ATTACHMENT D

SUPPLEMENTAL INSTRUCTIONS AND EVALUATION CRITERIA

The Government contemplates award of a Firm-Fixed Price Contract resulting from this solicitation.

I. General Information

A. Offeror is expected to review this entire request for proposal.

B. Offeror shall set forth full, accurate, and complete information as required by this Request for Proposal (RFP) package (including Attachments). The penalty for making false statements is prescribed in 18 U.S.C. 1001.

C. In accordance with FAR 52.212-1 (g), Contract award, the Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest;

accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

D. In responding to this RFP, it is the Offeror’s responsibility to provide current, complete, and accurate information in their proposal. If in reviewing the proposal the Government identifies or otherwise learns that the provided proposal information is not accurate or misrepresents the Offeror’s status or capabilities, that information may be used by the Contracting Officer as part of the Offeror’s responsibility determination and could result in the Offeror not being eligible for award.

E. The proposal must be clear, coherent, and prepared in sufficient detail for effective evaluation. The proposal must clearly demonstrate how the Offeror intends to accomplish the work required and must include convincing rationale and substantiation of all claims. Offeror shall assume that the Government has no prior knowledge of their facilities and experience and will base its evaluation on the information presented in the proposal. To be eligible for evaluation and award, offerors are required to substantially meet all solicitation requirements, such as terms and conditions, technical factors, and pricing information. Failure to comply with all terms and conditions of the solicitation may result in the offeror being removed from further consideration.

II. Period for Acceptance of Offer The Offeror agrees to hold the prices in its proposal firm for 30 calendar days from the date specified for receipt of proposal, unless another time period is specified in an amendment to the RFP.

III. Communications Prior to Award Offerors shall direct all communications to the attention of the Contracting Officer or Contract Specialist listed below in this RFP. Communications with the project officer or other officials may compromise the competitiveness of this acquisition and may result in cancellation of the requirement.

IV. Representation and Certifications The Government will review the Certifications and Representation in www.sam.gov

V. Preparation Cost This RFP does not commit the government to pay for the preparation and submission of a proposal. The Contracting Officer is the only individual who can legally bind the Government to the expenditure of public funds in connection with this procurement.

70B03C23R00000014 and “Request for Clarifications.” Questions received after the deadline date may be considered on a case-by-case basis.

VII. Submission Process Proposals shall be submitted to david.torres@cbp.dhs.gov by March 8, 2023, 4:00pm E.S.T. Offeror shall note in the email subject line: “Proposal for 70B03C23R00000014.

VIII. Overview

Proposals must be prepared and submitted in accordance and in compliance with the instructions of this solicitation. This is a best value award decision; the evaluation criteria for this award will be based on the factors described below. The non-price evaluation factors are of equal importance. Price is the least important factor. The importance of Price will increase as the differences in non-price factors’ ratings between the offerors decrease.

Factor 1: Technical Management (15-page limit) - The Factor 1 proposal shall be prepared in such a manner as to enable the Government reviewers to make a thorough evaluation and arrive at a sound determination of whether the proposal meets all technical requirements of the solicitation. The Factor 1 response should be sufficiently specific, detailed, and complete to clearly and fully demonstrate that the offeror has a thorough understanding of the requirements set forth in the solicitation. The offeror must submit an explanation of its proposed technical approach in conjunction with the tasks to be performed in achieving the Statement of Work requirements. The proposal must include benefits and expected outcomes of the technical solution, as well as any documented risks and mitigation planning.

Additionally, the Factor 1 proposal shall include the sub-factor, Staffing Plan, as specified below. The Staffing Plan is part of the Technical Management submission.

Staffing Plan

The Offeror shall provide appropriate staff to meet the Government’s requirements. The Offeror shall provide a Staffing Plan that includes the types of personnel and their respective roles, and a summary of the resources, tools and methods that the Offeror shall utilize to provide the necessary services and performance standards as specified within the SOW.

Additionally, the plan shall provide information on how the offeror will onboard and maintain experienced staffing for the technical solution.

Factor 2: Past Performance (5-page limit) – The Offeror shall describe a minimum of one (1) and a maximum of four (4) past projects similar in scope, size, and complexity to the requirement described in the SOW for which the Offeror was the prime contractor. Descriptions shall be sufficiently detailed to allow evaluators to judge relevancy to this Program within the page limits specified. All specialized experience must be ongoing or have been completed within the past five (5) years of the RFP closing date. Offerors may include projects with the Federal Government, agencies of state and local governments, and commercial customers.

Additionally, The Factor 1 submission shall include a discussion how the offeror’s own past performance will contribute to its likelihood of success on the proposed contract. The ideal submission will include experiences identifying the offeror’s role and contribution. The past performance discussion may address the offeror's own experience, and not any experience of its parent, affiliates, subcontractors, or teaming partners.

In no past performance is provided, this factor will be rated neutral.

Factor 3: Price (5-page limit)– Offeror shall provide firm, fixed pricing for all items listed in Section I Schedules of the solicitation/RFP. This is a firm, fixed-price requirement. Offerors shall submit a Microsoft Word, Excel spreadsheet or PDF in the Offerors’ format. The price submission shall provide visibility into the buildup of the offered prices; including unit pricing, proposed discounts against established prices, as well as any assumptions or narratives necessary to address the Contractor’s reasoning for the pricing provided.

Additionally, the price proposal may provide a pricing narrative of any price discounts against established pricing.

IX. Site Visit

A mandatory site visit is scheduled from February 8-10, 2023 (see attachment I for itinerary). Late arrivals will not be allowed to conduct the site visit. Interested offerors should contact the COR, Edward Zion listed in section 7.0 by of the Statement of Work by email for the appointment no later than February 7, 2023, by 4:00pm E.S.T. and copy Contract Specialist David Torres david.torres@cbp.dhs.gov on the email.

Vendors that submit proposals without site visits will not be considered for award. A limit of 1 person per company will be allowed. Any potential offeror conducting a site visit must provide proof of Small Business 8 (a) program current active status prior to attending the site visit. Offerors that cannot provide proof of their Small Business 8 (a) status will not be allowed to conduct a site visit.

The site visit Itinerary is in Attachment I. No questions will be allowed during the site visit. All questions must be submitted by email to the point of contact in section VI of this document.

I. Proposal Preparation Compliance Determination

The Government will review proposals submitted to determine compliance with the proposal preparation instructions. If it is determined that the proposal is substantially not in compliance with the instructions, the Government may deem the proposal to be unacceptable and it will not be evaluated further. The proposal may be removed from consideration for contract award.

II. FAR 52.212-2 Evaluation—Commercial Products and Commercial Services (NOV 2021)

The Government will award a firm fixed priced contract resulting from this solicitation.

Factor Overview:

Proposals must be prepared and submitted in accordance with and in compliance with the instructions of this solicitation. This is a best value award decision; the evaluation criteria for this award will be based on the factors described below, in descending order of importance:

Factor 1 – Technical Management/Staffing Factor 2 – Past Performance Factor 3 – Price

The Government will use confidence ratings to evaluate the non-price factors.

Basis for Award:

It is the Government’s intent to award a firm, fixed-price contract to the responsible Contractor whose quote provides the overall best value based on a trade-off analysis considering all factors.
