This project is to construct an approximately 6,600 square foot expansion to the Spinal Cord Injury Unit and renovate the existing Spinal Cord Injury Unit to increase the number of beds from 40 to 50. All construction work shall adhere to the latest JCAHO, NFPA, and life safety requirements, and be performed without affecting the medical center's operations. All work shall be performed at the Michael E. DeBakey VA Medical Center located in Houston, TX per the contract specifications, drawings and attached documents herein.
B. Contractor shall use the attached US Department of Labor Wage Determinations TX190253 in accordance with the Davis Bacon Act.
C. The magnitude of construction is between $5,000,000 and $10,000,000 per FAR 36.204 and VAAR 836.204. Bid bonds, and payment and performance bonds are required.
D. NAICS code for this project is 236220 with a small business size standard of $36.5 million.
E. This is a total Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside competitive procurement pursuant to Public Law 109-461 (38 USC 8127). The SDVOSB is required to perform a minimum of 15% of the construction work. The SDVOSB must be a small business under the relevant NAICS code. Vendors submitting proposals under a Joint Venture shall submit a copy of their Joint Venture agreement with their offer. Joint Ventures shall comply with VAAR 819.7003(c).

DESCRIPTION OF WORK: Contractor shall provide all labor, materials, tools, equipment, expertise, administration, supervision and transportation to construct an approximately 6,600 square foot expansion to the Spinal Cord Injury Unit and renovate the existing Spinal Cord Injury Unit as specified herein at the Michael E. DeBakey VA Medical Center located at 2002 Holcombe Boulevard, Houston, Texas 77030. All work shall be performed in accordance with the project plans and specifications.
BASIS OF AWARD: A single award will be made on Line Item No. 1, but in the event the offer exceeds the funds available, a single award will be made on Line Item No. 2, Line Item No. 3, or Line Item No. 4 in that order, based on available funding. The line items are listed in descending order of importance. Offerors shall provide a total contract price on each line item listed. The project’s period of performance is reflected in each bid line item.
LINE ITEM NO. 1: Base - Includes all work as indicated on the drawings and the specifications to expand and renovate Spinal Cord Injury Unit. The project period of performance is 730 calendar days.

LINE ITEM NO. 2: Alternate # 1 – Includes all work as indicated on the drawings and the specifications to expand and renovate Spinal Cord Injury Unit except the following items below. The project period of performance is 730 calendar days.
· Existing Internet Café to remain as indicated on plan. Existing curtain wall located between Internet Café and proposed Break Room to be removed. Provide new smoke partition in same location as the curtain wall being removed.
· Scheduled millwork for Nurse Station Room 1B-417 to be deleted from scope of work. Scheduled electrical and data outlets to remain as part of the scope.
· Scheduled millwork for Secretary Room 1B-432 to be deleted from scope of work. Scheduled electrical and data outlets to be installed at east wall of space. Eliminate scheduled fur down and continue scheduled ceiling in C1B-119 into reception space.
· Delete 3 Form material and associated stand offs from millwork shown on Sheet AE-213 detail D1 for Reception 1B-410. Delete LED electrical lighting and associated electrical power and switches.
· Relocation of existing interior Internet Café fixed glazing and horizontal automatic sliding glass door systems to be deleted. Relocate existing Dayroom horizontal automatic sliding glass door at opening for deleted door. Extend partition construction to close opening at deleted fixed glazing. Provide HR-1 handrail and crashrail @ hallway wall surfaces.
· Work includes installation of 2 Hour fire smoke partition scheduled at east end of 1B space, continuing as shown including through both 1B and addition spaces constructed whether or not any deduct is taken.
· Refer to AE-221 for base bid patient room finish trim at headwall. Refer to AE-222 for patient room head wall construction to be built with deduct Option #1.
· Delete LVT-3 finish. Expand adjacent LVT-2 finish into deleted LVT-3 areas. See IN-101, IN-102, & IN-103 for LVT floor patterns.

LINE ITEM NO. 3: Alternate # 2 – Includes all work as indicated on the drawings and the specifications to expand and renovate Spinal Cord Injury Unit except items listed in Line Item No. 2 and the following items below. The project period of performance is 640 calendar days.
· Remove Phase 4 from scope of work with exception to HVAC and ceiling. Remove existing and provide new HVAC system to rooms as scheduled and new acoustical ceiling system in patient room. Reinstall existing curtain tracks, light fixtures and other existing ceiling mounted fixtures and accessories. Patch, repair, and paint patient room toilet ceilings affected by construction.
· Provide and install scheduled 2 Hour fire partition as shown from exterior wall, through patient room and across hallway to align with 2 Hour fire smoke partition at clinic construction. 2 Hour fire partition is to be constructed whether or not deduct is taken. Location varies with deduct and is constructed as part of existing partition. Extend to underside of interstitial deck above. Field verify double egress door location to allow doors to be on magnetic hold opens without obstructing access to adjacent rooms. Provide closers with greater swing angle as needed. Relocate existing and adjacent storage room door if needed.

INFORMATION REGARDING BIDDING MATERIAL, BID GUARANTEE AND BONDS
Offerors shall follow the instructions contained herein. These instructions prescribe the proposal format and describe the approach for development and presentation of the proposal. These instructions are designed to ensure the submission of necessary information. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications. The Contracting Officer has determined there is a high probability of adequate competition in this acquisition. Interested offerors shall be solely responsible for all costs associated with this solicitation including but not limited to the preparation of proposals.
The Government plans to make an award without discussions. Therefore, each initial offer shall contain the offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions, if it is determined to be necessary.
Price proposals and Technical proposals of each offeror will be evaluated independently. Offerors shall submit as separate attachments titled, “Price Proposal” and “Technical Proposal”. Each attachment must contain a cover sheet with the offerors name, business address, and VA Solicitation Number.
Proposal shall be (1) submitted on the forms furnished by the Government or on copies of those forms; and (2) manually signed. The person signing the proposal shall initial each erasure or change appearing on any proposal form.
Offerors shall submit proposed prices for ALL priced line items as listed in the schedule. Failure to submit proposed prices for ALL bid items will result in the proposal being rejected as unacceptable without further consideration.
Alternate proposals will NOT be considered. The following documents shall be submitted to the Contract Specialist on the due date and time listed on the SF 1442. Electronic proposals transmitted through an electronic commerce method including but not limited to telegraph, fax, or email are NOT authorized under this solicitation and will NOT be accepted. The offeror shall submit two (2) separate proposals: Price and Technical/Past Performance and identified accordingly. Price proposal shall be submitted in one (1) original hard copy. Technical/Past Performance proposal shall be submitted in one (1) original and two (2) hard copies.
The price proposal shall be arranged in the following order:
1. 2-page SF1442 completed and signed by the signatory authority. All blocks under section “OFFER” on page 2 of SF1442 (Item 14 thru 20C) shall be completed. Offerors shall be solely responsible for monitoring Government’s website www.fbo.gov for amendments to this solicitation if any and acknowledge them in accordance with the requirements stipulated in this solicitation and amendments.
2. Duly executed Bid Bond/Guarantee: Offerors shall use form SF24 Bid Bond. Bid bonds that are found noncompliant with bid guarantee requirements may result in the rejection of the bid. See clause 52.228-1 Bid Guarantee for additional information on the compliance with bid guarantee requirements.
3. To be eligible for award, Offerors are required to be CVE SDVOSB certified and have an active account in SAM. Offerors must register their businesses at http://www.vetbiz.gov/ and https://www.sam.gov/portal/public/SAM/ and complete the ORCA. Upon request by the Government, Offerors shall submit a printout of their ORCA.

It is solely the responsibility of the offerors to ensure the Government receives the proposal before or on the exact due date and time set forth in this solicitation.
Offerors shall provide the Contract Specialist confirmation of delivery via email to tabitha.contreras@va.gov prior to the closing date if the offeror uses a mail carrier, such as FedEx, UPS, or USPS. Tracking number and the name of the person who signed for the package is required.

Government’s responses to inquiries will be issued in the form of Amendment(s) to be posted on the same website where this solicitation is posted: www.fbo.gov. All interested offerors including those submitting inquiries are required to monitor the above website for any posted amendments and acknowledge them in accordance with the instructions provided in the amendments as well as in this solicitation.
All proposals submitted on time and in accordance with provision 52.215-1 will be evaluated for the conformance to all requirements of this solicitation. Any proposal that fails to conform to the requirements of this solicitation will be rejected as nonresponsive.
BASIS FOR CONTRACT AWARD:
SOURCE SELECTION USING THE LOWEST PRICE TECHNICALLY ACCEPTABLE PROCESS (LPTA): This is a competitive Request for Proposal (RFP) that represents the best value to the Government conducted under FAR Part 15, Lowest Price Technically Acceptable (LPTA) source selection process. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors.
The Government intends to evaluate proposals and award a contract without discussions. Therefore, the offeror’s initial proposal shall contain the offeror’s best terms from a price and technical standpoint. Offerors are cautioned to submit sufficient information and, in the format, specified in the instructions to offerors section of this solicitation. Communication conducted to resolve minor or clerical errors would not constitute discussions and the Contracting Officer reserves the right to award a contract without the opportunity for proposal revisions. There will be no public bid opening.
Award will be made to the responsible, lowest price technically acceptable offeror that meets or exceeds the acceptability standards for all non-cost factors. Lowest price offer will be determined by the Government by comparison method of all offers received. A single award will be made as described in the Price Offer Schedule that is most advantageous to the Government.
EVALUATION OVERVIEW:
Proposals will be evaluated and ranked according to price, from lowest to highest. The Government reserves the right to evaluate only the technical proposal of the lowest price offeror. Other technical proposals may not be evaluated unless the Government determines the lowest priced offeror to be unacceptable. In the event the Government determines the lowest priced offeror to be unacceptable, the technical proposal of the next lowest price offeror will be evaluated. This process will continue until a technical proposal is determined to be acceptable. The lowest offeror deemed acceptable in all non-cost factors shall be the apparent awardee.
PRICE EVALUATION:
Price proposals will be evaluated and ranked according to price, from lowest to highest. Price will not be evaluated other than to ensure price reasonableness. The Government may use various price analysis techniques and procedures to make a price reasonableness determination. Note: Offers that are not technically acceptable cannot be selected, regardless of price. Offerors submitting price proposals in response to this solicitation do so with the complete and full understanding that the Government reserves the right to publicly announce the total contract award amount.
PAST PERFORMANCE:
Past performance will be rated in accordance with FAR 15.305 utilizing the Past Performance Questionnaire attached to this solicitation. In addition, pursuant to FAR 9.103 prescribing that purchases shall be made from, and contracts shall be awarded to, responsible prospective contractors only, the Government will perform the determination of responsibility on the apparently lowest offeror whose proposal is deemed technically acceptable. The Government’s determination of responsibility will be performed in accordance with FAR 9.1 and will include but not be limited to the review of all federal excluded or debarred lists from different U.S. departments, and from the Federal Awardee Performance and Integrity Information System (FAPIIS), available at www.ppirs.gov. Since this solicitation is set aside 100% for Service-Disabled Veteran-Owned Small Business (SDVOSB), the Government will refer the matter to the Small Business Administration which will decide whether to issue a Certificate of Competency if the Government deems a potential SDVOSB awardee non-responsible.
TECHNICAL EVALUATION:
The Technical evaluation factors consist of two separate elements: Experience and Performance Schedule. Technical proposals will be judged on a ‘pass/fail’ basis. Each element must receive a ‘pass’ in order for the proposal to be deemed technically acceptable.
I. EXPERIENCE – Offers shall address the following three (3) sub-factors in narrative form. Offers that do not describe each topic in enough detail or provide the requested documentation will be rated as ‘fail’ and be considered technically unacceptable.
1. Provide documentation of specific projects (minimum of three) relating to the construction of expanding and renovating inpatient clinics within a hospital environment, successfully completed or in progress, that was coordinated and performed by the general contractor and/or subcontractor in the last five (5) years, from the date this solicitation was issued, of similar magnitude ($5,000,000 to $10,000,000), scope, and complexity. Provide the following information for each contract/project submitted for evaluation:

Provide the names of the general contractor’s proposed project Site Superintendent and Project Manager with a description of the individual’s experience to include, at a minimum, one successfully completed hospital expansion project of similar size, scope, and complexity within the last five (5) years, from the date this solicitation was issued.
3. Provide a list of sub-contractors that your firm intends to use for this solicitation’s proposed project and include the subcontractor’s company name, and the number of years’ experience with hospital expansions. Minimal experience required for the civil, structural, and erector subcontractors is three years from the date this solicitation was issued.
II. PERFORMANCE SCHEDULE – Offers shall include the general contractor’s project schedule for this solicitation’s proposed project to showcase, at a minimum, completing the project (base bid) within the mandatory timeframe of 730 calendar days.
III. PAST PERFORMANCE – Submit a completed Past Performance Questionnaire (PPQ) for all projects your firm listed in its response to Evaluation Factor #1, Experience. To meet the minimum standard, the completed PPQs must be rated as Satisfactory or better for each question. Please note: the references shall submit the PPQ to the Contract Specialist as specified in the PPQ. Offerors are not permitted to submit the PPQ as these will not be considered. The PPQ that shall be used is attached to this solicitation.

2.2 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.3 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.

2.4 52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—
(1) To unsuccessful bidders as soon as practicable after the opening of bids; and
(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.
(c) The amount of the bid guarantee shall be 20 percent of the bid price or 3,000,000, whichever is less.
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

2.5 52.225-12 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS UNDER TRADE AGREEMENTS (MAY 2014)
(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "designated country construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials Under Trade Agreements" (Federal Acquisition Regulation (FAR) clause 52.225-11).
(b) Requests for determination of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of FAR clause 52.225-11 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction materials, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(4)(i) of FAR clause 52.225-11.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign construction material, other than designated country construction material, that is not listed by the Government in this solicitation in paragraph (b)(3) of FAR clause 52.225-11, the offeror also may submit an alternate offer based on use of equivalent domestic or designated country construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of FAR clause 52.225-11 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of FAR clause 52.225-11 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic or designated country construction material, and the offeror shall be required to furnish such domestic or designated country construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

2.11 VAAR 852.236-92 NOTICE TO BIDDERS—ADDITIVE OR DEDUCTIVE BID LINE ITEMS (APR 2019)
(a) Additive or deductive line items in the bid schedule shall be evaluated to determine the low offeror and the items to be awarded. The evaluation shall be made as follows—
(1) Prior to the opening of bids, the Government will determine the amount of funds available for the project.
(2) The low bid shall be the Bidder that—
(i) Is otherwise eligible for award; and
(ii) Offers the lowest aggregate amount for the first or base line item, plus or minus (in the order stated in the list of priorities in the bid schedule) those additive or deductive line items that provide the most features within the funds determined available.
(3) All bids shall be evaluated on the basis of the same additive or deductive line items.
