SCOPE OF WORK (6/24/2020)
The Contractor shall provide labor, materials, and equipment to install network data ports in the rooms listing in the table below. Work shall include but not be limited to cable terminations, faceplates, wall jacks, inserts, and labeling within buildings defined by this statement of work. The Contractor shall provide maintenance on either end of the cable termination as needed. Cable terminations may need to be performed in office and clinical spaces, IT closets, points in the ceiling, floor receptacles, furniture raceways and power poles. The Contractor shall provide all materials, parts and labor needed to pull and terminate the cable. The Contractor shall provide all end-to-end testing on each data service performed as defined by this statement of work. A copy of the test results shall be provided to the COR for each instance, either as a printed copy or an electronic file emailed to the COR once complete.

CABLE DISTRIBUTION SYSTEM
The Contractor shall conform to the following cable distribution system standards:
| 1. | The Contractor shall ensure the installation of any new cable shall be IAW VASFHCS Codes of Practice, EIA/TIA T568b, Commercial Building Telecommunications Wiring Standards, and coordinated with VA COR. Cable to be installed shall conform to EIA/TIA 568b, 569, 606, 607, and EIA/TIA TSB 40. Additionally, all work is required to follow the NFPA 70- National Electrical Code (NEC) code, which provides guidance on the installation of wiring. The Contractor shall notify the Contracting Officer and the COR when existing cables are not compliant to the wiring standards. The Contracting Officer may authorize the repair work to the existing cables. |
| 2. | The Contractor shall be responsible for installing/replacing any breach or gap in a fire-rated substrate with the use of an approved firestop system or other code approved method in order to restore the integrity of the substrate. The Contractor shall report any findings of deficient penetrations not meeting the firestop code requirements to the COR. All work shall confirm to International Building Code (IBC) and International Fire code (IFC) chapter 7 for required firestopping containment in new construction and maintenance of existing buildings. All work shall also conform to NFPA 101 chapter 8 for standards in health care. |
| 3. | The Contractor shall ensure that all conductors are cabled to ensure against induction in voice or data circuits. Cross talk attenuation within the cable system shall be a minimum 80db throughout the frequency range. |
| 4. | The Contractor shall ensure that all new cable is labeled on each end and fully tested. The cable records shall identify each cable as labeled, used cable pairs, spare cable pairs and bad cable pairs. Minimum test requirements for cables are for testing for opens, shorts, crosses, and split pairs. These tests are telecommunications continuity tests based on EIA/TIA telecommunications standards. See Attachment A for data cable labeling requirements. |
OUTLET JACKS AND STATION CABLE
The Contractor shall conform to the following outlet jacks and station cable standards:
| 1. | Only Category-6 Cabling will be installed. |
| 2. | Each faceplate shall be a 6-plex typeface plate, with RJ45, 568B jacks. Only four jacks per face place (two (2) voice, two (2) data). |
| 3. | Where there are no existing telephone outlets installed, and the new installation point is a hollow wall, provide and install a flush mounted box with RJ45 type, 568B jacks. For surface mounted installations, the contractor shall provide outlet boxes. |
| 4. | All cable distribution closets shall be wired per industry (EIA/TIA 568) standards. All telephone installations shall come from a terminal board via telephone cable tray and conduit to termination point in a designated room. |
| 5. | All telephone cable/wiring shall be installed in conduit, or in existing raceway or j-hook path. Where there is no existing or available path, the contractor shall install the necessary conduit or raceway. |
| 6. | Cable runs shall be no more than 300 feet from end-to-end, to include vertical length, slack and rise. |

Attachment A: Labeling requirements. Each end of wire will need a label designating Wing, Floor, Room, and Jack Number.
INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO BIDDERS/OFFERORS
INSTRUCTION TO OFFERORS
1. INTRODUCTION:
a. These instructions prescribe the format of Offers. Offers are defined as consisting of the Prime Contractor’s Price Proposal. These instructions are designed to ensure the submission of necessary information and documentation to provide for the comprehensive evaluation of offers.
b. Offerors are cautioned to carefully review this solicitation prior to commencing preparation. In order for offers to receive full consideration for award, offerors should ensure that the information and documentation furnished in support of the price proposal and other required documents are current, factual, accurate, and complete.
c. Offerors are strictly advised to comply with all instructions within this solicitation to ensure submission of a complete offer. Failure to furnish a complete offer per the instructions in this solicitation, at the required time and on the required date, may result in the Offeror’s proposal being determined ineligible.
d. The Government intends to award without discussions, unless discussions are in the best interest of the Government.
2. CONTRACT TYPE:
a. The awarded contract will be a firm fixed price (FFP) contract.
b. This solicitation is a total set-aside for Service-Disabled Veteran Owned Small Business (SDVOSB) per FAR 19 and Public Law 109-461. The offeror MUST have an active DUNS number and be current in System for Award Management (SAM) as an SDVOSB concern under the applicable NAICS. In addition, the offeror MUST be a Service-Disabled Veteran Owned Small Business (SDVOSB) in the VIP with a “verified” status at time of bid submission and at time of contract award. If the offerors SDVOSB status changes in SAM or VIP at any time prior to award, the offeror will not be eligible for award under FAR Part 9.104.
3. SUBMISSION INSTRUCTIONS:
a. One (1) electronic copy via (email shall be less than 10MB) of the price proposal and all other required documents are to be sent to arrive on or before the due date/time to the following email address:

4. PROPOSAL DUE DATE SCHEDULE:
Offers/Proposals are due by the date and time set for the receipt of proposals shown in Block 13 of the SF 1442.
5. QUESTIONS CONCERNING THIS RFP:
All Requests for Information (RFIs) regarding this RFP must be submitted in writing and received NLT 4:00 P.M. PT on August 5, 2020 in order to allow replies to reach all prospective offerors in a timely manner. Questions/RFIs shall be sent via email to Denise R. Groves at denise.groves@va.gov.
6. SITE VISIT/Pre-Proposal Conference:
Due to the current COVID environment and the locations of all the rooms, there will be no site visits for this project.
7. PROPOSAL VOLUME CONTENTS:
a. Completed SF1442
b. Completed Supplemental Pricing Breakdown. The pricing sheet must be complete to the room level, or, at a minimum, pricing shall be grouped by area. Area’s are noted by highlighted sections of the sheet.
c. PER VHA DIRECTIVE 7715 (06 April 2017): SAFETY & ENVIRONMENTAL RECORD AND EXPERIENCE MODIFICATION RATE (EMR): To be eligible for consideration and award, the contractor shall have no more than three serious, or one repeat, or one willful OSHA or EPA violation(s) in the past 3 years and have an EMR of equal to or less than 1.0. Therefore, all bidders shall submit the following information pertaining to their past Safety & Environmental Record and EMR with their bid/proposal:
i. SAFETY & ENVIRONMENTAL RECORD: A self-certification on company letterhead that the bidder has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years. Include the following table and signature block:

ii. EMR: All bidders shall submit information regarding their current EMR. This information shall be obtained from the bidder’s insurance carrier and be furnished on the insurance carrier’s letterhead.

BASIS FOR AWARD
1. INTRODUCTION
a. The Government intends to award a firm fixed price (FFP) contract to the lowest fair and reasonable price, which is responsible in accordance with FAR 9.104 received in response to this solicitation.
b. Offers are cautioned that the Government intends to award without discussions based solely on initial offers received.
c. Only one award will be made in response to the solicitation.
2. EVALUATION PROCESS. Offers will be evaluated as follows:
a. Step 1: All offers will be evaluated for adherence to the solicitation requirements. (Failure to provide all necessary and required documents will make the offer ineligible for award)
b. Step 2: The Government will evaluate the responsive lowest price offer to determine if the price is fair and reasonable for the work to be performed and not materially unbalanced at the line item or total contract level. The Government will evaluate the lowest price offer through the use of price analysis. To be considered fair and reasonable for the work performed, the evaluators will also check for appearance of unbalanced line item prices. The pricing schedule information will be used to assist the Government in performing the price evaluation. Offers which are materially unbalanced are not fair and reasonable. An Offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.
c. Step 3: If the responsive lowest price offer is determined fair and reasonable for the work to be performed and not materially unbalanced, the Government will evaluate the offer for responsibility in accordance with FAR Part 9.104.
d. Step 4: If the responsive lowest price offer is fair and reasonable and responsible under FAR 9.104, award will be made to that offeror.
e. Step 5: If not, the Government will evaluate the next lowest price offer adhering to the requirements of the solicitation, repeating steps 2-4 until a responsive, responsible lowest evaluated fair and reasonable priced offer is identified. The Government intends to award without discussions. The Government, however, reserves the right to conduct discussions if deemed in its best interest
2.1 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.2 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.
(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is City of San Francisco County of San Francisco State of California (End of Provision)
2.3 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

3.2 52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (DEC 2019) The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications—Commercial Items.
(a) Definitions. As used in this provision— Covered telecommunications equipment or services, critical technology, and substantial or essential component have the meanings provided in clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(d) Representation. The Offeror represents that it [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.

GENERAL CONDITIONS
4.1 52.204-19 INCORPORATION BY REFERENCE OF REPRESENTATIONS AND CERTIFICATIONS (DEC 2014) The Contractor's representations and certifications, including those completed electronically via the System for Award Management (SAM), are incorporated by reference into the contract.

4.2 52.204-23 PROHIBITION ON CONTRACTING FOR HARDWARE, SOFTWARE, AND SERVICES DEVELOPED OR PROVIDED BY KASPERSKY LAB AND OTHER COVERED ENTITIES (JUL 2018)
(a) Definitions. As used in this clause—Covered article means any hardware, software, or service that—
(1) Is developed or provided by a covered entity;
(2) Includes any hardware, software, or service developed or provided in whole or in part by a covered entity; or
(3) Contains components using any hardware or software developed in whole or in part by a covered entity.
Covered entity means—
(1) Kaspersky Lab;
(2) Any successor entity to Kaspersky Lab;
(3) Any entity that controls, is controlled by, or is under common control with Kaspersky Lab; or
(4) Any entity of which Kaspersky Lab has a majority ownership.
(b) Prohibition. Section 1634 of Division A of the National Defense Authorization Act for Fiscal Year 2018 (Pub. L. 115–91) prohibits Government use of any covered article. The Contractor is prohibited from—
(1) Providing any covered article that the Government will use on or after October 1, 2018; and
(2) Using any covered article on or after October 1, 2018, in the development of data or deliverables first produced in the performance of the contract.
(c) Reporting requirement. (1) In the event the Contractor identifies a covered article provided to the Government during contract performance, or the Contractor is notified of such by a subcontractor at any tier or any other source, the Contractor shall report, in writing, to the Contracting Officer or, in the case of the Department of Defense, to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (c)(1) of this clause:
(i) Within 1 business day from the date of such identification or notification: The contract number; the order number(s), if applicable; supplier name; brand; model number (Original Equipment Manufacturer (OEM) number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the report pursuant to paragraph (c)(1) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of a covered article, any reasons that led to the use or submission of the covered article, and any additional efforts that will be incorporated to prevent future use or submission of covered articles.
(d) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts, including subcontracts for the acquisition of commercial items.

4.3 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 90 days after receipt of notice to proceed. The time stated for completion shall include final cleanup of the premises.

4.4 52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (MAY 2020)
(a) Definitions. As used in this clause— Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts—
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, when the Contracting Officer explicitly requires it for an order issued under a multiple-award contract.
(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at https://www.sba.gov/document/support--table-size-standards.
(e) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraph (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.
(g) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (f) or (h) of this clause.
(h) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:
