained to meet National Trail Design Parameters for Class 3 Trails. ATV trails will constitute 90% of trail work on this contract. ATV trail tread will be maintained to a width of 60”; horse trail tread will be maintained to a minimum width of 18” and a maximum width of 48. Mountain biking and hiking trails will constitute less than 5% of the work on this contract. Work on mountain biking and hiking trails will take into account the size of equipment at hand. No specialized equipment will be required on mountain biking and hiking trails that is not acceptable for ATV and horse trails without the agreement of the contractor.
3. The crossing of trail bridges by construction equipment will be at the discretion of the COR, as some bridges are designed for ATV loads only. If necessary, contractor will be allowed to ford creeks in locations approved by the FS. Any work needed to improve the ford will be incidental to work performed, and the fords will be maintained to prevent damage to the environment. Fords will be blocked when you are done with the work in the area to prevent their use by others. All disturbances at bridge sites, outside the trail tread, will be seeded and mulched as soon as it is no longer needed. Use of silt fence may be required at the site, and will be evaluated on a case-by-case basis. If required it will be paid as per section 2.h.1.
4. Haul of aggregates is difficult in many locations. In most locations hauling on the trail is required and in many instances distances average ¼ to ½ mile from stockpile site on the roadway. Hauling with over-road equipment on the trail is not allowed in most locations. Contractor will be required to keep equipment on the maintained tread (except to ford streams and other locations as agreed to in advance by FS). One site on the Ironton RD (Zone 1) is nearly 2.0 miles from the closest stockpile site. At least one section of trail on the Athens RD (Zone 2) is approximately 1.75 miles from the nearest stockpile site. Contractor will be allowed to stockpile in the nearest location to the work, as long as it will not cause damage to the resources. All stockpile sites on Federal ground must be reviewed and accepted prior to stockpiling activities taking place on the ground. No stockpiling along township or county roads is allowed in the Public ROW without written permission from the authority having jurisdiction on the road. In no case will any stockpile site be placed in such a way as to endanger the traffic on a road or trail, plug drainages, damage the facilities, or harm flora or fauna of the Forest.
5. If hauling distance is in excess of ½ mile, pay item 91303.9 Aggregate Surfacing, Additional ¼ Mile Haul Pay Rate will be applied for each additional ¼ mile of one-way haul required. Contractor will make every reasonable effort to get as close as possible to the placement of aggregates with over-road equipment.
6. Woody debris removed from the trailway will be scattered along the trail as shown in the drawings.
7. Soil debris will be placed on the fill side of the trail and spread evenly as directed in the TO. At no time will placement of any debris be allowed in waterways or ditches. Soil will be compacted if over 3” in depth with a vibratory roller that has a minimum weight of 60 pounds per inch of width of the roller drum, equipped with amplitude and frequency controls, and specifically designed to compact the material at hand. Size will be appropriate for trail tread width of ≤ 60 inches.. If under 3” in depth (loose measure) you may track equipment over full width of trail to compact soil to the satisfaction of the COR. Soil will not be considered debris unless it is unsuitable for fill.
8. Fuel storage in bulk stationary containers will not be allowed. Fuel deliveries in contractor owned equipment will be allowed in slip-on truck mounted tanks with less than 250 gallon capacity. Delivery by state licensed fuel transportation companies will be allowed in excess of 250 gallons. The contractor will keep fuel absorption pads on site during refueling operations. In no circumstance will refueling take place within 50 feet of any surface water.
9. Contractor will provide all material receipts for products being used on the contract to the COR before or at the time of invoicing. This will include, but is not limited to, weigh tickets for stone (with certification from quarry that the product meets specifications) and other materials as requested in the TO. All trucks will be clearly identified by a unique number or marking and this will be listed on the weight ticket.
10. Moisture content of the aggregate will be sufficient to attain compaction and prevent raveling.
11. Moisture content on soil shall be maintained in such a way as to allow compaction and workability. If it is too wet, it shall be allowed to dry; if too dry, it will be moistened or left until conditions are such that moisture content is sufficient to complete work. If it is critical for safety or resource protection, the contractor will not be allowed to wait to complete the work, but will moisten the soil or import soil and complete needed repairs for safety. Payment for water will be made under pay item 91309 Watering, if required.
12. Contractor will provide signs the meet MUTCD requirements with respect to size and location of signs in a work zone. A minimum of 2 warning signs (4” black letters on reflective orange background on 48” x 48” panels) will be placed (one) ahead and (one) behind the work site. The signs will be placed a minimum distance of 500’ but not more than 1500’ behind and ahead of equipment.
Warning of work ahead will be maintained on the trail at all times that equipment and persons are working on the trail or are transiting on the trail.
13. Trails will remain open during the contract, unless agreed to by the FS that a section may be closed for safety or resource protection. Contractor will not hold traffic for more than 15 minutes unless it would be unsafe to pass. Work on some weekends and holidays may be restricted as listed in the TO, due to heavy traffic.
14. In some locations the trails cross surface or buried gas and/or oil distribution lines. The contractor will contact pipeline owners and verify where lines are and take precautions to prevent damage to the lines. The contractor will notify the COR immediately of any exposed pipeline found in or along the trail, GPS its location, and mark the pipeline with flagging or paint. No pipeline will be left exposed upon leaving the area. The Forest will provide information on lines in the TO as to general locations. The FS will also provide oil and gas company names and number where known.
15. Any damage to forest facilities, vegetation, or property caused by the contractor that is outside the work area or is considered non-necessary for the prosecution of work at hand will be repaired at no cost to the Government. This includes damage to trees along the trail. If trees are damaged they will be painted with approved black paint and/or pine tar as required by COR. Contracting Officer may elect to charge contractor up to $50.00 for each damaged tree.
16. Contractor must contact the Ohio Utilities Protection Service (1-800-362- 2764) at least 48 hours but no more than 10 working days (weekends and holidays excluded) in advance of any ground disturbing activities. A call number or case number will be provided to the COR prior to any ground disturbing activities commencing.
17. AT ALL TIMES, THE CONTRACTOR WILL PROVIDE A SAFE WORK
SITE AND WILL MAINTAIN THE TRAILS IN A SAFE MANNER THAT
WILL MINIMIZE HAZARDS TO THEIR WORKERS, THE PUBLIC,
AND FOREST SERVICE PERSONNEL.
18. Contractor will not have more trail tread being worked on than can be completed that day. Contractor will not leave the trail or fords in a manner that would be a public safety hazard or cause erosion or damage in a storm event. If storms are forecast, the contractor will make an effort to “button up” the work to protect it from damage due to a storm.
19. At locations throughout the trail system the contractor will be required to remove barriers such as large A-rock, wood rail fences, downed timber barriers, or other like items to gain access to the trail. Contractor will be required to replace these to prevent others from accessing the trails when they are not on site.
20. In times of extreme fire danger where construction activities will increase likelihood of ignition, a stop work order may be issued. If the suspension is over 7 days, remobilization may be paid if the equipment is removed from the site to a location off Forest in order to complete non-federal work elsewhere.
21. Except for those items or services specifically stated to be furnished by the FS, the contractor shall furnish everything required to perform the work of this contract, task order, and/or attachment(s) to the Acceptable Quality Level indicated in said contract, task order, and/or attachment(s).
