5. Demonstration that the Contractor’s Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Select proprietary products to be used on 523A4-CSI-211 SPECT/CT (Rm. 2C-118). These sole source proprietary products are:

a) Corbin Russwin Door Hardware – Corbin Russwin is the existing VA West Roxbury

Engineering building standard for door locks that is installed and operating campus wide at the West Roxbury VAMC. Corbin Russwin products are compatible with the Kaba Peaks keying system used on the West Roxbury VAMC campus; other manufacturer’s door locks may not be compatible with the Kaba Peaks keying system and may not operate properly or operate at all with the Kaba Peaks keying system. The West Roxbury campus has an existing locksmith with inventory of Corbin Russwin door locks and spare parts; it would be uneconomical for VA locksmith to create additional inventories of other manufacturer’s door locks. Therefore, only this manufacturer’s products are acceptable; no substitutions.

b) Kaba Peaks Lock Cylinders with Removable Cores – Kaba Peaks Lock Cylinders with

Removable Cores is the existing VA West Roxbury Engineering building standard for door lock cylinders that is installed and operating for the keyed security system campus wide at the West Roxbury VAMC. Other manufacturer’s cannot make the Kaba Peaks lock cylinder and would not be compatible with the existing keyed security system. The West Roxbury campus has an existing locksmith with inventory of 6-pin LFIC; in order for the new door lock cylinders with removable cores on this project be coordinated with the existing locksmith and inventory, the door lock cylinders with removable cores must be Kaba Peaks 6-pin LFIC door lock cylinders with removable cores. Therefore, only this manufacturer’s products are acceptable; no substitutions.

c) TRANE Building Technology Direct Digital Control HVAC Building Management

System including components - TRANE Building Technology Direct Digital Control (DDC) HVAC Building Management System is the existing building management control system installed and operating campus wide at the West Roxbury VAMC. Any products to be used on the existing HVAC Building Management System must interface with the existing system. To minimize the technical risks of ensuring compatibility among the component parts and integration of the entire DDC system with the campus wide system, the system and components installed in this project should be provided by the same manufacturer as that of the campus wide system; other manufacturer’s components may not operate properly or operate at all on the existing system. The VA has existing service contracts with TRANE. It is cost effective for the new DDC system and components to be installed and maintained under the existing service contracts with TRANE. Introducing other manufacturer’s products may void the existing DDC system’s

OFOC SOP Revision 08 Page 3 of 5

Revision 08 Date: 04/18/2018 manufacturer’s warranty. Therefore, only this manufacturer’s products are acceptable; no substitutions.

d) General Electric/EST-3 Fire Alarm System as assemble and bench tested by the manufacturer of record, Signet Electronic Systems, Inc.: General Electric/EST-3 Fire Alarm System as assembled and bench tested by the manufacturer of record (Signet Electronic Systems, Inc.) is the existing fire alarm system installed and operating campus wide at the West Roxbury VAMC. National Fire Protection Association (NFPA), Building Code, Life Safety Code and VA Standard require Fire Alarm systems to be the product of one manufacturer to maintain UL listing, NFPA compliance testing and hospital certification. This project will include fire alarm system installation that is an extension of the existing campus wide code compliant and certified fire alarm system.

Any products to be used on the existing fire alarm system must be the existing system’s products In order to ensure system compatibility and to maintain manufacturer’s warranty; other manufacturer’s components may not operate properly or operate at all on the existing system. Therefore, only this manufacturer’s products are acceptable; no substitutions.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

a) The existing TRANE Building Technology Direct Digital Control HVAC Building Management System was procured under a contract awarded through full and open competition. The new system must interface with this fully competed installation.

b) The existing General Electric/EST-3 Fire Alarm System as assembled and bench tested by the manufacturer of record, Signet Electronic Systems, Inc., were procured under a contract awarded through full and open competition. The new system and components must interface with this fully competed installation.

c) The existing Corbin Russwin Door Locks were procured under a contract awarded through full and open competition. The new system and components must interface with this fully competed installation.

d) The existing Kaba Peaks Lock Cylinders with Removable Cores were procured under a contract awarded through full and open competition. The new door lock cores must interface with this fully competed installation.

Reasonable:

The anticipated price to the Government for the items requested to be brand name is under the Simplified Acquisition Threshold ($250,000.00).

OFOC SOP Revision 08 Page 4 of 5

Revision 08 Date: 04/18/2018

The items for which brand name approval is being requested are incidental to the overall construction project. This procurement will be competed and awarded based on competition; the Contracting Officer will make a determination of fair and reasonable pricing prior to award.

8. Description of the Market Research Conducted and the Results, or a Statement of the

Reasons Market Research Was Not Conducted:

Market research was conducted for the required items when they were initially installed in the main facility and out-buildings. The items required for the addition are brand name to support current systems, standardization throughout the facility, and the safety of patients and employees. Approval of the items as brand name is critical for the overall efficiency and effectiveness of the addition and the entire facility.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

Standardization of most facility systems according to the preponderance of long term industry data results in substantially reduced costs for parts as well as maintenance and repair labor that far outweigh the potential savings to be had by full and open competition.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

Not applicable. It is the responsibility of the offeror awarded the contract to locate suppliers and obtain pricing for all materials and components, including the items listed in this justification.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any

Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

There will be competition for the overall procurement. It will be the responsibility of the offerors to obtain pricing from the suppliers for the items and to submit a competitive proposal for the project.

12. Requirements Certification: I certify that the requirement outlined in this justification is a

Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
