About this file
This document is a Contract Amendment No. 3 between the Florida Department of Management Services and L.V. Hiers, Inc., pertaining to a contract for bulk fuel, gasoline, and diesel. The contract was originally effective July 1, 2019, and was previously renewed for a three-year period, with an initial expiration date of June 30, 2025. The amendment is being executed by both parties through their authorized representatives.
The contract amendment extends the existing contract for an additional six months, establishing a new expiration date of December 30, 2025. The amendment introduces two key additions: a new section on termination related to statutory certifications, which allows the Department to terminate the contract if the contractor is placed on certain prohibited lists, and a new section requiring an annual warranty of ability to perform. The contractor must submit a Vendor Certification Form annually, affirming there are no pending actions that would prohibit fulfilling contract obligations. The amendment also requires the contractor to promptly notify the Department of any potential performance issues, including placement on various vendor lists or potential inability to renew the contract.
